F. The owner and contractor shail protect the
public from injury or damage during the construction of the
sidewaik, curb and gutter, driveway, driveway approach, driveway
turnaround, curb cuts, roadway surfacing or private improvement in
any �ubiic street or other public property in the City and any
permit issued pursuant to this Ordinance shaii contain the
agreement of the appiicant that the City shal � not be Iiable for
damage which may arise from the resuit of work, and that the
applicant wili hold the City harmless for any Iiabil.ity incurred by
the City as a result of such activity.
G. Trees or shrubs shall not be placed adjacent to
a driveway so as to constitute a site distance problem.
H. If a parcei of Iand has frontage on both a cuI-
de-sac portion and a " Zead-in" portion of the public road, the
driveway shail be constructed off the " Iead-in" portion of the
public road and not the cui-de-sac.
Subd. 9. Resident Driveways, Approaches and Turnaround.
A. One dri veway approach sha i � be a I iowed f rom up
to two single residentiai parceis of iand to the same pubiic road
provided that appropriate easements exist between parties sharing
the driveway and driveway approach. Parceis having frontage on
more than one public road shali be al �owed a driveway approach to
one public road.
B. Residential driveway approach shal.I not exceed
20 feet in width at the intersected right-of-way iine.
C. The totai width of driveway approaches to up to
two singie parceis of iand from a singie public road shall not
exceed 20 feet.
D. A curb cut shaii not exceed the width of the
driveway approach at the property iine by more than 10 feet.
E. No portion of a driveway approach, except the
curb return, sha ii be constructed within 100 feet of a corner.

F. For residences hereafter constructed , the
driveway approach and that part of the driveway and turnarounds
which drain to the public �road shall be paved with bituminous
concrete blacktop or equivalent paving. Where it has been
determined by the City's Public Works Director that an existing
driveway and/or driveway approach is causing a maintenance problem
on the public road, inciuding, but not iimited to, the washing of
dirt and gravei into the public road, the Public Works Director
shall order that the property owner pave such portion of the
driveway and/or driveway approach as is necessary to remove the
maintenance problem. Portland cement concrete will only be ailowed
from the driveway up to the public right-of-way. This requirement
shall not be construed to reduce paving otherwise required by
performance standards in the Zoning Code or required as a condition
to the granting of a Conditional Use Permit, Iot division ,
subdivision or as designated in the approved site plan.
G. Driveway turnarounds shail be required on ali
driveways or driveway approaches entering onto a State highway,
County road or coilector roadway as determined in the Comprehensive
Plan, and on a1Z entrances to public roads within the City where
deemed necessary by the Public Works Director, based on traffic
counts, sight distances, street grades and other relevant factors.
If a driveway turnaround is required by the Public Works Director,
such requirement shall be stated on any permit issued by him or her
pursuant to this ordinance.
Subd. 10 . Business Driveways , Approaches and
Turnarounds.
A. Only one business driveway shail be ai Iowed per
deveiopment unl.ess a greater number of driveways are approved by
the City, or approved as part of the site plan review. The
business driveway approach shail not exceed the width of the access
road or 32 feet at the property Iine, whichever is Iess in a
business or industrial district. The curb cut shall not exceed the
width of the driveway approach at the property Iine by more than 20
feet unless approved as part of a site pian. In a residential
district, the curb cut shal i not exceed the width of the driveway
approach at the property line by more than 10 feet unless approved
as part of the site plan.
B. AlI. business driveways and driveway approaches
shall be paved with asphaltic concrete or equivalent material.
Portland cement concrete will only be allowed outside of the public
road right-of-way.
C. Loading docks, ramps and vehicular entrances
sha11 be Zocated in such a manner that backing onto and maneuvering
within the pubiic road right-of-way is eliminated and in such a
manner that driveways greater in width than that specified by this
chapter shall not be required.
