':•� .�aa �L - . . ..�. . .� t- : iti VIOLATION REPORT - DEFENDANT: Mark Breneman, General Manager North Shore Drive Marina 3222 North Shore Drive Orono, MN 55391 PROPERTY OWNER: Larry Hork North Shore Drive Marina . 3222 North Shore Drive Orono, MN 55391 LOCATION OF VIOLATION: 3222 North Shore Drive VIOLATION OF: Orono Municipal Code Section 10.61, Subd. 3 (D) - Signage non-conforming to sign code. INSPECTOR: Lyle Oman, Building Official BADGE: #581 DESCRIPTION OF VIOLATION: Defendant was notified by phone several times that a permit was required for signage and that the sign that was installed does not meet the requirements of the Orono Municipal Code. On 5-13-91 the defendant submitted a sign permit application and was told by Jeanne A. Mabusth, Zoning Administrator that the sign does not meet the code requirements. He then asked to appeal the Zoning Administrator' s decision to the City Planning Commission. Zoning Administrator told the defendant to remove the sign until such a time it may be approved. On 6-17-91 Planning Commission supported staffs interpretation of the code and ordered the sign to be removed by 7-3-91. A site inspection on 7-22-91 was conducted and the sign had not been removed. ACTION TAKEN: Citation #391-0432255 issued. The Citys objective is to have the sign removed and to fine the defendant to cover costs incurred in inforcing the ordinance. , - _ _ § 10 .61 sum of four square feet per front foot of building, plus one square foot per front foot of property not occupied by a buil3ing. No individual sign surface shall exceed 100 square feet. - - Source : Municipal Code Effective Date: 9-14-67 D. "B-1", "B-2" and "B-4": Height. Within the "B-1", "B-2" and "B-4" Districts, no sign shall extend in height more than two feet above the highest outside wall or parapet of any principal building nor shall any sign be located closer than ten feet from any property line except that any sign over ten square feet may project two feet into any required yard area from the principal building. Within any "B-3" or "I" District, no sign shall extend in height more than six feet in height above the highest outside wall or parapet of any principal building. No sign shall be located closer than ten feet �rom any property line except that any sign exceeding ten square feet may project only two feet into the yard area from any building. � Subd. 4. Purpose of Off-Street Parking and Loading Requirements. Regulation of off-street parking and loading spaces in this Chapter is to alleviate or prevent congestion of the public right-of-way and so to promote the safety and general welfare of the public by establishing minimum requirements for off-street parking, loading and unloading from motor vehicles in accordance with the utilization of various parcels of land and structures. All applications for an occupancy certificate in all districts shall be accompanied by a site plan drawn to scale and dimensioned indicating the location af off-street parking and loading spaces in compliance with the following reguirements : Source: Municioal Code Effective Date: 9-14-67 A.
