Also acknowledged is receipt of your check in the amount of $688. 00 . The City in its previous licenses has agreed to allow you to have 68 rental slips and 8 service slips for a total of 76 boats in the water. Additionally, the City allowed 22 "other boats" on the property. This is a total of 98 boats, maximum density, on land and/or water. Your current application proposes 77 boats in the water and 140 "other boats" on the property, for a maximum overall boat density of 217. In addition to the 98 boats previously mentioned, the City in the past has licensed you for 80 winter storage boats in place of the boats in the water during the summer. Your application is unclear as to whether all 140 "other boats" you propose are for for winter storage. It would appear from an inspection earlier in the spring that you had approximately 156 boats on the property. And, it was our impression that approximately two- thirds of those were winter stored boats so that in any event you are exceeding the winter storage allowance referred to above. And, you are exceeding the allowable boats for summer use as well. TELEPHONE-473-7357 �FAX-473-0�10 . - Lakeside Marina May 28, 1992 Page 2 Under its present ordinances, the City cannot licence your marina to operate unless the number of spaces you propose to have is reduced to 98 of the type described in the earlier paragraph with appropriate adjustments made during the winter storage season. Consequently, you are advised to reduce the combined number of boats on the property to no more than 98 within thirty (30 ) days of the date of this letter as the first step to obtaining a license, without which it is illegal to operate. The City is also greatly concerned over the winteea�t��rabe stored and the large number of boats which, in fact, app on your property during this current season, as I noted to you in my letter of May 22. 1992. To name one area of concern which has been noted to you this spring, the boats in the extreme southeast corner of the property appear to have been stored partially within the County Road 51 right-of-way, which cannot be allowed to continue nor be repeated next winter. Moveover, the City is concerned that the sheer density of boats that you maintained on the property during the winter season in effect eliminated fire lanes or any easy means of access should a ha 22,d yourlcurrent develop. As I noted in the letter of May storage arrangement does not appear to even attempt to conform with parking requirements. The City looks with extreme disfavor on what appears to have been a blatant disregard of the permitted density during the winter season. There are a number of other areas in which your operation seems to be in violation or fails to conform to existing land use requirements. These issues need to be discussed and solved before a license can be granted and you can be permitted to continue operations in the future. These issues, many of which I discussed with you on March 25, include: 1. Inadequacy of screening and landscaping along your east lot line. 2. Concerns about storm water run-off management, both from a quantity and quality standpoint. You should anticipate City requirements for storm water management facilities such as retention ponds or basins, etc. in the future. 3. The degree of hardcover on the property. Except for the 30' wide grassy strip along the shoreline, the entire property is hardcovered. You should anticipate the City will be requesting future reductions in hardcover on the property. Lakeside Marina May 28, 1992 Page 3 4. Screening along the west lot line is inadequate. I noted that some boats were stored within a few feet of the fence line on the west side, and generally less than the required 10' setback from all of your property lines, regardless of the extent of hard surface. 5. The number of available automobile parking spaces appears to be significantly less than those required from a code standpoint as well as from a practical viewpoint. 6. Commercial use of the property at 3350 North Shore Drive will not be condoned until such time that you apply for and are granted the appropriate approvals. 7 . The use of styrofoam f loats for the docks has been a subject of ongoing discussion. You are advised that the City is considering an ordinance to ban the use of unprotected styrofoam for dock flotation, with a reasonable phase-out period for existing users. Finally, the City is informed that you are engaged in land storage of trailered boats for on-demand launching. We consider such a use and operation to be essentially identical to dry- stacking and to be a violation of City Resolution No. 938, which limits the number of authorized slips, lifts, buoys or dry-stack slips to the number provided in prior years' licenses. As you are aware, the City is reviewing the operations of the marinas in the City, including Lakeside Marina. And it is reviewing the various general ordinances and their actual effect upon the marinas. It may be that the Lake Use Committee, which is the committee investigating these matters , will ,make recommendations about changes of one sort or another in the ordinances, especially in regard to on-demand launching, boat clubs" , dry-stacking and charter boat operations. I will repeat again that you appear to have an excessive number of boats on the property at present, not counting any trai lered boats related to on-demand launching. Further, your license application requests more than double the number of boats allowed on the property per previous licenses. A 1992 license cannot be granted to you until the foregoing conditions are rectified, and you submit a revised application meeting previous boat density limits. Issuance of licenses for 1991 or prior years wil 1 not be considered until the current issues are resolved. And, quite aside from the number of boats in summer use, the other matters referred to in this letter wil 1 have to be dealt with in a satisfactory manner including .some guarantees of future compliance before a 1992 license can be issued. In the final analysis, if you do not have a license, you wi 11 not be ab le to operate. . . . Lakeside Marina May 28, 1992 Page 4 I would note for the record that at their April 27 meeting, the Council issued licenses to those marina operations in the City which were in compliance.
