I received comments back from our engineer (and wetland specialist) regarding your garage proposal. The project
triggers our wetland buffer regulations and it appears that a buffer area must be established. The area south of the
proposed garage you told me was intended to be improved as a parking pad and any changes to the existing driveway to
accommodate the new garage must be shown on the survey so that the appropriate buffer mitigation area can be
determined.
The wetland comments are attached. Our city code can be found online at www.municode.com

Please see the attached escrow agreement. You must sign this and return it to the City with a check for $2500 (escrow)
before the permit will be issued. This escrow is partially for erosion control and will be held until the completion of your
project. Because your project triggers the City's wetland buffer requirement your escrow will also be held until we are
into the growing season so the exiting buffer vegetation can be evaluated. Depending on the existing condition of the
buffer, new plantings and invasive species removal may be necessary.
Also, I noted that you've had the 16.5'wetland buffer width shown on your survey, thank you. Obviously, it extends into
the driveway so additional buffer will need to be added in the square footage taken up by the driveway. Your surveyor
should calculate the square footage of the buffer that falls on the driveway and add it to the buffer elsewhere. It may be
helpful for your surveyor to also add the existing topography (and any proposed changes to the grades) to the survey as
well.

Remarks:
The proposed site improvements trigger the requirements of the City wetland code. The wetland classification map
indicates one wetland is located within the property and is classified as a Manage 3 with a I6.5 foot buffer.
There is currently a concrete driveway located within the required buffer of the wetland. This is considered a legal
nonconforming structure. When existin¢ surfaces, like the driveway, are within the area needed for the
establishment of a buffer the applicant can be allowed Buffer Flexibility under 78-1608 (3) Nonconformities (d)
Buffer Flexibility. The applicant will need to provide a survey that shows where the buffer is being expanded to
make-up for the square footage of the buffer that is lost due to the existing driveway.
Buffer Yegetation Aequirement�
If any of the buffer area is disturbed by graded or currently is turf it will need to be restored to native
vegetation. A plan that provides the location of seeding, proposed native seed mix to be seeded and method of
site preparation and seeding should be provided. According to the ordinance Div. 3 Sec. 18-1605 (3) the seed mix
must contain at least 12 pounds (PLS) per acre of native prairie grass seed and 5 pounds (PLS) per acre of native
wildflower seed. The grass mixture must contain a minimum of four species while the wildflower mixture must
contain a minimum of five species. (MN BWSR Web Site — Publication: "Restoring & Managing Native Wetland and
Upland Vegetation" source for options). Once the native vegetation is established the buffer area will not be
allowed to be mowed unless it is for maintenance aher October 15.
Wedand Bu�er Marlaers
It is recommended that at least two markers are placed at the upland boundary of the wetland buffer edge.
Signage is available from the City and will be sold to the landowner.
Itecommendations
It is recommended that the items in this memo are addressed prior to approval. An escrow amount for $ 1,500 is
recommended to cover the cost of buffer development if not completed by the applicant and compliance checks.

Melanie -They should not hit the 5,000 square feet of disturbance (approx. 800 sf) and it appears the slab of the garage is
at 969 and the ground surface is around 968 and slightly higher so the fill for the garage will be less then 50cy. As long as
they do not dig more than 1.5 feet deep under the garage they should be ok. I would say they do not trigger the buffer
requirements of the ordinance.

Do you think the proposed garage will trigger the wetland buffer ordinance? He doesn't want to do buffer averaging to
make up for the driveway, etc. He said he doesn't mow most of the area shown as buffer.
He got some additional topography & spot elevations shown on the survey...

This is 340 Leaf Street. The property owner wants to construct the detached garage as shown on the attached survey. It
appears the project will trigger the buffer requirement.
Two questions:
1. How should we handle this with respect to buffer improvements? I am not sure if I tell the owner that he has to
submit a planting plan now, or if we wait and inspect it when the snow melts/growing season starts before we
refund his building permit escrow. I'm leaning toward informing him of the requirement and holding the escrow.
2. The driveway encroaches into the required buffer area. I assume he can average the width of the buffer on the
east side between the proposed garage and the buffer and the driveway. Should I have him show this averaging
on the survey now, or wait until we know what is up in the growing season?
Your thoughts please.

