You requested information regarding installing a gate at the property addressed 3400 North Shore Drive. Click here to
be directed to the City Code Section 78-1405 on Nonencroachments. According to City Code Section 78-1405(a)(9)(i)
gates are permitted and must be located at least 40' from the paved,traveled County road. Also, according to City Code
Section 78-1405(8)the associated fence height shall not exceed 42 inches within the street yard.

Staff received a complaint regarding boat storage and potentially unpermitted land alterations at
3400 North Shore Drive. On May 16, 2014 Staff performed a property inspection. During the
inspection Staff noted three boats stored on the property displaying !N 3296 DZ and AZ 9878 85
registration numbers. One boat was covered and the registration number could not be read. According
to City Section 78-1577(4) all boats stored outside on a residential property shall be licensed to the
owner or occupant of the property. Please provide registration and ownership information for all three
boats. If the boats are not registered to the owner or occupant of the property they must be removed
from the property or stored in an enclosed structure.
Also noted was a pile of brush and exposed soil. The brush pile must be removed in accordance with
City Code Section 58-1(a). According to City Code Section 78-1247 land alterations require a permit.
Depending upon the scope of the proposed project, other permits may be required. Please complete
the attached zoning permit application and retum with all the required submittals.
This letter will serve as your notice that the property must be brought into compliance by
June 11, 2014. In order to bring your property into compliance you must provide the City with
documentation stating the boats are registered to the owner or occupant of the property; removed or
stored indoors. The brush pile must be removed, erosion control measures implemented and
maintained until vegetation is established over disturbed areas and a complete Zoning Permit
Application submitted by June 11, 2014 with an after the fact (double) fee. A copy of the zoning permit
application is enclosed.

Sec.58-1.Maintenance of private property
(a) It is the duty of the owner of every vacant property and the owner and occupant of every occupied
property to maintain the property in a neat, clean and presentable manner free of any junk, debris,
refuse, litter, dead trees,or noxious weeds, and to remove all other public health or safety hazards from
the property.
(b) The owner or occupant of every lot or parcel shatl regularly cut or otherwise maintain all grass and
weeds on the property at a height of not more than six inches.
(c) Any violation of this section is declared to be a nuisance and a public safety and welfare hazard, and
upon seven days' written notice to the owner, as shown by the records of the office of the county
auditor, of private premises on which such material is found or any conditions in violation of this code
section exist,the city may remove such matter or correct any conditions in violation, and certify the cost
of such removals or corrections as any other special assessment.

Sec.78-1247. land alteration and building permits required.
A permit is required for the construction of buildings, building additions, related work such as construction of
decks and signs, installation or alteration of sewage treatment systems,grading and filling activities,and other
activities as regulated elsewhere in this Code.
Sec.78-1577. Exterior storage in R districts
In all R districts, it is the responsibility of the owner of any property, improved or unimproved, to maintain the
outdoor areas; including courtyards and the like, of the property and adjacent rights-of-way in a manner that
complies with the following requirements. All recreational vehicles, mobile homes, camping trailers, motor
homes, pickup coaches,travel trailers, special mobile equipment,and utility trailers shall meet the requirements
of this Code.Additionally,all exterior storage must comply with subdivision (6)of this section.
(1J Definitions:
a. Blight means a deteriorated condition, something that impairs or destroys.
b. Junk means any cast-off, damaged, discarded, junked, obsolete, salvage, scrapped, unusable,
worn-out or wrecked object, thing or material composed in whole or in part of asphalt, brick,
carbon, cement, plastic, or other synthetic substance, �ber, glass, metal, paper, plaster, plaster
of paris, rubber, terra cotta, wool, cotton, cloth, canvas, organic matter or other substance,
regardless of perceived market value or requiring reconditioning in order to be used for its
original purpose.
c. Recreational vehicle. Mobile home and recreational vehicle shall mean and include the following
definitions, and shall not include any manufactured housing unit bearing a State of Minnesota
manufactured housing seal or certificate, for uses including but not limited to those listed
below:
1. Camping trailer means a folding structure, mounted on wheels and designed for travel,
recreation and vacation uses,also called a pop-up camper.
2. Motor home means a portable, temporary dwelling to be used for travel, recreation and
vacation,constructed as an integral part of a self-propelled vehicle.
3. Pickup camper means a structure designed to be mounted on a truck chassis for use as a
temporary dwelling for travel, recreation and vacation.

