We aren't doing a drawing for our client at this time. Our old Fred Johnson survey as well as our survey for Peter Luzaich at 4709 both were in agreement and won't change because that was the agreed upon line. We may be asked to do a drawing by an attorney but I don't know at this time.We also had a 1981 survey for Richard Segner on the 4709 parcel that agrees with the Johnson and Luzaich surveys. In 2009 we were working on a lot line agreement with both property owners at that time. Even though both legal descriptions were torrens they were faulty because of references to the SW corner of Lot 4 which is at the lake and can move as the lake changes.Thus, I wrote two new legal descriptions and got them approved by the torrens office.An attorney for each side and a title company were working on this but I don't think it was ever concluded because of the recession. It sounds like both current parties and Woody are going to use this line that was agreed on in 2009. It is the same at the road and about 3 feet farther east at the lake.They will come in with a revised survey to reflect that line. If you have any questions please feel free to call. Sounds Good- I will stop in around 9:30 with a check. You had said we may need an encroachment agreement and Craig did not want to get one unless you communicated we absolutely had to. He felt strongly that we are not going to encroach at all. We will remain on our property for all of the work. The neighbor has seen the plans and we've had a great working relationship with her. I'm sure he'd be livid if he finds out on week 5 that we need one and it pushes off the permit further. He's already on one about the building official not properly reading the sq ft calculations for the sprinklers. Lord help me! The house is labeled ��proposed". That label should be removed if the house is now complete. 2. The as-built depicts numerous retaining wall that were not on the approved plan. That said the majority of the walls appear to comply with city standards. The wall next to the drive way is within the County ROW and must be approved by the county. A copy of the permit or other correspondence from county officials should be provided to the city prior to approving this as-built. 3. The approved plan called for the establishment of a drainage pattern on both the east and west side of the property which ensured runoff was not directed onto the neighboring property. The contours depicted on the east side of the home appear to direct run off onto the property to the east. If a mechanism other that a swale 1 was used to achieve the approved drainage pattern (drainage tile...) it should be depicted on the as built. A City inspector should visit the site to ensure the approved drainage pattern was achieved.
