ATTENTION: Mr. Gayle Wittig
Dear Mr. Wittig:
The City of Orono has received no 1992 Orono Commercial Marina License
Application from you. You were notified of the licensing requirement
on December 6, 1991, February 20, 1992, and March 6, 1992.
Since you are now operating the marina in what appears to be a willful
violation of the City licensing ordinance, and have been doing so for
some time, the City Counci 1 has directed that you be advised to stop
operations until you are in compliance.
Although there seem to be a number of long-standing problems with your
operation which may take some time to correct in addition to the
failure even to apply for the license, you are advised that if we are
not in receipt of a licensing application and fees by June 3, 1992, or
if you have not ceased operations by that time, the City wi 11 take
such steps that seem appropriate to terminate the operations.
In regards to your inquiry as to a bui lding permit to reconstruct your
sign, if such permit is applied for, it cannot be issued until you are
in compliance.

RE: Sign Replacement and Licensing Issues
Dear Mr. Wittig:
As I'm sure you are aware, I have had discussions with your attorney, James MacKinnon, with
regard to the issues of landscaping, tree plantings, and the shoreline buffer zone/riprapping.
These are the issues that have resulted in the City Council not issuing you licenses for quite a
number of years now. I hope that, through Mr. MacKinnon, we will make progress this year
in resolving these City concerns.
The Building Inspections Department advises me they have placed a Stop Work Order on your
entrance sign replacement, which requires a permit. The City Council on March 8 directed me
to advise you that should you apply for a permit for sign replacement, a permit cannot be issued
until you are licensed. They also suggested that, out of fairness, you be advised to carefully
consider any significant expenditures or improvements of the property in light of the possibility
of DNR acquisition of your property. The same could be said for any expenditures on plantings
or buffer zone improvements.
I'm sure this all sounds like a huge Catch-22, i.e. we won't give you a sign permit since you
don't have a license and we won't give you a license because you haven't complied with buffer
zone and landscaping regulations, yet we're telling you to perhaps hold off on those
improvements until the ultimate fate of the property is known. However, as will be noted in the
cover letter attached to the 1993 license application forms, the City Council intends to issue
licenses to all marinas who apply, and deal with the land use issues through the Zoning Code.
Therefore, if you make application for a license, the City Council intends to issue you a license,
and we would be in a position to issue a sign replacement permit if the sign meets all code
requirements.

In relation to that sign, every commercial property is allowed 1 s.f. of signage for each front
foot of properry. In your case this would be your frontage along North Shore Drive, which
amounts to approximately 212' for your mari.na. No individual sign or face of a sign may
exceed 50 s.f. (Zoning Code Section 10.61, Subd. 3 (A), copy attached).
Note that, at Mr. MacKinnon's request, when the ice and snow are gone, I will make an
appointment with you or your staff to visit the site with the Ciry Engineer to review and inspect
the riprap, which as I understand it, you feel may have incorporated the necessary runoff
filtration system that was discussed in 1983-84-85.

Subd. 2. Signs in "R" Districts. Within "R" Districts, -
the following signs are permitted:
A. Nameplates.
l. One nameplate sign for each dwelling and
such sign shall not exceed two square feet in area per surface, and
no sign shall be so constructed as to have more than two surfaces.
2. One nameplate sign for each dwelling group
of six or more units, and such sign shall not exceed six square
feet in area per surface and no sign shall be so constructed as to
have more than two surfaces.
3. One nameplate sign for each permitted use
or use by conditional permit other than residential and such sign
shall not exceed twelve square feet in area per surface .
B. Illumination. Symbols, statues, sculptures and
integrated architectural features on non-residential buildings may
be illuminated by flood lights provided the direct source of light
is not visible from the public right-of-way or adjacent residential
district.
C. Setbacks, Etc. Any sign over one-half square
foot shall be set back at least five feet from any property line.
No sign shall exceed eight feet in heigh t above the average grade
level. Signs may ,be illuminated but such lighting shall be
diffused or indirect.
Subd. 3. S igns in "B" -and "I" Distr icts. Within the "B"
and "I" Districts nameplate signs and business signs are permitted
subject to the following regulations:

A. "B-1", "B-2" and "B-4": Size. Within the "B-1",
"B-2" and "B-4" Districts, the aggregate square footage . of sign
space per lot shall not exceed the sum of one square foot for each
front foot of building, plus one square foot for each front foot of
lot not occupied by a building. No individual sign shall exceed
fifty square feet.

B. "B-3": Size. Within the "B-3" District, the
aggregate square footage of sign space per lot shall not exceed the
sum of four square feet per front foot of building, plus one square
foot per front foot of property not occupied by a building. No
individual sign surface shall exceed 100 square feet.
C. "I" : Size. Within any "I " Distric•t, the
