According to City Code <br /> Section 78-1405(6), a shed is generally considered an accessory structure and must be located at least 10 feet <br /> from a side lot line. Click here to be linked to City Code Section 78-1405. <br /> If you decide to proceed with a variance application to allow the current 7.8' from the side lot line, the <br /> application fee is $700 (plus an additional $700 as this is an after-the-fact request) and a $700 escrow is also <br /> required. The escrow is returned after the variance process is complete, the application fee is non-refundable. <br /> Attached is a copy of the variance application packet. <br /> The planning commission holds a public hearing where the public and your neighbors within 150' are given an <br /> opportunity to speak on your request. Following the planning commission's review they will make a <br /> recommendation to the City Council regarding the request. Your application will be presented to the City <br /> Council Meeting at a subsequent meeting. Depending upon timing, the variance process can take <br /> approximately 2 '/z to 3 months. Planning Commission and Council will determine if there is a Practical <br /> Difficulty for the request being made. If there are conforming locations the structure can be located, they may <br /> deny the request.
