Sii��i ��ivuCi't vi�v.v fvv� V'hPn 3n �'ee� IS i�C�1L'.l.e�� �::� • WHEREAS, for the purpose of constructing an attached garage, a decorative wing wall and an oversized overhang the Owners have made application to the City for a variance to Municipal Zoning Code Section 78-1403 to allow stiuctural lot coverage of 22.9 percent wl�en 15 percent is allowed; and WH��AS, for the purpose of adding an attached garage and decorative wing wall to the existin� residence the O�vners have made application to the City for a variance to Municipal Zoning Code Section 78-128� to allow 16 percent hardcover in the 0 to 75 foot zone when none is allowed and to allow 61.4 percent hardcover in the 75 to 250 foot zone when 25 percent is allowed; and 'IJVN�i RF�C� ?fter ��,e �>>1J1iSre� notice an� mailed ??Ot1C� lIl 2CCOIC��nCP Wlt�1 Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Plaiu7ing Commission held a pubiic nearing on November 2U, 2vu6, at which zimes ali persons ciesiring to be heard concerning this application were given the opportunity to speak thereon. Page 1 of 6 � � °� . o 0 � CITY of ORONO � .;: � ti ti RfSOLUTION OF THE CITY COUNCIL �L� 4�G No. 5 5 t 0 k'ESH.� NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Miruzesota: FINDINGS 1. This application was reviewed as Zoning File#06-3245 2. The property is located in the LR-1C zoning district, where 0.5 acre is the minimum lot area and 100 feet is the ininimum lot width. The property is 0.26 acre in area and 92 feet in width. 3. There is a roadway that provides access from this property and four others to North Shore Drive. This roadway has existed for over 50 years. It is maintained by the property owners who use it for access. While this roadway does not have the 50 foot right-of-way required for a private roadway and in fact may exist only by prescription, it functions as a private roadway and should be considered one for purposes of determining setback and lot area. This does not reduce the width of the lot but the area is reduced to 0.22 acre. 4. The Planning Commission reviewed this application on November 20, 2006 and on a vote of 4 - 0 recommended approval of the variances, based on the following findiilgs: a. The area of the lot is only 43 percent of the required ininimum lot area. No land is available to enlarge the lot. The size of the lot is similar in size to the other lots in the immediate vicinity. b. The new garage will be placed so the width of the private roadway/fire lane at its narrowest point is increased from 15.2 feet to 18 feet. The new garage is slightly larger than required to accommodate two vehicles to compensate for absence of a basement under the house. c. The second story will reseinble a half-story. The remodeled house will have less mass than a new 2%z story house constructed without a lot coverage variance. The portion of the house that encroaches on the average lakeshore setback will be changed from an enclosed room to an open porch. The City Council has considered this application including the findings and recommendation of the Planning Commission, reports by City staff, comments by the applicants and the public, and the effect of the proposed variance on the . health, safety and welfare of the coinmunity. 6. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variances would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the O�Nners, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the Owners; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon the above findings, the Orono City Council hereby grants variances to Orono Municipal Zoning Code Sections 78-1279, 78-350, 78-1403 and 78-1288 to allow �o^st���ti�^ ^f � se�ond s±^��� u�i:lg wal�� a::� atta�hPd ga:-age for the exist::lg ?'�si�ence, subject to the following conditions: 1. Council approval is based on the site and house plans submitted by the Applicants and a.imotated by City staff, attached to this Resolution as Exhibits A. and B. Any amendments to these plans may require further Planning Commission and City Council review. 2. A fire lane shall be maintained ac:•oss the property as ger.erally sh�wn on Exhibit C. The northwesterly side will be marked with Fire Lane signs and the southeasterly side adjacent to the garage approach will be maxked with contrasting paving materials. A fire lane and emergency vehicle access easement shall be provided over the fire lane. By signing this resolution the Owners agrPe to grant this easement, which shall be created by a separate document. 3. The proposed open entry porch and the open porch on the lake side of the house shall not be reconverted to enclosed space. Hardcover in the 0-75' zone shall be liinited to 1,017 s.f. or 16% and in the 75- 250' zone shall be limited to 1,099 s.f. or 61.4 %per the proposed site plan and hardcover allowance summa.iy as depicted on Exhibit D. The Owners are advised that any future requests to increase hardcover or change the nature of existing/approved hardcover shall require City approval, and increases in hardcover will not likely be approved without concurrent �reduction in existing hardcover. 5. Owners shall not place any plastic or fabric liner material under any landscaping on the property :o ensure their permeability as non-hardcover surfaces. 6. Authorities granted by this resolution run with the property not with the Owners,but are permissive only and must be exercised by obtairiing a building permit for the new construction before January 22, 2008 or the variance will expire on that date. 7. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically ternunate any authority granted herein, . and shall be punishable as a mis3emeanor. 8. The undersigned Owners have read, understand and hereby agree to the terms of this resolution and ori behalf of their heirs, successors and assigns, hereby agree to the recording of this resolution in the chain of title of the property.
