A RESOLUTION
GRANTING A VARIANCE TO
MUNICIPAL ZONING CODE '
SECTIONS 78-1279
FILE NO. 143672
WHEREAS, Keliy J. Marx and Melodee S. Marx, a maRied couple (hereinafter
°the Applicants°) are the owners of the property located at 3135 North Shore Drive within the
City of Orono (hereinafter the "City") and legally described as Tract A, Registered Land
Survey No. 1113, Hennepin County, Minnesota; and
WHEREAS, the Applicants have made application to the City of Orono for a
variance to Orono Municipal Zoning Code Section 78-1279 to alfow construction of a second
story addition above the existing home on the property as close as 50.9' feet to the OHWL of
Lake Minnetonka where a 75-foot setback is required for structure; and
WHEREAS, after due published notice and mailed notice in accordance with
Minnesota Statutes and the Orono, Minnesota, City Code, public hearings were held by the
Orono Planning Commission on June 16, 2014.and by the City Council on July 14, 2014 at
which times all persons desiring to be heard conceming this application were given the
opportunity to speak thereon.
NOW, THEREFORE BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
1. This appfication was reviewed as Zoning File number 143672.
2. The Property is located in the LR-1 B One Famify Lakeshore Residential Zoning
Distnct which requires a minimum lot area of 1.0 acre and a minimum lot width of
140'.
3. The Planning Commission reviewed this application at a public hearing held on
June 16, 2014 and voted 6 for and 0 against on a motion to approve the
variance.
4. The City Council reviewed this application a public hearing held on Jufy 14, 2014
and g�anted approval of the variance based on the following findings

a. The Property contains 43,347 square feet, or 0.99 acre, in area and has a
defined width of 290-feet at the OHWL.
b. The orientation of the Property and the existing home on the Property with
respect to County Road 51, the lagoon, and the lakeshore results in a
practical difficulty preventing constcuction of an addition to the home in a
conforming location.
c. The existing home and the proposed second story addition to the home are
located well behind the average lakeshore setback line. The proposed
addition will not adversely impact views of the lake currently enjoyed by the
adjacent properties.
d. The proposed addition is conforrning with respect to structural coverage,
overall hardcover, height and massing regulations.
e. The existing orientation of the �adjacent and subject homes as well as the
mature vegetation on the Property should serve to address or mitigate any
negative visual impacts.
f. There were no negative neighbor comments received regarding the
Applicants' proposed plan.
g. The additional square footage within the home's existing footprint will not be a
detriment to neighboring properties nor will the addition impact the light, air
and open space of the location.
h. The addition appears to be reasonable and consistent with similar residential
properties in the area.
i. The proposed addition to the home will not alter the essential character of the
neighborhood and will result in minimal or no negative impact on adjacent
properties.
j. The Applicants' request is in harmony with the purpose and intent of the
ordinance.
k. The Applicants have demonstrated that enforcing the provisions of the Zoning
Ordinance deprives the Appiicants of the reasonable use of their Property.
5. The City Council has considered this application including the findings and
recommendation of the Planning Commission, reports by City staff, comments by

the Applicants and the public, and the effect of the proposed variance on the
health, safety and welfare of the community.
6. The City Council finds that the conditions existing on this Property are peculiar to
it and do not apply generally to other property in this zoning district; that granting
the variance would not adversely affeet traffic conditions, light, air nor pose a fire
hazard or other danger to neighboring property; would not mereiy serve as a
convenience to the Applicants, but is necessary to alleviate a practical difficulty;
is necessary to preserve a substantial property right of the Applicants; and would
be in keeping with the spirit and in#ent of the Zoning Code and Comprehensive
Plan of the City.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findings, the Orono City Council hereby grants a
variance to Orono Municipal Zoning Code Section 78-1279 to allow construction of a second
story addition above the existing home on the property as close as 50.9' feet to the OHWL of
Lake Minnetonka where a 75-foot setback is required; subject to the foliowing conditions:
1. Council approval is based on the survey and building plans submitted by the Applicants
and annotated by City staff, attached to this Resolution as Exhibits A 8� B. Any
amendments to the approved plans which are not in conformity with City codes will
require further Planning Commission and City Council review.
2. No hardcover variances are granted. Structural coverage fimitations will also be met.
3. Authorities granted by this resolution run with the Property not with the Applicants, but
are permissive onfy and must be exercised by obtaining a permit for and commencing
construction of said project. A framing inspection must be compieted within one year of
the date of Council approval, or the approvafs granted with this Resolution will expire on
that date (July 14, 2015).
4. Violation of or non-compliance with any of the terms and conditions of this resolution
shall constitute a violation of the zoning code, shall automatically terminate any authority
granted herein, and shall be punishable as a misdemeanor.
5. The undersigned Applicants have read, understand and hereby agree to the terms of
this resofution and on behalf of the Applicants and the Appiicants' heirs, successors and
assigns, hereby agree to the recording of this resolution in the chain of titie of the
Property.
