This letter is a follow up to letters sent from this office on June 15, 2009 regarding illegal storage
of watercraft at your Orono property. It has come to our attention that you are continuing to
store boats (MN license numbers 4803 KA and 0383 KD) at your property, 3095 North Shore
Drive, in violation of Orono City Code.
Please be advised that storage of boats that are not licensed or registered to you or the property
� address is inconsistent with permitted uses within the LR-1 C zoning district (Cite City Code
• Section 78-347j. Such activity is considered to be a commercial use, which is allowed only
• within the B-2 Lakeshore Business zoning district (Sections 94-71 thru 94-101).
During conversations with City Staff you indicated that you were in possession of a lease
. document for one of the boats. Please provide copies of this information to the City so that we
- may update our file.
This letter will serve as your notice that the property must be brought into compliance
before Friday, July 10, 2009. Failure to comply will result in this matter being forwarded to the
City Attorney for legal action.

4.TERM OF LEASE AGREEMENT:
The term of the Lease Agreement is for two years to commence on June 1,2009.
5.USE&OCCUPANCY OF PROPERTY:

B. Any change in occupancy may be subject to an adjustrnent in the amount of rent.

6.AMOUNT OF RENT:

8.LATE FEE:
A. If the rent or any other charges aze not received by the Landlord on or before 5 days after the rent due date,Tenant must pay
a late fee of$50 in addition to the rent.
B. Rental payments paid late 3 times within a 12 month period creates a default of the Lease Agreement.
C. Payments received by Landlord when there are arrearages,shall bc credited first,to any outstanding balance,and then
applied to the current amount due.
9.RETURNED PAYMENTS:
A. A returned payment fee of$50 will be added for all returned payments.A personal check will not be accepted as payment to
reptace a returned payment.
B. If there are more than 2 instances of returned payments,Tenant(s)agree that the Landlord may require all future payments to
be made only by Certified Check,Money Order,or Cash.
C. If your financial institution retums your rental payment and causes the rental payment to be late,a late charge will apply.

10.SECITRFTY DEPOSTT: a E�s
A. The Tenant(s)have paid to the Landlord a Security Deposit o •
B. The Security Deposit is intended to pay the cost of damages,cleaning,excessive wear and tear,and unreturned keys once the
Lease Agreement has ended and/or for any unpaid charges or attomey fees suffered by the Landlord by reason of Tenant's
default of this Lease Agreement.
C. Tenant may be responsible for any unpaid charges or attorney fees,suffered by the Landlord by reason of Tenant's default of
this Lease in accordance to state and locai laws and regulations.
D. Under no circumstance can the S�urity Deposit be used as payment for rent and/or other charges due during the term of this
Lease Agreement.
E. The Leased Premises must be left in good,clean condition with all trash,debris,and Tenant's personal property removed.
The Leased Premises shall be left with all appliances and equipment in working order.
F. Landlord's recove-ry of damages wiil not be limited to the amount of the Security Deposit.
11.LiTILITIES&SERVICES:
A. Tenant is responsible for the following utilities and services:Electricity and Gas
and is required to register the utilities and services in Tenant's name.Tenant understands and agrees that essentiai services
are to be maintained and operationai at atl times.
B. L.andbrd will bili Tenant for the following utilities and services in addition to the rent:Water
I. Tenant must pay utility bills within 10 days of the date of bilting.
II. If a payment is late,tenattt wili be responsible for a late fee in the amount of$50.The late payment of a biil or failure to pay �
a utility bill is a default of the Lease Agreement.
12.APPLIANCES:
A. Landlord will supply and maintain:Dishwasher,Washing Machine,and Dryer
I. Tenant will keep appliances provided by Landlord in gpod working order and shall report any malfunction to th�Landlord.
Any damage sustained due to the neglect or misuse by Tenant will become the full responsibility of the Tenar►t,either in the
appliance repair or replacement.
II. Tenant agrees that the items specified above are the property of the Landlord and wilt remain with the Leased Premises at
the end of this lease term.
B. Tenant must have written approval before installing any appliance.Landlord accepts no responsibility for the maintenance,
repair or upkeep of any appliance supplied by the Tenant.Tenant agrees he/she is responsible for any damage that occurs to
the Leased Premises resuiting from the addition of any appliance that is supplied by the Tenant.
13.MAIN1'ENANCE AND REPAIItS:
Landlord shall be responsible for repairs in or about the Leased Premises unless caused by the negligence of the Tenant.
Tenant will be•responsible for any repairs caused by his/her negiigence.
A. It is the responsibility of the Tenant to promptly notify the Landlord of the need for any such repair of which the Tenant
becomes aware.
B. If any required repair is caused by the negligence of the Tenant and/or Tenant's guests,the Tenant will be fWly responsible
for the cost of the repair and/or replacement that may be needed.
C. The Tenant must keep the Leased Premises clean and sanitary at all times and remove all rubbish,garbage,and other waste,
in a clean,tidy and sanitary manner.
D. Tenant must abide by all local recycling regulations.
E. The Tenant shall properly use and opera#e all electrical,cooking and plumbing fi�ctures and keep tl�em clean and sanitary.
F. 'The Tenant is not permitted to paint,make any alterations,improvements or additions to the premises without first obtaining
the written permission of the Landlord.The Landlord's permission to a particular painting,alteration,improvement,or
addition shall not be deemed as consent to future painting,alterations,improvements,or additions.
G. The Tenant is responsible for removing snow and ice from stairs and walkways.
H. The Tenant shall maintain the lawn and landscaping by cutting grass,removing weeds and pruning trees.
I. The Tenant shail provide his or her own pest control services.