4. Travel trailer means a vehicular, portable structure buiit on a chassis, designed to be used as
a temporary dwelling for travel, recreational and vacation uses, permanently identified as a
travel trailer by the manufacturer of the trailer.
d. Special mobile equipment means every vehicle not designed or used primarily for the
transportation of persons or property and only incidentally operated or moved over a highway,
including but not limited to: ditch digging equipment, moving dollies, pump hoists and other
well-drilling equipment, street sweeping vehictes, and other machinery such as asphalt
spreaders, bituminous mixers, bucket loaders, tractors other than truck-tractors, ditchers,
leveling graders, finishing machines, motor graders, road rollers, scarifiers, earth-moving
equipment. The term does not include travel trailers, dump trucks, truck-mounted transit
mixers, truck-mounted feed grinders, or other motor vehicles designed for the transportation of
persons or property to which machinery has been attached.
e. Utility trailer means any motorless vehicle, other than a boat trailer or personal watercraft
trailer, designed for carrying of snowmobiles, motorcycles, all terrain vehicles, or property on its
own structure and for being drawn by a motor vehicle but shall not include boat trailers,a trailer
drawn by a truck-tractor semitrailer combination, or an auxiliary axle on a motor vehicle which
carries a portion of the weight of the motor vehicle to which it is attached.
(2) (Parking regulated.J Parking of recreational vehicles, mobile homes and utility trailers shall be
regulated as follows:
a. It is unlawful for any person to park a mobile home or recreational vehicle upon public property
for human habitation
b. It is unlawful for any person to park or store a utility trailer, mobile home, recreational vehicle in
any "R" district for more than 24 hours, except in a side or rear yard at least five feet from any
property line.
c. It is unlawful to use a mobile home or recreational vehicle for human habitation on any private
property for more than 72 hours without a permit from the city.
(3) Vehicle storage. All vehicles parked or stored on any property within the city shall be operable and
currently licensed. The parking of vehicles, other than recreational vehicles, in "R" districts is
regulated as follows:
a. Parking of vehicles other than recreational vehicles, with a maximum gross vehicle weight
(GVW)of 14,000 pounds or less is allowed in all "R"districts.
b. Parking of vehicles in "R" districts in excess of 14,000 pounds GVW has the potential to create
negative impacts on the surrounding neighborhood. These impacts may include noise (from
operation as well as maintenance of vehicle); vibration; glare; odors; soil/water contamination
(from dripping, washing, etc.); hazards to pedestrians by way of proximity, especially on private
roads; wear and tear on local or private roads; propensity to offload remaining cargo on site at
end of day; and visual incompatibility with the character of a neighborhood. Such use may be
acceptable under certain conditions in zoning districts where lot areas are generally two acres or
larger.Therefore, parking of such vehicles requires each of the following conditions be met:
1. Property owner must be vehicle owner or operator.
2. Vehicle must be set back 50 feet from property lines.
3. Vehicle must not be visible from neighboring properties and public streets; vegetative
screening is preferred.
4. Maintenance of said vehicle shall occur within an enclosed building.
5. The vehicle shall not constitute a nuisance at any time.
6. In a shared driveway situation, the applicant shall demonstrate that the appropriate
easement exists.

