Dear Mr. Johnson:
The Department of Natwal Resources has reviewed your application for a permit to place an ice ramp
with anchors along 50'of shoreline, extending 13'waterward of the ordinary high water level of Lake
l�nnetonka, at 3105 North Shore Drive, Wayzata, l�finnesota(located in the SW 1/4 of Section 9,
T 117N-R23 W, Hennepin County).
It has been determined that your application as proposed must be denied. Minnesota Rules, Chapter
6115.0210, Subp. 1, A states that "It is the goal of the department to limit the occupation of
protected waters by offshore navigational facilities, retaining walls, and other structures in order to
preserve the natural character of protected waters and their shorelands." It is the opinion of the DNR
Section of Fisheries,lV�innehaha Creek Watershed District, and Hennepin Conservation District that
your ice ramp does not preserve the natural character of the shoreline.
Mumesota Rules, Chapter 6115.0210, Subp. 1, C. also requires the Department of Natural Resources
to"encourage the removal of existing structures which do not serve the public interest from the beds
of protected waters at the earliest practicable date." The proposed ice ramp is intended to protect
private property, and it would not serve the public interest. Allowing the ice ramp to be built would
clearly be against the intent ofthis rule.
Mmnesota Rules, Chapte,r 6115.0210, Subp. 5, A. states that when a permit is issued"the proposed
project must represent the minimal impact solution to a specific need with respect to all other
reasonable alternatives." The DNR Section of Fisheries, Minnehaha Creek Watershed District, and
Hennepin Conservation District recommended that riprap be properly installed along your shoreline.
It is the opinion of these agencies that riprap represents the minimal impact solution for protecting
your shoreline.
11�nnesota Rules, Chapter 6115.0211, Subp. 5, C, requires that"Adequate engineering studies shall
be performed of foundation conditions, tiebacks, internal drainage, construction materials, and
protection against$anking" for structures that are placed in DNR Protected Waters. The results of
engineering studies were not submitted with the permit application for the ice ramp.

Muuiesota Rules, Chapter 6115.0211, Subp. 5, D requires that"The facility shall not be an aesthetic
intn�sion upon the area and is consistent with all applicable local, state, and federal management plans
and programs for the water body." The proposed ice ramp has been denied a permit on two
occasions by the IVfinnehaha Creek Watershed District. The Watershed District has also indicated
that they will not consider issuing an experimental permit for the project. Therefore, the project is
not consistent with a local program, and our permit cannot be issued.
Excellent technical resources are available to you to assist in designing and implementing an
alternative to the ice ramp for protecting your shoreline from ice. You are encouraged to contact the

Minnesota Statutes, Chapter 103 G, requires that "In all permit applications, the applicant has the
burden of proving that the proposed project is reasonable, practical, and will adequately protect
public safety and promote the public welfare." In view of our observations, we cannot conclude that
your proposal is indeed reasonable and will promote the public welfare; therefore, the proposal
presented in the application is in all respects denied.
11Tinnesota Statutes, Sections 103G.251, Subdivision 2(c), and 103G.311, Subdivisions 5, 6 and 7,
provide for an administrative hearing if you or, in some cases, certain local units of govemment are
aggrieved by the action taken on this pernut application. Be advised that to take advantage of this
review process you must file a hearing request and a required $500.00 bond within 30 days of receipt
of this order or you lose the right to any further appeals.

In 1990� a F.ip Rap installation was approve� byc.MWC�. The
installation, in the::ensuing years, has moved in=land to
the degree it has raised the up-land ground . Also � two
mature trees are in danger of being uprooted . Large field
stone was the 1990 choice and is an option today� however,
the costs proffered by two licensed RipRap installers
seems excessive and;has a questionable life . :�Jith this
experience of Rip .Rap, I;.�prppose, in encl:�1�, ax�other:.::_-
method for preventing shore-line errosion and up-land
stability.
The encl . l , is innovative and a`�feasible .and:;:func�ioal
approach� to replace the conventional large field stone.
It has a more predictable load capacity (5000 psf;or
greater) and the ideal slope control of 3 to 1 . This
installation can be done for less cost than the large
field method . The piece part size of items used to do
this job� precludes the need of barges and heavy
equipment for installation. All parts can be man hanaied �
except installation of soil anehors. The soil anchors
will be installed by Atlas Foundation Co . This company
is the licensed installer for i�. B. Chance Co . , owner
of the soil anchors. Refer to encl 3, for data on soil ��-;:_::"�.-,.:
anchors. This application of soil anchors is a new one.

because this is a prototype venture , I want approval
for a 50 foot length of shore-line, in lieu of the 100
foot shore-line. The 50 foot length would protect the
endangered. trees. Also � this new Rip Rap would be
observed for movement or changes in the following 2-5
years by the �ItiF, and others . Further, in the event that
this scheme proves deleterious or unstable in its
purpose , it will be the applicants responsibility to
revise or remove the plates and replace it with �he
conventional Rip Rap.
In talks with licensed Rip Rap installers, it is their
collective opinion that the approach is feasible and
would be a good option for shore-line Rip Rap.

Dear Ms. George:
I have reviewed the information you faxed regarding Minnehaha Creek
Watershed District permit application 95-129. The proposed project
involves placing soil anchors and steel floor plates (deflection
plates) on top of riprap for purposes of shoreline stabilization.
The proposed project would require a DNR Protected Waters permit.
The proposed project would not meet the conditions of pending
General Permit 95-6140, so an individual DNR permit is required.
The Watershed District and Mr. Johnson (by copy of this letter) are
advised that the DNR will not look favorably on the proposed
project. Within the Department Rules, it is a stated goal that
retaining walls and other structures (such as the proposed
deflection plates) be limited in order to preserve the natural
character of protected waters and their shorelines, In general,
these types of structures are only permitted if more natural
alternatives for shoreline stabilization (i.e. , vegetation or
natural stone riprap) are not feasible. However, Mr. Johnson may
apply for a DNR permit and go through the full review process. If
his application is denied, he would have an opportunity to request
a hearing before an administrative law judge.

Dear Jeanne,
We have reviewed the proposed shoreline protection and DNR permit application for the
Carl T. Johnson property at 3105 North Shore Drive. The installation which includes soil
anchors, deflection plates and riprap seems feasible from an engineering perspective.
However, we have a few questions and comments that relate to constructability:
- What is the structural capacity of the soil anchors?
- In the section view, it appears that there may be some difficulty in installing the soil
anchors at the indicated direction, due to the e�sting riprap and embankment.
- How will the steel plates be supported uniformly over such an uneven base such as
riprap? Will there be large voids or will corners stick up?
