Dear Andrew:
As requested, I have reviewed the Land Alteration and Retaining Wall Permit submitted for 3155 North
Shore Drive. Based on my review of the information provided with the application and our visit to the site
yesterday,I offer the following comments for your consideration:
1. Some of the proposed improvements are located within 5' of the property line including a boulder
retaining wall and drain tile system.
2. One of the proposed trees is shown extending beyond the south property line.
3. The proposed retaining wall does not need to be designed by a Licensed Professional Engineer since
it is less than 4' in height.
4. The proposed improvements are located within a drainage easement that has been granted to the
neighboring property by the applicant. Approval of this application does not change the
requirements of the agreement between the private property owners.
5. Grading improvements that have been approved on the neighboring property are intended to direct
runoff around the corner of the lot where the improvements are proposed.
6. The proposed improvements will restrict drainage across the drainage easement; however, it does not
appear that the improvements will have a negative effect on the neighboring property.
7. It is unclear how the proposed drain tile will be outlet but it is assumed that it will be outlet near the
lake or connected to an existing drainage system located on the property.

� ZONING PERMIT ESCROW AGREEMENT \��

AGREEMENT made this day of , 20_, by and between the CITY OF , ONO,
�a Minnesota municipal corporation ("City") and ("Ow rs").
Recitals
1. A building permit application has been filed for a zoning permit for property located at
the ("Subject Property"), legally described as
Hennepin County Minnesota.
2. Owner requests the City to review this application. �
3. The City will commence its review of the application and inc costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the Ci of its costs.
NOW THEREFORE, THE PARTIES AGREE AS FOLLOWS: �
1. DEPOSIT OF ESCROW FUNDS. Contempor eously with the execution of this Escrow
Agreement, t Owners shall deposit $ with the City. II accrued interest, if any, shall be paid to the
City to reimburs he City for its cost in administering the escro account.
2. PUR SE OF ESCROW. The purpose of e escrow is to guarantee reimbursement to the City
for all out-of-pocket cost he City has incurred (includin lanning, engineering or legal consultant review) or will
incur in reviewing the plan. igible expenses shall be c nsistent with expenses the Owners would be responsible
for under a zoning permit ap �cation. The escrow �I also guarantee reimbursement to the City for all out-of-
pocket costs the City has incu d to assure tha he work is completed in accordance with the Stormwater
Pollution Prevention Plan and the ovisions of O no City Code Chapter 79. The financial security may also be
used by the City to eliminate any ha rdous c ditions associated with the work and to repair any damage to
public property or infrastructure that is use by the work (including planning, engineering, or legal consultant
review) associated with permit # if compliance with the approved zoning permit is not
accomplished. �

3. MONTHLY BILLING. �the City ceives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners s all be respon � le for payment to the City within 30 days of the Owners'
receipt of bill. �

4. DISBURSEMENT ROM ESCROW ACCOU In the event that the Owners do not make payment
to the City within the timeframe o ined in #3 above, shall issue a top Work Order until the Owners pay all expenses
invoiced pursuant to #3. The ity may draw from the escrow ac unt without further approval of the Owners to
reimburse the City for eligible e enses the City has incurred.
5. CLOSING SCROW. The Balance on deposit in the e row, if any, shall be returned to the
Owners when the review h s been completed and written notification is received from the Owners requesting the
funds.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify t�ie unpaid balance to the
subject property pursuant to Minn. Stat. §§ 415.01 and 366.012.