7. Minimum lot size of five acres. For any property at least two acres but less than five acres in
area, where it can be shown that prior to the effective date of this section such a vehicle
was previously stored on a regular basis prior to and after January 1, 2004, a vehicle storage
permit may be granted if the above conditions a. through f. are met, subject also to the
following limitations:
i. A vehicle storage permit may only be issued for properties within the RR-1B, RR-1A, and
LR-1A zoning districts.
ii. Such permit shall be granted only to the current property owner and only for the
specific vehicle applied for. The current owner may replace the vehicle in kind, but shall
not add other such vehicles. Any replacement vehicle must be registered with the city
within 30 days to transfer its permitted status.
iii. This permit shall not apply to subsequent property owners, subsequent property
owners shall not be considered as having a grandfathered permit by virtue of their
predecessor's permit.
iv. This permit shall automatically and permanently expire if the vehicle storage is
voluntarily discontinued for a period of one year.
(4) (Storage of boats and boat trailers.] Boats, unoccupied boat trailers, and boats on trailers shall
be subject to the following storage requirements when not stored for commercial purposes:
a. Licensing, operability and restorations. All boats stored outside on a residential property
shall be licensed to the owner or occupant of the property. All boats stored on a property
shall be in operable condition, except that inoperable boats under active restoration may be
stored on a property for not more than two years, the intent being to discourage the long-
term storage of inoperable boats on residential property.
b. Principal residence required. No boat shall be stored on a property or on a group of
contiguous commonly owned properties that does not contain a principle residence
structure.
c. Maximum length. Boats and unoccupied boat trailers exceeding 30 feet in length shall not
be stored on any residential property except within a fully enclosed building meeting all
applicable zoning and building code standards. Exception: Existing boats over 30 feet in
length which are documented to have been stored on the property within the 24 months
prior to the effective date of the ordinance from which this section is derived shall be
allowed to continue such storage practice until the property is sold, and shall meet the
setback requirements of this section.
d. Allowed storage/ocations. Boats and unoccupied boat trailers up to 30 feet in length may be
stored outside on residential property as follows:
1. Lakeshore lots. Boats may be stored in a side yard, street yard, side street yard and
lakeshore yard as long as they meet required setbacks and have no significant impact on
lake views enjoyed by adjacent neighbors.
2. Nonlakeshore lots. Boats maybe stored in a side yard and rear yard; trailerable boats
may be stored on trailers in a driveway in a front yard or side street yard.
e. Required setbacks. Boats and unoccupied boat trailers shall be stored no less than five feet
from any lot line and no less than 15 feet from the principal residence structure on any
adjacent lot.
f. Screening. Screening is not required for outside boat storage when in conformance with this
section. If boats are shrink wrapped,white is the preferred color but is not mandatory.

g. Dispute resolution. Complaints regarding boats stored in lakeshore yards and potentially
impacting a neighbor's views of the lake will be referred to a dispute resolution committee,
consisting of the planning director, the building official, and a member of the planning and
zoning staff.
(5) (Prohibited parking or storage.] Outdoor parking or storage of special mobile equipment as
defined in this section shall be prohibited in any"R" district.
(6) Prohibited material storage. Any violation of this section is subject to abatement upon seven
days' written notice to the owner of private premises on which such material is found or any
conditions in violation of this code section exist. The owner of the p�operty will be determined
as shown by the records of the office of the county recorder. The city may remove such matter
or correct any conditions in violation, and certify the cost of such removals or corrections as any
other special assessment. Additionally, the city may also seek injunctive relief for violation of
this section. Owners of private property shall remove and keep removed from all exterior areas
of all residential properties the following items:
a. Pest harborage. All exterior property shall be free from rodent harborage and infestation.
Boxes, lumber, scrap metal, and similar materials shall not be allowed to accumulate outside
a structure in a manner that attracts an infestation of pests. Materials permitted and
approved for exterior storage shall be neatly stacked.
b. Trash and debris.
1. All household garbage, offal, dead animals, animal and human waste, and waste
materials.
2. Accumulations of litter,glass, scrap materials(such as wood, metal, paper, and plastics),
junk,combustible materials,stagnant water, plastic bags or trash.
3. Accumulations of clothing and any other items not designed for outdoor storage.
c. Non-trash items.
1. Accumulations of wood pallets.
2. Accumulations of vehicle parts or tires.
3. All construction and building materials unless such materials are being used at the time
in the construction of a building, in which case such construction must be permitted and
on a continuous, uninterrupted basis.
4. All appliances or appliance parts.
5. All indoor or upholstered furniture of a type or material which is deteriorated by
exposure to outdoor elements.
6. All recycling materials except for reasonable accumulations, amounts consistent with a
policy of regular removal, which are stored in a well-maintained manner according to
Chapter 50 and Chapter 54
7. All other non-trash items which:
(i) Are of a type or quantity inconsistent with normal and usual use;or
(ii) Are of a type or quantity inconsistent with the intended use of the property;or
(iii) Are likely to obstruct or impede the necessary passage of fire or other emergency
personnel.
d. Fertilizer and burial of waste. No person shall leave, deposit, or cause to be placed on any
private ground any garbage, sewage, waste, debris, carcass, or other substance or matter
which is offensive or unhealthy by decomposition unless the same be buried at least three
(3)feet under the surface of the ground; provided,that the use of manure and phosphorous
free fertifizer in the normal course for agriculture or horticulture is permitted.

