Re: Licensing Update
Dear Mr. and Mrs. Breneman:
Thank you for submitting your 1992 Commercial Marina License
application which was received by this office on April 8, 1992. Also
acknowledged is receipt of your check in the amount of $604.00.
The City in its past licensing has agreed to allow you to have 76
rental slips, 6 transient slips, and 4 service slips for a total of 86
boats in the water, exclusive of dry stacked boats.
The dry stack .agreement executed by the City of Orono and North Shore
Drive biarina, Inc. on July 29, 1977, which is a stipulation of
settlement of litigation between us, was a binding agreement that no
more than 20 boats would be "dry stacked" for lake use.
The 86 boat slips referred to and the 20 boats dry stacked have
permitted you 106 boats for lake use. Additionally, 45 "other boats"
on land for servicing, sale, etc. have been permitted for a total
density of 151 boats.
Your current license application, and we assume your current and
intended use, shows a total boat density of 210. Two discrepancies
are apparent. You propose 93 total boats in the water as opposed to
86. You propose 72 boats dry stacked for lake use, contrary to the
Court settlement.
Under its present ordinances, the City cannot license your marina for
the number of spaces proposed. Your application and actual use would
have to be reduced to the 151 boats referred to above.

Consequently, you are advised to reduce the combined number of boats
on the property within 30 days if it exceeds this number, and, as a
first step to obtaining a license, submit a revised application form.
While the LMCD has since 1988 required you to license the 52 dry stack
slots over and above the 20 allowed by the City for lake use, the City
has no intent at this time to license those 52 spaces for lake use.
In addition to the boat use just discussed, the City has previously
licensed you for 82 winter stored boats on the site in place of the
boats in the water during the summer. You are now requesting 100
winter stored boats. At present, the City is not prepared to license
more than 82 winter stored boats. We will be willing to discuss this
matter with you further to see if there is justification for such an
increase. But, if the license were issued at the moment, it would be
for no more than 82 winter stored boats.
It does appear for various reasons that you have overpaid the City
license fees for license years 1991 and 1992. A statement showing the
overpayment is enclosed, and you will receive a refund check for the
difference.
During my inspection tour of your site on March llth I pointed out to
you the following additional problems which might lead to the C lans
refusal to grant a license, but which I am aware you are making p
to resolve:
1. Lack of required screening along west side of service
building.
2. Apparent increases in hardcover along the west side of
lagoon (parking area not shown on 1984 variance application
site plan) .
3. Substantial apparent increases in hardcover that occurred
when natural ground cover was replaced with decorative
gravel between dry stacks and County Road 51.
4. General upkeep of the site, which you acknowledged and which
you noted you are in the process of cleaning up.
5. I also mentioned to you a number of future items for
discussion, including:
a. Establishing a grass buffer area along the shoreline.
b. Future hardcover reductions should be anticipated.

c. Future requests by the City for runoff control
facilities should be anticipated.
d. Review of your signage allowances is in order.
In addition, you advised me that you were not satisfied with the
replacement of shrubs removed during the recent sewer reconstruction.
I would refer you to Public Works Coordinator John Gerhardson
regarding this matter.
You also mentioned you are contemplating a major upgrade of the
marina, including a two level parking ramp. Zoning Administrator
Jeanne Mabusth and I would be pleased to meet with you in your early
planning stages so that unanticipated zoning code conflicts can be
avoided.
Your application indicates "Christmas Tree Sales" as a principal
business activity. As we discussed, Christmas tree sales is not an
allowed use in the B-2 zone, although under certain conditions it
could be argued that this may be a reasonable seasonal use. The
proper way to pursue approva 1 of Christmas tree sales on your property
would be to request a zoning amendment. However, I must reiterate
that, until Christmas tree sales becomes an approved use in the B-2
zone, we cannot allow such sales to occur.
As you are aware, the City is reviewing the operations of the marinas
in the City, including North Shore Drive Marina. And, it is reviewing
the various general ordinances and their actual effect upon the
marinas. It may be that the lake use committee, which is the
committee investigating these matters, wil 1 make recommendations about
. changes of one sort or another in the ordinances, especially in regard
to on demand launching, "boat clubs", dry stacking and "charter boat"
operations.
I would further note that while the City has approved a special event
permit for the IN Bass Tournaments on June 28th and September 20th of
this year, future approvals of similar activities may be withheld
until such time as issues relating to your licensing have been
resolved.
