Hi Liz:
In follow-up to our prior discussion on the watercraft storage for 3400 North Shore Drive, I received a call from the
President of Southwest Capital. He seemed to understand the rules; confirming that as long as all watercraft(up to four)
are owned by and registered to Southwest Capital,they are able to dock or moor that watercraft(or two without
reference to ownership). I confirmed he was correct as it pertained to the LMCD Code of Ordinances. Of the three that
were documented,two were registered in Arizona and the other was pending a USGS Tile. He stated the latter was sold.
He confirmed the single family dwelling is a vacation home for the company. I told him I could not confirm the two
Arizona registrations and that he would have to forward a copy of such to me for our records should they be present
during the 2014 boating season and beyond. I urged him to forward all watercraft registration that will be docked or
moored to me for more efficient confirmation.
It will be a while before I get over that way, but I will follow-up after the fact. Have a good week.

Hi Lizz:
It is very nice to meet you. My name is Emily Herman and I supervise the LMCD's Code Enforcement Program for
watercraft storage at residential sites on Lake Minnetonka. Please be assured that the owner of 3400 North Shore Drive
will receive the LMCD's initial correspondence relative to their watercraft storage for the 2013 boating season.
Time has allowed for staff to submit correspondence to those that have either reached prosecution or were due for their
second letter of correspondence and follow-up inspection. Initial correspondence (which provides valuable educational
material and requests the owner(s) to voluntarily come into compliance by the next boating season and beyond)will be
submitted to a number of sites throughout the Lake in the very near future. If this site (as well as the others) are not
incompliance during the 2014 boating season, staff proceeds to the next step of communication set by the LMCD Board of
Directors. This process will provide for a second letter acknowledging a re-inspection during the same boating season. If
continued non-compliance exists, staff will proceed to define the site's storage and submit the information over to the
LMCD's prosecuting attorney.
This process has provided a great avenue for neighboring individuals to stay neutral but still know the LMCD is
addressing their concerns. Additionally, if an individuals would prefer a more efficient result, one does have the ability to
file a formal complaint(acknowledging their name will be held in confidence based on State law). However, the follow-up
and request for compliance is within the same boating season. Based on the status of this site, I would recommend one
let the LMCD follow through as planned.
I will be sure to keep Mike informed of the 2014 findings. If I can be of further assistance (or you would like to discuss this

Hello Emily,
As a way of introduction, I am Lizz Levanq a council member in Orono. I sent Mike Gaffron an email this morning after it
came to my attention that the owners of 3400 North Shore Drive may be renting their dock to other boat owners. Mike
sent me the correspondence between the two of you.
I am concerned about this property's history relative to boat docking and boat storage. The codes set by the LMCD are
clear and attempts by individuals to skirt these should not be tolerated. I appreciate the LMCD's efforts in this matter and
urge you to continue addressing the compliance issue at 3400 North Shore Drive.

subject site's watercraft storage on July 8th at 3 :32 p.m. I documented the following:
Cruiser, MN 9878BS Runabout, Commander, AZ156585 Cruiser, Formula, "Formula 4 Success"
(Lake Norman, NC) . The 9878BS is not registered to the site owner, "Southwest Capital,
LLC. " The Formula cruiser's name did not come up on the USCG' s website. I have not called
them to verbally confirm any pending registrations. Based on the ownership of the 9878BS,
the LMCD will proceed in sending the first initial letter to the Southwest Capital, LLC.
This provides for voluntary compliance by the next boating season and beyond. If they are
out of compliance next year, I send a more stern letter with a re-inspection date the
same season. If non-compliance continues during the re-inspection, I document the storage
three days within a 14-day period and turn the matter over to the LMCD's prosecuting
attorney. When we talked about the storage in 2010, the LMCD did not send a letter based

on all watercraft being owned by the owner of the home at that time. If you have concerns
with this process, please feel free to let me know. The process offered is based on the
LMCD' s Proactive Code Enforcement Program and not via the receipt of a formal complaint.
Should a formal complaint be obtained, the first letter goes away and I communicate re-
inspection yet this boating season. Additionally, I forwarded the pictures of my