Subject: 3400 North Shore Drive - Complaints Regarding Commercial Use
We have received a number of complaints regarding a "boat lift
installation" business being conducted from this property. The comp laints,
from two or three sources, have indicated that the ogeration consists of a
barge and crane being docked on Crystal Bay across from this property,
which is used for instal ling boats lifts around the lake. Apparently, the
barge was also seen on the yard of the property being painted, at some
point during the month of April.
The first telephone complaint to me occurred on Apri 1 8, 1988. Inspector
Lyle Oman viewed the site on April 11, 1988 at 11:40 a.m. and found that
the large piece of equipment alleged to have been in the yard had been
moved and there was no evidence of a business operating at that time.
Since then, we have received additional complaints regarding the use of the
dock area for storing the barge.
Today I visited the site and knocked on the door, but found no one home. I
left a slip in the door requesting the property owner to contact us
regarding the apparent commercial use of the property in absence of the
proFer zoning and without evidence of a home occupation license on file. I
also noted that three boat lifts were stored on the Crystal Bay side of
North Shore Drive on this property. The barge was not present. There also
is a 30' f latbed trailer stored in the driveway adjacent to Tonkawa Road.
The tongue of this trailer would appear to be very near the right-of-way
line. This would probably be construed as storage of equipment in
violation of Section 10.60, Subdivision 13, in that the trailer is not
stored to the rear of the house, it does not appear to be at least 10' from
any property line and appears to be an unoccupied trailer greater than 20'
in length, and may be, in fact, being stored for commercial purposes. I
will follow up the inspection slip with a letter.

Re: Commercial Use of Residential Property
Dear Ms. Yearns:
This letter is to follow up your recent discussions with Zoning
Administrator Jeanne Mabusth, regarding the City's inspection of
your property on Apri 1 27, 1988. That inspection was made upon
receipt of a number of complaints that you were operating a
business from this property, which is zoned for single family
residential use only. The nature of the comp laints was regarding
the storing of boat lifts and maintaining a barge used in the
business of installing boat lifts around the lake. Additionally,
it was brought to our attention that the barge was stored on land
on the property for a period of time. During our inspection on
April 27, 1988 , I noted that three steel boat lifts were stored
on the property on the lakeshore side of North Shore Drive. I
also noted the storage of an oversize trailer in the driveway
along Tonkawa Road.
On April 27 I left an inspection notice in your front door, and
followed up with a letter which was mistakenly sent to I. J.
Meyers whose name appears in City and County records as the owner
of the property, hence the tardiness of this letter.
The purpose of this letter is to formally advise you that
commercial use of this property is not allowed by Municipal
Ordinance. In addition, any home occupation use of the property
would require a Home Occupation License per Municipal Code
Section 5.40 and would have to comply with the home occupation
standards set forth in Municipal Zoning Code Section 10.20,
Subdivision 4C (attached). I am told you have obtained the
application for Home Occupation License, which you should
complete and submit for City review.
Per your discussions with Jeanne Mabusth, the trailer which was
stored on the property did not meet the standards for storage of
mobile materials and equipment as set forth in Municipal Zoning
Code Section 10.60, Subdivision 13 (attached). I note that this
trailer has been removed as have two of the boat lifts. Also,
you were advised that the barge could not be stored offshore from