14.CONDITION OF PROPERTY:
A. The Tenant acirnowledges that the Tenant has inspected the Leased Premises and at the commencement of this Lease
Agreement,the interior and exterior of the Leased Premises,as well as all equipment and any appliances are found to be in
an acceptable condition and in good working order.
B. The Tenant agrees that neither the Landlord nor his agent have made promises regarding the condition of the Leased
Premises.
C. The Tenant agrees to return the Leased Premises to Landlord at end of the Lease Agreement in the same condition it was at
the beginning of the Lease Agreement.
15.PETS:
Pets are not allowed. �
l6.PARKING:
Parking is provided.Tennant may have(1)dock slip and(2)parking spaces.
17.RiTLES AND REGLTLATIONS:
A. Late fees are strictly enforced and any unpaid fees will not be waived.
B. The Tenant may not interfere with the peaceful enjoyment of the neighbors.
C. Garbage/Trash must be taken to the curb on the scheduled day(s)of trash removal and not before.
D. 'The Tenant will be responsible for any fine and/or violation that is imposed on the Landlord due to the Tenant's neg(igence.
E. The Tenant shall abide by all Federal,State,and Locai laws.
F, The Tenant shall notify the police and Landlord of any illegal activity that is witnessed in or around the Leased Premises.
G. The Tenant agrees not to use the Leased Premises for any unlawful purpose inciuding but not limited to the sale,use or
possession of illegal drugs on or around the Leased Premises.
H. 1fie Tenant agrees to test smoke detectot(s)periodically as well as maintain operational batteries at ail times.
I. The Tenant must report any malfunction with smoke detector(s)immediately to Landlord.The Tenant agrees not to remove,
dismantle or take any action to interfere with the operation of any smoke detector(s)installed on the Leased Premises.
J. Absolutely no hazardous materials are pern�to be in or around the Leased Premises at any time.
K. The Tenant may not use or store Kerosene or space heaters at any time in or around the Leased Premises.
L. Under no circumstance may a stove,oven or range be used as a source for heat.
M. Charcoal and Gas Barbecue gills may not be used inside the Leased Premises.
N. The Tenant shall use ventilating fans at all times when hathing and cooking.
O. All windows and doors must remain closed during inclement we�ther.
P, The Tenant shall notify Landlord of any pest control probiems.
Q. The Tenant must notify Landlord of any changes in employment.
R. The basement and/or attic may not be modified for the use as living quarters without written permission of the Landlord.
S. Waterbeds and liquid fumiture are not permitted without the written permission of the Landlord.
T. T1�e Tenant must obtxin written permission to instatl a satellite system or antenna on or around the Leased Premises.
18.ADDENDUMS:
The foliowing Addendums,attached to this Lease Agreement,shall become part of this Lease Agreement:

