'�a, �•, , , � i � O� O 4 - CITY of ORONO � � ti ti RESOLUTION OF THE CITY COUNCIL ��`�kEsi30g'�G NO. ;1 � � ri A RESOLUTION GRANTING VARIANCES TO THE ORONO, MINNESOTA, CITY CODE SECTIONS 78-330 AND 78-1288 FILE NO. 09-3390 � WHEREAS, Glen Thomas Neddermeyer and Christine Marie Neddermeyer, husband and wife, (hereinafter "Owners") are the owners of the property located at 3186 North Shore Drive within the City of Orono (hereinafter "City") and legally described as: See attached Exhibit A. (hereinafter "the Property"); and WHEREAS, Michael Jones has made application to the City on behalf of the Owners for a variance to Orono Code Section 78-330 to allow construction of a replacement residence on a lot with a defined width of 28 feet when 140 feet is required; and � WHEREAS, Michael Jones has made application to the City on behalf of the . Owners for a variance to Orono Code Section 78-1288 to allow hardcover in the 250 to 500 foot zone in excess of the allowed 30 percent; and WHEREAS, Michael Jones has made application on behalf of the Owners to the City for a variance to Orono Code Section 78-1288 to allow hardcover in the 500 to 1,000 foot zone in excess of the allowed 35 percent; and WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission held a public hearing on January 20, 2009, at which times all persons desiring to be heard concerning this application were given the opportunity to speak thereon. NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS l. This application was reviewed as Zoning File #09-3390. 2. The Property is located in the LR-1B zoning district, where 1 acre is the minimum lot area and 140 feet is the minimum lot width. The Planning Commission reviewed this application on January 20, 2009 and on a vote of 7 - 0 recommended approval of the variances, based on the following firidings: a. The lot is a legal lot of record created prior to adoption of the current Zoning Ordinance width lot requirements. � b. The lot is provided with City sewer. c. The owners are not able to acquue additional �roperty to meet minimum lot width and a.rea requirements. d. A house has existed on the lot for many yeazs. e. Without the hardcover variances it would be impossible to provide a driveway for the property. 4. The City Council has considered this application including the findings and recommendation of the Planning Commission, reports by City staff, comments by the applicants and the public, and the effect of the proposed variance on the health, safety and welfare of the community. 5. The City Council finds that the conditions eaisting on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variances would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danaer to neighboring property; would not merely serve as a convenience to the Owners but are necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the Owners; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. Page 2 of 5 �O� O 4 CITY of ORONO - � � ti RESOLUTION OF THE CITY COUNCIL ��l 4��'~ -- `9kE3i'i0g' NO. � � � �i CONCLUSIONS, ORDER AND CONDITIONS Based upon the above findings, the Orono City Council hereby grants variances to Orono Code Section 78-330 to construct a.replacement residence on a lot 28 feet wide when the required minimum is 140 feet and to Orono Gode Section 78-1288 to maintain 34.58 percent hardcover in the 250 to 500 foot zone when the maximum allowed is 30 percent and to maintain 54.62 percent hardcover in the 500 to 1,000 foot zone when the maximum allowed is 35 percent,subject to the following conditions: l. Council approval is based on the site and house plans submitted by the Applicant and annotated by City staff, attached to this Resolution as Exhibits B and C. Any amendments to these plans may require further Planning Commission and City Council review. 2. Hardcover in the 0-75' zone shall be limited to 0 s.f. or 0%. Hardcover in the 75-250' zone shall be limited to 5,232 s.f. or 24.78%. Hardcover in the 250- 500' zone shall be limited to 3,320 s.f. or 34.58 %. Hardcover in the 500-1000' zone shall be limited to 213 s.f. or 54.62% per the proposed site plan and hardcover allowance summary as depicted on Exhibit D. The owners are advised that any future requests to increase hardcover or change the nature of existinglapproved hardcover shall require City approval, and increases in hardcover will not likely be approved without concurrent reduction in existing hardcover. 3. The Certificate of Occupancy shall not be issued until an as-built grading plan verifying compliance with engineering and zoning approvals has been submitted and approved. Any deviation from the approved plan may require Planning Commission and/or City Council review. 4. Owners shall not place any plastic or fabric liner material under any landscaping on the property to ensure their permeability as non-hardcover surfaces. 5. Violation of or non-compliance with any of the terms and conditions of this � resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 7. The undersigned Owners have read, understand and hereby agree to the terms _ of this resolution and on behalf of their heirs, successors and assigns, hereby agree to the recording of this resolution in the chain of title of the property.
