The B-2 code requires that all building permit applications be reviewed by Council.
Richard Anderson of 3205 Crystal Bay Road has purchased North Shore Drive Marina.
He will be applying for a 1994 license to continue the operation of that property as a marina.
It is his intent to upgrade the property although a major site renovation may be some
years away. His first request is to commence an interior and exterior renovation of the existing
"clubhouse" cabin at the northeast corner of the property. The Building Inspectors have
concluded that this building, which is approximately 10' from the shoreline, appears to be
structurally sound and likely will not require significant structural repairs, perhaps none.
Anderson proposes mainly cosmetic work such as residing, redoing interior walls and floors, etc.
The work will all be within the existing building footprint and roofline.
Such a project which proposes no site plan revisions generally does not trigger a
hardcover review. However, any future proposal to add onto, relocate, or construct new
buildings on the site would trigger a hardcover review with that application, since hardcover
percentages are exceeded on the property.

Note that since it appears there will be no structural work necessary on the building in
question, the non-conforming structure sections of the code do not prohibit or limit the proposed
cosmetic alterations. While one might argue that the proposed alterations make this non-
conforming structure more "permanent", the code does not appear to prohibit such work.
Further, the proposed alterations will undoubtedly add to the attractiveness of this building which
is quite visible from the lake.
Staff recommends Council approve issuance of this permit.
COUNCIL ACTION REQUESTED:
Direct staff as to whether a building permit should be issued to Richard Anderson for the
proposed work subject to the normal plan review process by the Building Inspectors.

3. No building or structure of a temoorary
character, trailer, basement, tent or shack shall be constructed,
placed or maintained upon the property except as accessory to and
during the construction of permanent buildings .
H. Drainage. No land shall be developed and no use
shall be permitted that results in water runoff causing floods ,
erosion, or deposits on adjacent properties. Site and drainage
plans shall be submitted by the applicant in such detail as
required by the Council and those plans shall be reviewed by the
City Engineer before submission to the Planning Commission and
Council for approval. Such runoff may be required to be properly
channeled into a natural water course, ponding area, storm drain or
other public facilities. Any change in grade affecting water
runoff whether onto adjacent property or otherwise must be in
compliance with the Surface Water Management P1an and sha11 be
consistent with other applicable regulations or City Code
provisions and subject to the approval of other agencies having
jurisdiction over the area affected by the drainage.

2-1/2 stories or thirty feet in height except as provided in
Section 10 .75 .

Subd. 1. Purpose. The "B-2" Lakeshore Commercial
District was originally intended to provide areas where limited
com mercial businesses could be located to service boats used for
recreational purposes on Lake Minnetonka. However , many of the
operators of the lakeshore com mercial businesse� have stripped the
; trees and vegetation from the shorelands and have expanded the
operations so that now the "B-2" Lakeshore Commercial Districts
adversely affect the lake water quality and the real estate values
of adjoining properties. The purpose of this Chapter is to provide
for additional reasonable regulations t:�at require partial
restoration of the shoreland vegetation, that will serve to avoid
pollution of the lake water and to insure protection of adjacent
residential properties which have previously suffered from the
unregulated expansion of commercial activities.
Subd. 2. Application. All applications for a building
permit in any "B-2" Lakeshore Commercial District shall be reviewed
by the Council and may be referred to the Planning Commission for
review.
Subd. 3. Permitted Uses. Within the "B-2" Lakeshore
Business District, no land or structure shall be used except for