B.Lead-Based Paint EPA Pamphlet(4 Pages) D.Lead-Based Paint EPA Disclosure
19.INSURANCE:
Tenant agrees to be solely responsibie for any damage to or loss of the Tenant's personal property.Accordingly,the Tenant is
strongly encouraged to obtain personal property/renter's insutance with an insurance company properiy lic�nsed to do business
in the State.This policy must become effective on or before the beginning date of this Lease Agreement.
20.SECURITY NOT PROMISED:
The Tenant has inspected and acknowledges that all door and window locks,fire extinguishers,security alarm systems and/or
carbon monoxide detectors are in sound working order.Tenant further understands and aclviowledges that although the
Landlord makes every effort to make the Leased Premises safe and secure,this in no way creates a promise of security.

21.RIGHT OF ENTRY:
A. Landlord and/or his agents,with 24 hours written notice have the right during the term of this Lease Agreement to enter
during reasonable hours to inspect the premises,make repairs or improvements or show prospective buyers and/or Tenant(s)
the property.
B. In the event of an emergency,Landlord reserves the right to enter Leased Premises without notice.It is required that
Landlord have a working set of keys and/or security codes to gain access to the Leased Premises.
I. Tenants will not change,or install additional locks,bolts or security systems without the written permission of the Landiord.
II. Unauthorized installation or changing of any locks will be replaced at the Tenant's expense.
III. Tenant shall be responsible for any and all damages that may occur as a result of forcible entry dwing an emergency where
there is an unauthorized placement of a lock.
22.ENDING OR RENEWING THE LEASE AGREEMENT:
A. At the end of the Lease term,this Lease Agreement shall automaticaily continue on a month to month basis.The Landlord or
Tenant may end this Lease Agreement by giving to the other 90 days prior written notice before the end of the Lease
Agreement.
23.NOTICES:
A. Any notice,required by the terms of this Lease Agreement shall be in writing.

24.ABANDONMENT:
If Tenant vacates the Leased Premises before the end of the Lease term without written permission from the Landlord,the
Leased Premises is then considered to be abandon�and Tenant is in defauit of this Lease Agreement.Under these
circumstances,Tenant may be responsib(e for damages and losses allowed by federal,state and local regulations.
25.LANDLORD'S REMEDIES:
If Tenant violates any part of this Lease Agreement including non-paymcnt of rent,the Tenant is in default of this Lease
Agreement.In the event of a default,the Landlord may initiate legal proceedings in accordance with local and state
regetlations to evict or have Tenant removed from the Leased Premises as well as seek judgrnent against Tenant for any
monies owed to Landlord as a result of Tenant's default.
A. T'he Tenant understands and agrees that if the Tenant files a petition of banlQuptcy,it will not release Tenant from the
fuifillment of the terms and conditions of the Lease Agr�ment.
26.SUBORDINATION:
This Lease Agreement is subject and subordinate to any lease,financing,loans,other artangements,or right to possession with
regards to the building or land that the Landlord is obligated to now or in the future including existing and future financing,
and/or loans or leases on the building and land.
27.CONDEMNATION:
If the whole or any part of the Leased Premises is taken by any authority having power of condemnation,this Lease
Agreement will end.Tenant shall peaceably vacate the Leased Premises and remove all personal property and the lease terms
wi11 no longer apply.The Tenant,however is responsible for all rent and charges until such time that Tenant vacates the
Leased Premises.
28.ASSIGNIVI�NT OR SUBLEASE:
Tenant agrees not to transfer,assign or sub-lease the Leased Premises without the Landlord's written permission.
29.JOIIVT AND SEVERAL LIABILITY:
The Tenant understands and agrees that if there is more than one Tenant that has signed the Lease Agreement,each Tenant is
individually and completely responsible far all obligations under the tercns of the Lease Agreement.