Dear Ms. Yearns:
The City continues to note the commercial use of your residential
property. In 1988 you advised the City that you=ancl your husband
would file a license application for a business that he operated
from your home.
Once again, we enclose pertinent copies of the Code, Section
5.40 - Home Occupation License and Section 10.20, Subdivision 4
(C) - Standards for the Operation of a Lega 1 Home Occupation.
It has been the observation of the various inspectors of the City
that your property continues to contain boat lifts, trailers and
other misce llaneous construction-type equipment. It is obvious
that your husband's business continues to be operated from your
residence and that this business is operated in violation of the
Orono Code. In the filing of your license application, it would
be helpful if you would include a letter from Frank Mixa that you
previously referenced regarding the maintenance of your
commercial barge at your residential dock.
The City must ask that you file a license application for your
home occupation no later than December 10, 1990. An application
for a Home Occupation License has also been enclosed with this
letter. Failure to complete the filing of the application by the
deadline may necessitate this entire matter being referred to the
City Attorney's office for further review and possible legal
action.

Dear Mr. Yarnes : .
The City continues to receive complaints about the appearance of your
property, particularly the lakeshore. On inspecting the property, I
observed tal 1 weeds and grass and numerous boat lifts. The tall weeds
and grass are in violation of Orono Municipa 1 Code Section 9.55, Subd.
1. The boat lifts are obviously not for your personal use and .are in
storage as part of your business. Orono Municipal Code Section 10.20,
Subd. 4 (C) prohibits use of residential property for commercial
purposes except for very limited office type operations.

The City has received complaints about the commercial use of your
property dating back to 1988 and you have been notified of these

Please prepare a formal complaint against Mr. Gerald Yarnes,
3400 North Shore Drive, Orono, MN. Mr. Yarnes operates an illegal
business on his residentially zoned property on Lake Minnetonka.
His operation involves removing, installing and repairing boat
lifts and docks . A barge with a large crane is stored at his
residential dock when it is not in use . He also stores boat lifts
on the shoreline and in his yard (see photos) . The City receives
complaints continuously from neighbors and people passing by on the
road and on the lake.
This operation is in violation of Orono Municipal Code Section
10 . 20, Subd. 4 (c) and 10 . 60, Subd. 13 . The City' s objective is to
require Mr. Yarns to remove the boat lifts from his yard and to
cease operation of this business . Be advised that the barge is in
storage for the winter but the boat lifts are still stored on the
property.

when such general practice will involve the need for more than
three off-street parking spaces for the occupant and visitors.
D. Signs. Signs as regulated in the Zoning
Chapter.
E. Temporary Structures. Buildings temporarily
located for purposes of constructing on the premises for a period
not to exceed time necessary for such constructing.
F. Gardens, etc. Gardening and other horticultural
uses including aviaries and decorative landscape features.
G. Roadside Stands. One roadside stand offering
for sale only farm products produced on the premises provided that
such stand does not exceed 200 square feet in area and that it is
located at least thirty feet back from the public right-of-way.

Subd. 1. License Required. It is unlawful for any
person to engage in, or carry-on, a home occupation, as that term
is defined in the Zoning Chapter of the City Code, without first
having obtained a license therefor from the City.
Subd. 2. Regulation. Licenses will only be issued if
the specific use is permitted or otherwise allowed by the Zoning
Chapter, and if all conditions set forth in said Chapter are fully
complied with.
SEC. 5.41. MACE.
Subd. 1. License Required. It is unlawful for any
person to sell or distribute, at wholesale or retail, the substance
commonly referred to as mace, without first having obtained a
license therefor from the City.
Subd. 2. Limitations.
A. Only persons who are duly authorized and
licensed Federal firearms dealers shall be licensed.
B. This Section shall not apply to official sales
--- to, or purchases from, the City Police Department.