Remarks:
The proposed site improvements trigger the requirements of the City wetland code. The wetland classification map
indicates ane wedand is located within the property and is classified as a Manage 3 with a I6.5 foot bu(fer.
There is currently a concrete driveway located within the required buffer of the wetland. This is considered a legal
nonconforming structure. When existin¢ surfaces, like the driveway, are within the area needed for the
establishment of a buffer the applicant can be allowed Buffer Flexibility under 18-1608 (3) Nonconformities (d)
Buffer Flexibility. The applicant will need to provide a survey that shows where the buffer is being expanded to
make-up for the square footage of the buffer that is lost due to the existing driveway.
Buffer Yegeta6on Requirements
If any of the buffer area is disturbed by graded or currently is turf it will need to be restored to native
vegetation. A plan that provides the location of seeding, proposed native seed mix to be seeded and method of
site preparation and seeding should be provided. According to the ordinance Div. 3 Sec. 18-1605 (3) the seed mix
must contain at least 12 pounds (PLS) per acre of native prairie grass seed and 5 pounds (PLS) per acre of native
wildflower seed. The grass mixture must contain a minimum of four species while the wildflower mixture must
contain a minimum of five species. (MN BWSR Web Site — Publication: "Restoring & Managing Native Wetland and
Upland Vegetation" source for options). Once the native vegetation is established the buffer area will not be
allowed to be mowed unless it is for maintenance aher October 15.
Wedand Buffer Markers
It is recommended that at least two markers are placed at the upland boundary of the wetland buffer edge.
Signage is available from the City and will be sold to the landowner.
Recommenda6ons
It is recommended that the items in this memo are addressed prior to approval. An escrow amount for $ 1,500 is
recommended to cover the cost of buffer development if not completed by the applicant and compliance checks.

BUILDING PERMIT ESCROW AGREEMENT

AGREEMENT made this � � ��day of � , 20�, by and befinreen the CITY OF ORONO,
a Minnesota municipal corporation("City"�and ("Owners°).
Recitals
1. A building permit application has been filed for construction of an accessory structure located at
340 Leaf Street, the ("Subject Property"), legally described as Lot 28, Auditor's Subdivision Number 230,
Hennepin County Minnesota.
2. Owners request the C�y to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit$2,500 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal
consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the
Owners would be responsible for under a building permit application. The escrow will also guarantee
reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in
accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may also be used by the City to eliminate any hazardous conditions associated with the
work and to repair any damage to public property or infrastructure that is caused by the work (including planning,
engineering, or legal consultant review) associated with building permit #2011-00156 if compliance with the
approved building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the everrt that the Owners do not make paymerrt
to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when the review has been completed and written not�cation is received from the Owners requesting the
funds.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn. Stat. §§415.01 and 366.012.

WETLAND BUFFER ESTABLISHMENT ESCROW AGREEMENT
Permit#2011-00156
AGREEMENT made this�day of�� , 20�Z by and between the CITY OF ORONO,
a Minnesota municipal corporation ("City") and Brent Juusola ("Owners").
Recitals
1. A buiiding permit application has been filed for construction of an accessory structure located at
340 Leaf Street the ("Subject Property"), legally described as Lot 28, Auditor's Subdivision Number 230,
Hennepin County, Minnesota.
2. The City has reviewed and approved this application.
3. The scope of the project which is the subject of building permit #2011-00156 triggers the
application of the City's wetland buffer requirement as established by City Zoning Code Article XI Wetlands
Protection will commence its review of the application and incur costs associated with said review only if the
Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall continue to leave in deposit $1,500 with the City. All accrued interest, if any, shall
be paid to the City to reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee the establishment and
development of the required native wetland buffer and to reimburse the City for all out-of-pocket costs the City
has incurred (including planning, engineering or legal consultant review)or will incur in reviewing the plan. Eligible
expenses shall be consistent with expenses the Owners would be responsible for as part of the establishment of
the wetland buffer. The escrow will also guarantee reimbursement to the City for alt out-of-pocket costs the City
has incurred associated with permit #2011-00156 if compliance with the wetland buffer establishment is not
accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when the review has been completed, the native wetland buffer established and written notification is
received from the Owners requesting the funds.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subjec y pursuant to Minn. Stat. §§415.01 and 366.012.

convenience. I must receive the new sign agreement before I can release the partial refund.
