Sec.13.04 RIGHTS OF SUBJECTS OF DATA
Subd.l. Type of data. The rights of individual on whom the data is stored or to be stored shall be as set forth in this section.
Subd.2. Informatlon required to be given individual.An indivldual asked to supply private or contidential data concerning 6imself shall be
lnformed of: (a)the purpose and intended use of the requested data within the collecting state agency,political subdivislon,or statew(de system;(b)
whether he may refuse or is legally required to supply the requested data;(c)any known consequence arising from his supplying or refusing to supply
prlvate or contidential data;and(d)the identity of other persons or entitles authorized by state or tederal law to receive the data. This requtrement shall
not apply when an Indtvidusi is asked to supply investigative data,pursusnt to seMion 13.82,subdivision 5,to a law enforcement offlcer.
The commissioner of revenue mav olace the notice reauired under this subdivision in the Individual income tax or orouertv tax refund
instruMions instead of on those forms.
Subd.3. Access to data by indtvidual. Upon request to a responsible authority,an individual shall be informed whether he Is the subject of
stored data on individuals,and whether it is classified as public,pr(vate or confidential. Upon hts further request,an indtvidual who is the subJect of
stored private or public data on Individuals shall be shown the data without any charge to him and,lf he deslres,shall be informed of the content and
meaning of that data. After an Individual has been shown the private data and informed of its mean(ng,the data need not be disclosed to him for six
months thereafter unless a dispute or action pursuant to this section is pending or additional dats on the indlvldual has been collected or crested. The
responsible authority shall provide wpies otthe pHvate or public data upon request by the individual sub ject of the data.The responsible authority may
requlre the requesting person to pay the actual costs of maldng,certifying,and compiling the rnpies.
The responsible suthority shell comply immediately,If possible,with any request made pursuant to this subdivision,or withfn five days of the
date of the request,excluding Saturdays,Sundays and legal holidays,if immediate compiiance is not possible.It he cannot comply wfth the request within
that time,he shall so Inform the individual,and may have an addltional flve days withln which to rnmply with the request,excluding Saturdays,Sundays
and legal holidays.
Subd.4. Procedure when data is not accurate or complete.An individual may contest the sccurscy or completeness ot public or private data
concerning himself. To ezercise this right,an individual shall notify in writing the responsible authority describing the nature of the disagreemenG The
responsible author[ty shall wit6tn 30 days either: (a)correct the data found to be inaccurate or inwmplete and attempt to notify past reclpients of
inaccurate or incomplete data,including recipients named by the individual;or(b)notlfy the Individual thst he beileves the data to be rnrrecw Data in
dispute shall be disclosed only If the individual's statement of disagreement is induded with the discbsed data.
The determinatlon ot the responsible authority may be appesled pursuant to the provisions ot the admini�trative procedure act relating to
contested cases.

Shore Drive.
Dear Applicant:
The comment period for the above mentioned permit application has concluded as of January 12,
2006 The Minnehaha Creek Watershed District has determined the above mentioned permit
application to be complete therefore the application is approved with the following conditions:
• Reimbursement of mailing costs in the amount of$17.28
• Reimbursement of Rule J fees in the amount of$244.18
Due to the size and complexity of certain projects,the Board,by Rule J,requires that site
inspections be conducted.In these cases,the applicant is required to pay to the District,a fee equal
to the actual costs of analysis of the project,field inspection,engineering services,legal services,
and any subsequent monitoring of the work.These costs are referred to as Rule J fees.
Once the above mentioned fees have been paid and all permit conditions have been met staff will
issue the permit. You are reminded that work on the project cannot begin until the permit has been
issued. The approval expires one year from the date of this letter. If final municipal approval of
the project results in changes to the project you must submit revised plans to the MCWD for
review.