SSC. 5.42. BDSINESS AND JOINT QSE OF LARE FACILITIES.
Subd. 1. Definitions. For the purpose of this Section,
the following terms have the meanings given them:
A. "Boat Slip, Water" means a structure, space,
dock or other thing designed or used for the docking, mooring or
storing of a boat temporarily or permanently in or on water,
including mooring posts, buoys or other devices.
B. "Boat Slip, Land" means a structure, space or
other thing designed or used for storing a boat temporarily or
permanently on land adjacent to a lake, whether it is located on or
off the licensed premises.
C. "Business of Docking, Mooring, or Storing Boats"
means renting or otherwise providing space, including boat buoys,
for docking, mooring or storing three or more boats belonging to
persons other than the owner or occupant of the property.
D. "Commercial Boat Dock Business" means providing
space for docking, mooring or storing boats for a fee, or boats
used in a trade or business, including, without limitation, provid-
ing rented spaces, boat buoys, space for keeping boats owned by the
licensee and held for sale, display, rental, or otherwise used in
connection with a boat or marina business, and space held for
� ^_ docking of boats during or pending repairs or maintenance of said

boats.

Subd. 7. Vibration. Any use creating periodic earth-
shaking vibrations, such as may be created from a drop forge shall

not apply to vibrations created during the process of construction.
Subd. 8. Glare or Heat. Any use requiring an operation
producing an intense heat or light transmission shall be performed
with the necessary shielding to prevent such heat or light from
being detectable at the lot line of the site on which the use is
located. Lighting in all instances shall be diffused or directed
away from "R" Districts and public streets.
Subd. 9. Explosives. Any use requiring the storage,
utilization or manufacturing of products which could decompose by
detonation shall be located not less than 400 feet from any "R"

Subd. 14. Waste Materials. Waste material shall not be
washed into the public storm sewer system nor the sanitary sewer
system without first having received a permit to do so from the
City. If said permit is not granted, a method of disposal shall be
devised which will not require continuous land requisition for
permanent operation and will not cause a detrimental effect to the
adjacent land. Should the waste be of solid form rather than
fluid, the storage area shall be so located and fenced as to be
removed from public view. In all districts, all waste material,
debris, refuse, garbage, materials not currently in use for
construction or otherwise regulated herein shall be kept in an
enclosed building or properly contained in a closed container for
such purposes. The owner of vacant land shall be responsible for
keeping such vacant land free of waste material and noxious weeds.
_ _ Subd. 15. Drainage. No land shall be developed and no
( ,� use shall be permitted that results in water runoff causing
� flooding, or erosion on adjacent properties. Such runoff shall be
properly channeled into a storm drain, water course, ponding area
or other suitable facility.
Subd. 16. Traffic Control. The traffic generated by any
use shall be channelized and controlled in a manner that will avoid
congestion on public streets, safety hazards, or excessive traffic
through residential streets. Vehicles backing from a parking space
shall not back into the public street. No access drive to any lot
shall be located within 20 feet of any two intersecting street
right-of-way lines,
Subd. 17. Radiation, Etc. No activities shall be
permitted that emit dangerous radio activity beyond enclosed areas.
There shall be no electrical disturbance adversely affecting the
operation of any point of any equipment including but not limited
to radio and television reception other than that of the creator of
the disturbance.

The City has notified you on various occasions of zoning violations that exist on your
property. The most recent letter was sent on October 15, 1992. This letter required
you to remove boat lifts stored on the lake shore, file a home occupation license
application and to produce documentation showing approval from Lake Minnetonka
Conservation District for commercial use of your residential dock. As of this date,

Your failure to resolve these issues leaves the City no altemative but to initiate legal
