Sec.13.04 RIGHTS OFSUBIECTS OFDATA
Subdivrsron 1. Type ojdata The rights of irutividual on whom lhe data is stored or to be stored shall be as set forth in this section.
Subd 2. Injormation requlred to be given indivlduaL An individual asked to supply private or conf:dential data concerning himself
sha!!be informed of (a)the purpose and intended use of the requested data within the collecting state agency,political subdivision,or statewide
system;(b)whether he may refuse or rs legally required fo supply the requested data;(c)arry known coruequence arising from his supplying or
sefusing to supplyprivate or confidential data;and(dJ the rdentity of other persons or entities authorized by state orfederal law to receive the data.
This requirement shall not apply when an individual is asked to supply irrvestigative data,pursuant to section 13.82, subdivision S, to a law
enforcement o�cer.
The commissioner ofrevenue mav nlace the notice reouired under lhis subdivision in the individual income tax or nronertv 1ax refund
irrstructions instead ot on those forms.
Subd.3.Access to data by individuaL Upon request to a responsible authority,an individual shall be informed whether he rs the subject
of stored data on individuals,and whether it is classrfied as public,private or confidential. Upon his further request,an lndivrdual who is the
subject o,jstored private or public data on rndrvidua/s shall be shown the data without a�ry charge to him and,if he desires,shall be in,rormed oJ
the content and meaning ojthat data. �fter an rndivrdual has been shown the private data and informed of its meaning,rhe data need not be
disclosed to him for six months thereafter unless a dispute or action pursuant to this section is pending or additional data on the individual has
been collected or created. The responsi6le authority shall provide copies o,jthe private or public data upon request by the individua[subject of
the data. The responsible authorrty may require the requesting person to pay the actual costs of making,cert�ing,and compiling the copies.
The resporuible authoriry shal!comply immediately,rf possible,with arry request made pursuant to this subdivision,or within frve days
of the date oj�he request,excluding Saturdays,Sundays and legal holidays,if immediate compliance is not possrble. If he cannot comply wrth the

• disagreement. The responsib/e authoriey shall within 30 days either: (a)correct the datafound to be inaccurate or inconeplete and attempt to not�
past recipients of inaccurate or incomp/ete data,includrng recipients named by the individual;or(b)not�the indrvidual that he believes the data
to be correct. Data in dispute shall be disclosed on/y rf the individual's statement of disagreement is rnc[uded with the disc[osed data.
The determination o,jthe responsible authority may be appealed pursuan!to the pravrsiorrs of the administrative procedure act relating
