(hercinafter "the applicants") are the owners of the property located at 3165 North Shore
Drive within the City of Orono (hereinafter the "City") and legally described as follotivs:

WHEREAS, the applicants have made application to the City of Orono
for a conditional use pernzit per Orono Municipal Zoning Code Section 78-1286(d)(2) to
allo�v land alterations consisting of fill in an amount exceeding 500 cubic yards; and a
variance to Section 78-1279(6} to allow placement of a new residence fon��arC of tne
average lakeshore setbacic line�vhere no encroachment is nornzally allowed.

1. This application�vas reviewed as Zoning File #OS-313�.
2, The property is located in the LR – 1B Zoning District which requires a
miniintmi lot area of 1.0 acre aud a inininnim lot width of 1�0' at the
slzoreline and the 75' lalce setbacl: line. The lot has an area of 1.35 acres, a
width of 173' at the shoreline and 1�0' at the 75' setbacl: line, and
contains an existing residence.
3. The Planning Commissiorl revie�,ved this application at public hearings
held on January 1?, 2006 and Febz-uary 21, 2U06, and subsequently voted
3-3 on a motion to recommend approval of the average setbacl: variance
based on a buildin; hei�ht of 2T and approval for a �UP to �illo�v fill of
2350 c.y. as proposed. The motion included a requirement that the

applicants provide a plan for establisYunent and maintenance of
raingardens as a method of stonnwater treatment,
4. The City Council revie�ved the application on March 27, 2006 and tabled
it peiiding a re-design that would eliminate the zzeed for an average
lakeshore setback variance, findiiig no hardship that would support such a
variance, finding that the lot was sufficiently large to allow for a new
residence meeting the average setback, and that the concerns expressed Uy
the affected neighboring property owner about potential loss of lake views
due to the encroachment were valid.
5. The City Council finds that subject to approval by the City Engineer, a
grading and drainage plan that includes up to 2,400 cuUic yards of fill
material to raise the west yard to an elevation just below the upper level of
lhe proposed house is not inappropriate, as long as no neighboring
properties are iiegatively affected by the changes in runoff characteristics.
The proposed drainage easement over the corner of the neighboring
property at 3155 Noi-th Shore Drive is necessaty for the grading &
drainage plan to be viable.
6. The City Council has considered this application including the findings
and recommendation of the Planning Commission, reports by City staff,
comments by the applicants aizd the public, and the effect of the proposed
conditional use permit on the health, safety and welfare of the community.
7. The City Council finds that the conditions existing on this property are
peculiar to it and do not apply generally to other property in this zoning
district; tliat granting the condiiional use permit would not adversely affect
traffic conditions, light, air nor pose a fire hazard or other danger to
i�eighboring property; �vill not be detrimental to the public health, safety or
welfare nor be materially injurious to surrounding propet-ties or
improvements; is necessary to preserve a substantial property right of the
applicants; and would be in keeping with the spirit and intent of the
Zoning Code and Comprehensive Plan of the City.

CONCLUSTONS, ORDER AND CONDITIONS
Based upon one or more of the above findings, the Orono City Council hereby
denies a variance to Zoning Code Section 78-1279(6); and grants a conditional use peiznit
per Orono Municipal Zoning Code Section 78-1286(d)(2) to allow land alterations
consisting of fill in an amount exceeding 500 cubic yards, subject to the following
conditions:
1. Council approval is based on the site plan, grading and drainage plans, and
buildiiig plans submitted by the applicants and annotated by City staff, attached to
this Resolution as Exhibit B. Any ainendments to the said plans which are not in
conformity with City codes will require further Planning Conunission and City
Council review.
2. This approval is subject to coinpliance with the recominendations of the City
Engineer with regards to grading, drainage and erosion control. Appropriate
erosion control measures shall be in place prior to commencement of fill
importation.
3. Evidence that the progosed drainage easemeiit over the adjacent property at 3155
North Shore Drive has been granted and recorded with Hennepin County shall be
provided prior to issuance of a building permit for the new residence.
4. Raiu gardens shall be established on the site for purposes of stonnwater
inanageiilent, subject to approval of the City Engineer. A proposed rain garden
desi�i shall be submitted by applicants and approved by the City Engineer prior
to issuance of�bc�ilding permit for the new residence, Such rain gardens shall be
constructed on the site and covenants for their nlaintenance shall be estab1is11ed,
prior to issuance of a Certificate of Occupancy for the new home.
5. No other variances are granted for redevelopment of this property.

6. Authorities graiited by this resolution run with the property not with the
applicants, but are pennissive only and must be exercised by obtaining a building
permit for the new residence within one year of the date of Council approval, or
the conditional use pennit approval will expire on tliat date(December 1 l, 2007).
7. Violation of or non-compliance with any of the terms and conditions of this
resolution shall constitute a violation of the zoning code, shall automatically
tenninate any authority granted herein, aild shall be punishable as a misdemeanor.
8. Tlle uiidersigiled applicants have read, understand and hereby agree to the terms
of this resolution and on behalf of the applicants and the applicants' heirs,
sliccessors and assigns, lzereby agree to the recording of this resolution iiz the
chain of title of the property.
