Orono Zoning Code Section 10.41 Subd. 7 (D) requires a conditional use permit (CUP)for operating a'charter boat port of call' among other activities, and Lakeside Marina has not been issued such a permit. Mr. Dunn was notified of the need for the CUP for this and other uses on numerous occasions during 1995 and 1996. He submitted an incomplete application in May 1996 but has never submitted the information needed to make that application complete, hence it was never processed (see June 12, 1996 letter). Other activities we believe are being conducted at Lakeside which require a CUP include operation of a boat club; on-demand public boat launching (dry-stack); transient public boat launching; and operating a caretaker dwelling unit. As of this writing, Lakeside Marina also has not submitted the required 1997 Orono Marina License application which was due February 1. All other Orono marinas submitted their applications on time. Each licensed marina is required to adhere to the seven Operation Standards as noted in Exhibi[A. During the 1996 season I would appreciate if you could pay close attention to the following items in order to remain in compliance: - Continue to mana�e parking to avoid congestion on the site. - Continue to manage boat storaae to avoid causing view obstructions for traffic entering and leaving the site. - Limit storage to those areas shown on the site operation plan. Winter and summer storage of boats on the lakeshore landscape area is not allowed, as I noted to you earlier this year. We are in receipt of your Conditional Use Permit Application and $300 fee, but the application is lacking the following required submittals necessary to make it complete: 1. Detailed description of request (Identify the five activities for which you are making a CUP application and describe how you intend to meet the parking requirements for each). 2. Certified Property Owners List of owners within 350'of your property boundaries, labels � and plat map(you must obtain this list,labels and map from Hennepin County Department of Finance,A-603 Govemment Center, 348-3271). Updated Certificate of Survey (refer to attached handout- a clean copy of your cunent survey will suffice if it shows current site conditions including all buildings and hazdcover areas). The deadline for submittal of this information for review at the July 15 Planning Commission meeting is Noon on Friday,June 21. The City Council has directed staff to commence leaal action if your application submittals are not received in a timely manner. As part of the application process, you must be in compliance with an approved landscape plan, which you and I need to review and agree on as soon as possible.
