A RESOLUTION
GRANTING VARIANCES
TO THE ORONO, MINNESOTA, CITY CODE
SECTIONS 78-330 AND 78-1288
FILE NO. 10-3459
WHEREAS, Barbara A. Halper, a single person, (hereinafter "Owner") is
the owner of the property located at 3200 North Shore Drive within the City of Orono
(hereinafter "City") and legally described as: The east 57.75 feet of that part of Government
Lot 1, Section 8, Township 117, Range 23, Hennepin County, Minnesota, lying north of the
Road(hereinafter "the Property"); and
WHEREAS, Owner has made an application to the City for a variance to
Orono Code Section 78-330 to allow modification of the roofline of the dormer on the street
side of the house when part of the dormer is only 8.1 feet from the side property line and a 10
foot setback is required; and
WHEREAS, Owner has made application to the City for a Variance to Orono
Code Section 78-1288 to have hardcover in the 75 to 250 foot zone in excess of the allowed
25 percent to allow enlargement of the lakeside steps and retention of existing hardcover; and
WHEREAS, after due published notice and mailed notice in accordance with
Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission
held a public hearing on May 17, 2010, at which times all persons desiring to be heard
concerning this application were given the opportunity to speak thereon.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
1. This application was reviewed as Zoning File#10-3459.
2. The Property is located in the LR-1B zoning district, where 1.0 acre is the
minimum lot area and 140 feet is the minimum lot width. The Property is
approximately 0.68 acre in area, 68 feet in defined width and 57.75 feet in
width measured perpendicular to the side property lines. It measures
approximately 520 feet in depth.

3. The Planning Commission reviewed this application on May 17, 2010 and on a
vote of 6 - 0 recommended:
a. Approval of the setback variance, based on the following findings:
i. The house was constructed prior to the enactment of zoning
regulations.
ii. The encroachment into the setback is minimal and will not have an
adverse effect on the adj acent property.
iii. The modified roofline will a11ow for installation of additional
insulation to comply with current standards.
iv. The variance will allow a larger roof modification project that will
make the appearance of the house more compatible with those in
the surrounding area.
b. Approval of the hardcover variance, based on the following findings:
i. When the attached garage was constructed in 2001 resulting
hardcover in the 75 to 250 foot zone was thought to be 23.88
percent. Based on 2010 hardcover calculations the 2001 hardcover
level was at least 25.13 percent. A more precise determination is
not possible because the accuracy of the area of the driveway in the
2001 calculations cannot be determined.
ii. The driveway generally corresponds to the driveway in the 2001
hardcover calculations. It includes space for parking, a turnaround,
and six inches of driveway width that are beyond the minimum
requirements but are justified by the 350 foot distance between
North Shore Drive and the residence.
iii. The existing deck and steps is being replaced by a sunroom and
steps. Although the steps are larger than the existing steps the
sunroom is smaller than the deck. The result is a slight decrease in
hardcover.

iv. Allowed hardcover in the 250 to 500 foot zone can be reduced by
the amount of extra hardcover in the 75 to 250 foot zone so the total
amount of hardcover on the property would be no more than the
total permitted on the entire lot without the variance.
4. The City Council has considered this application including the findings and
recommendation of the Planning Commission, reports by City staff, comments
by the applicants and the public, and the effect of the proposed variance on the
health, safety and welfare of the community.
5. The City Council finds that the conditions existing on this property are peculiar
to it and do not apply generally to other property in this zoning district; that
granting the variances would not adversely affect traffic conditions, light, air
nor pose a fire hazard or other danger to neighboring property; would not
merely serve as a convenience to the Owner but is necessary to alleviate a
demonstrable hardship or difficulty; is necessary to preserve a substantial
property right of the Owner; and would be in keeping with the spirit and intent
of the Zoning Code and Comprehensive Plan of the City.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon the above findings, the Orono City Council hereby grants a variance to Orono
Code Section 78-330 to allow modification of the roofline of a dormer that encroaches 1.9
feet into the 10 foot side setback and a variance to Orono Code Section 78-1288 to allow
26.48 percent hardcover in the 75 to 250 foot zone when 25 percent is allowed, subject to the
following conditions:
l. Council approval is based on the site and house plans submitted by the Owner
and annotated by City staff, attached to this Resolution as Exhibits A and B.
Any amendments to these plans may require further Ptanning Commission and
City Council review.
2. Hardcover in the 0-75' zone shall be limited to 0 s.f. or 0%. Hardcover in the
75-250' zone shall be limited to 5,419 s.f. or 26.30%per the proposed site plan
and hardcover allowance summary as depicted on Exhibit C. Hardcover in the
250-500' zone shall be limited to 1,271 s.f. or 24.75%. The owner is advised
that any future requests to increase hardcover or change the nature of

existing/approved hardcover shall require City approval, and increases in
hardcover will not likely be approved without concurrent reduction in existing
hardcover.
3. The building permit escrow shall not be released until an as-built survey
verifying compliance with approved hardcover levels has been submitted and
approved.
4. Owner shall not place any plastic or fabric liner material under any landscaping
on the property to ensure their permeability as non-hardcover surfaces.
5. Authorities granted by this resolution run with the Property not with the owner,
but are permissive only and must be exercised by obtaining a building permit
for the new construction before June 14, 2011, or the variances will expire on
that date.
6. Violation of or non-compliance with any of the terms and conditions of this
resolution shall constitute a violation of the zoning code, shall automatically
terminate any authority granted herein, and shall be punishable as a
misdemeanor.
7. The undersigned Owner has read, understood and hereby agrees to the terms of
this resolution and on behalf of her heirs, successors and assigns, hereby agrees
to the recording of this resolution in the chain of title of the property.