30.MISREPRESENTATTON:
If any information provided by Tenant in application for this Lease is found to be knowingly incorrect,uniruthful and/or
misleading,it is a breach of this Lease.
31.BINDING OF HEIRS AND ASSIGNS:
All provisions,terms and conditions of this Lease Agreement shall be binding to Tenant,Landlord,their Heirs,Assignees and
Lega1 Successors.
32.SEVERABILITY:
If any part of this Lease Agreement is not valid,enforceable,binding or legal,it wiil not cancel or void the rest of this Lease
Agreement.T'he remainder of the Lease Agreement will continue to be valid and enforceable by the Landlord,to the
maximum extent of the laws and regulations set forth by local,staie and federal governments.
33.GOVERNING LAW:
This Agreement shall be governed,construed and interpreted by,through and under the Laws of the State of Muinesota.

36.ENTIRE AGREEMENT:
A. Landlord and Tenant agree that this Lease A$reement and any attached Addendums,Rules and Regutations,and/or Special

Premises.
B. Tenant acknowledges the receipt of any disclosures re,quired by the State of Minnesota as well as any disclosures required by
federal,state,and local jurisdictions.
NOTICE:This is an important LEGAL document.

• You are giving up certain important rights.
• If the Landlord faiis to enforce any provision of this L,ease Agreement it is not a waiver of any future default or default of the

ADDENDUM: ZERO TOLERANCE FOR CRIMINAL ACTIVITY

This LEASE ADDENDUM is incorporated into and made part of the Lease executed by the
Landlord and the Tenant referring to and incorporating the Leased Premises.
The Landlord has zero tolerance for criminal activity in or around the Leased Premises.
This policy appiies to the Tenant, residents, guests, and/or family members. The Landlord will
immediately report any evidence of criminal activity to the proper authorities, and the Tenant's
engagement in any criminal activity is a default of the Lease. �
The Tenant understands his/her responsibility to call 911 and report any suspicious activity
observed, and then notify the Landlord.
The Tenant understands that domestic disturbances not only infringe on the neighbors'
peaceful enjoyment of their property, but are also a default of the Lease.
In the event of any criminal activity in which the Tenant is directty or indirectly involved, the
Landlord will take the legal measures necessary to evict the Tenant(s)from the Leased
Premises. This includes but is not limited to illegal drug activity, gang involvement, and
domestic disturbances.
The�Tenant understands that violation of this addendum is a default of the Lease and wiA result
in the Landlord taking the necessary steps towards eviction of the Tenant. The Tenant may
then be responsible for the rent remaining due for the balance of the Lease term, court costs,

Re: Dockage Issue on Lake Minnetonka
My husband and I are Orono property owners and live at 3085 North
Shore Drive. I have researched Section 78 of the municipal code
regarding the �Prohibition of Boat Slip Rental in Residential Zones�
and I am asking you to look into a situation with our next door
neighbors regarding violation of this code.
The property in question is located at 3095 North Shore Drive. The
owners have it for sale and do not reside there, nor does anyone
else. However, there are 3 large boats that are moored at their
docks, the last one arriving just this weekend with a Florida license.
In addition, the property acts as a parking lot with the boat owners
parking everywhere - even on the front lawn facing the lake within 50
feet of the lakeshore.
Needless to say, we are quite annoyed with this situation. We all pay
a lot of taxes to live on this great lake and it frustrates us, as well as it
does our neighbors, to look at this "abuse�.
We would appreciate your review of this complaint and would like
immediate action taken on your part to rectify this situation.
