The spruce tree nearest the house may be trimmed to prevent damage to the structure. The trees outside the 0-75 foot setback may be cut and/or trimmed as requested. I brought the request up at the Thursday Staff meeting. I also noticed a sign on the property advertising for a new house to be built on the property in 2009 or 2010. If that is truly the case then a site/grading/landscaping plan would be required for that project and considerations may be given at that time. The reasons for our request for reconsideration are outlined below. The four trees, a cottonwood, a willow and two ash, are all considered to be hazard trees that present a serious potential threat to both property and people. As I mentioned in my previous correspondence, all four trees exhibit multiple signs of structural instability and are highly subject to failing due to a number of conditions, including ice ar snow load, wind or other natural or environmental stress and decay. Not only is this a concern for the surrounding viable trees, the marina and other structures that could be damaged should a failure occur, of a greater concern is the potential injury or death to persons. Moreover, in that the City has undertaken the responsibility to issue permits to remove trees, I would believe that any damage from not permitting the removal of these hazard trees could create liability issues for the City. In iny experience few trees actually reach the dead stage before they fall; it is much more common for a tree, particularly a larger tree, to fail after it exhibits signs of extended decline but before it is deemed dead. Thus, to � � wai; until these trees are dead will subject persons and property to unwarranted risks associated with the potential failure of these large hazard trees. The removal of these hazard trees will also allow the property owner to plant healthy, viable trees. Given the environment we have suggested planting five 12" Norway spruce trees, although we are open to other suggestions. In addition, removing the hazard trees and planting healthy trees will preserve from potential collateral damage the 100 plus year-old Vb'hite Oak due to a failure by the nearby hazard trees. We believe that the tree is too close to the house for proper development, that trimming will further weaken a tree that is already in less than optimum condition, and that doing nothing will allow the tree to continue to decline and adversely impact the surrounding environment. Thus, we recommend that the tree be removed and replaced with a tree located in an area more suitable to healthy tree development. We believe our request is consistent with the City's oejective to preserve the naturai wooded character of the lakeshore. Our requested plan of action will remove these decaying hazard trees, preserve the surrounding healthy trees, reduce the potential for damage and liability claims, and will allow the property owner to plant trees that will enhance the long-term ascetic value of the natural wooded shoreline. Reasons for the pro-active removal of#'s 1 - 4 (see diagram A) and associated photos which display the issues at hand. The primary concern is their structural instability caused by previous storms and years of decay. Large hollow pockets in their would be structural support wood, creating hinging points for which to fail under a wind load or heavy snow-ice loading episodes. There are many targets beneath these trees which have compromised structural integrity, such as the house, other healthy and or recently planted trees, boats staged in the marina and potentially humans. Tree #5, an unhealthy spruce due to the crowded condition in which it has been planted. It is also too close to the house for development. Once properly cleared from the structure, there would not be an appropriate root-crown balance for long term potential. In my site assessment, I have advised the homeowners to remove these hazard trees as soon as conditions allow and certainly prior to any restoration dollars are put toward the structure. See diagram B, due to their rapid development and disease and insect resistant nature, I have advised the planting of 5 - 12' Norway Spruce as shown to close off the site line to the marina and the preservation of the 100 + year old White Oak, centrally located on the lot.
