Hi Todd - As we discussed earlier today, I have confirmed the 66 foot road "right of way"area should be subtracted from
the lot area.
From city code Chapter 78-1
Lot area means the area of a lot in a horizontal plane bounded by the lot lines, but not including any area
occupied by the waters of a duly recorded lake or river or wetland or area which has been dedicated as public
right-of-way.
From City Code chapter 82 definitions— Section 82-1:
Lot area, minimum, means minimum area required for each proposed lot as prescribed in chapter 78. In rural
zones not served by sanitary sewer, each lot must contain a minimum of two acres of contiguous dry buildable
land exclusive of wetlands, public and private rights-of-way, vehicular or pedestrian easements, surface areas
below the ordinary high water mark of any surface water or areas at or below the floodplain elevation for a
specific property. All rural lots must comply with chapter 58, article II. In urban areas served by sanitary sewer,
each lot must contain contiguous dry buildable land equal to the minimum areas as prescribed in chapter 78 or
half-acre, whichever is less (exclusive of public and private rights-of-way, vehicular or pedestrian easements,
surface areas below the ordinary high water mark of any surface water wetlands or areas at or below the
floodplain elevation for a specific property), and have legal access to the building site without encroachment of
a wetland or floodplain area.

Todd,
As discussed on the phone, we have some concerns regarding the proposed project at 3400 North Shore
Drive.
Properties under two acres in area are limited to 15% structural coverage. According to your hardcover
calculations the lot is currently at 16% structural coverage; your application will result in additional structural
coverage. There is no variance record in the file for this existing structural coverage overage. Staff will not
support a variance request to further exceed the 15% structural coverage limitation.
Also, the Master Bedroom addition does not appear to meet Orono's definition of a half-story. Click here to be
linked to 78-1. Definitions and scroll to Half story. Specifically, the definition reads...."Half story means the
uppermost floor of a building in which (i) the intersection of the exterior wall and the roof is not more than three feet
above the floor elevation, and (ii) not more than 60 percent of the floor area within the exterior walls of the uppermost
floor exceeds five feet in height as measured from the floor to the rafters. Floors exceeding these parameters shall be
deemed a full story". Please provide us with additional information and/or revised plans so that the half story
can be determined prior to our meetinq date.

Building Permit #2012-01054 pertaining to 3400 North Shore Drive was applied for on
October 19, 2012. An advance plan review fee(2012-01053) of$881.89 was paid also.
The applicant, Jaymes Whitney of Southwestern Capital LLC, not�ed me on November 28,
2012 he was withdrawing his application and requested the escrow to be refunded.
Please refund the building perm� escrow of $2,500 and the advance plan review fee of
$881.89 for a total of$3,381.89 to the applicant.

AGREEMENT made this�day of �CTD 3LT�Z-, 20�o? by and between the CITY OF ORONO,
a Minnesota municipal corporation ("City") and Southwest Capital LLC ("Owners").
Recitals
1. A building permit application has been filed for additions to the principal structure located at 3400
North Shore Drive the("Subject Property"), legally described on Exhibit A, attached..
2. Owners request the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit$2,500 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal
consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the
Owners would be responsible for under a building permit application. The escrow will also guarantee
reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in
accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may also be used by the City to eliminate any hazardous conditions associated with the
work and to repair any damage to public property or infrastructure that is caused by the work (including planning,
engineering, or legal consultant review) associated with building permit #2012-01054 if compliance with the
approved building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in #3 above, shall issue a Stop Woric Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when the review has been completed and written notification is received from the Owners requesting the
funds.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn. Stat. §§415.01 and 366.012.
