Mr. Gerald Yarnes 3400 North Shore Drive Wayzata, Minnesota 55391 Re: Zoning Violations Dear Mr. Yarnes: The City has notified you on various occasions of zoning violations that exist on your property. The most recent letter was sent on October 15, 1992. This letter required you to remove boat lifts stored on the lake shore, file a home occupation license application and to produce documentation showing approval from Lake Minnetonka Conservation District for commercial use of your residential dock. As of this date, these violations still exist. Your failure to resolve these issues leaves the City no alternative but to initiate legal proceedings. Action will be withheld until December 21, 1992. If by that time you have failed to comply, citations will be issued and the matter referred to the City Attorney for further legal action. Box 66 Orono, MN 55356 Crystal Bay, MN 55323-0066 December 21, 1993 Mr. and Mrs. Gerald Yarnes 3400 North Shore Drive Wayzata, Minnesota 55391 Re: Boat Lift Storage and Maintenance of Private Properry Dear Mr. and Mrs. Yarnes: In the past, the City informed you that you were in violation of Orono Mobile Material Storage Ordinance 10.60, Subd. 13. Since that time, the City has also developed an enforcement policy on this ordinance as it pertains to boat lifts. The policy is as follows: Each lakeshore property L"r �� may store a maximum of two boat lifts on their lakeshore a minunum of 10' from the side property lines and from road right-of-way. This will only be enforced on complaint or if staff �� feels there is a health or life safety issue involved. The City has received numerous complaints regarding boat lift storage on your lakeshore, along with complaints regarding.a sunken pontoon boat and a dock that has partially collapsed. The portion of the complaint regarding the pontoon, dock and any other items in the water is in the Department of Natural Resources' jurisdiction and has been forwarded to them for enforcement. The boat lift storage is in Orono's jurisdiction. The condition of your lakeshore is also a violation of Orono Municipal Code Section 9.55. Therefore, the City must require you to comply with the ordinances and the City's enforcement policy before January 10, 1994. If this deadline is not met, the City will initiate legal action.
