The City of Orono concurs with the statements made by Mr. Sones in that memo as to the status of the project with regards to City requirements and permits. Resolution No. 2203 (copy attached) spells out the conditions of City approva 1. Regarding Condition No. 6 on Page 4, we would expect that the park district would obtain these staff-issued permits prior to beginning work. Regarding Condition No. 7 on Page 5, construction of the pathway system did commence within the one year time frame, hence the condition is satisfied. During a meeting held last May with Jeanne Mabusth and i'��IN yourself,chief landscape architect Don King reviewed the current Noerenberg Master ',��R�, Plan revisions. The primary purpose of the meeting was to determine if the changes '��'�� to the Master Plan would require a review by the Orono Planning Commission and City Council prior to commencing construction in 1991. Three items were brought up as a result of this meeting according to Don King's memorandum to the record: 1. The visitor center-Any changes to the size, location or functions of the visitor center would require review by the city council. Staff agreed that the changes being proposed would be welcomed by the city, as they eliminate the function from the building that they were concemed about, i.e., a classroom space and sale of inerchan- dise. They indicated that this review would not have to occurr until the visitor center was to be built. � 2. The amount of hardcover within the 75' setback zone from the lake -The previous lm plan had 4,560 sq. ft. or 3.8% hazdcover within this zone. Any increase from this W� would require council approval. The revised master plan has more than this allow- able amount. However, the plan can be (and has been)revised to conform to this pre- scribed amount of hazdcover. Any changes to this would require a review by the council. The�azking lot was specified to have 24 paved(asphalt) spaces constructed initially,with fiirture expansian limited to an additi�na126 spaces intencled to be developed using a"grass paver" system. Development of those 26 additional spaces will be subject to council review. A RESOLIITION GRANTING A VARIANCE TO MLTNICIPAL ZONING CODE SECTION 10.22, SIIBDIVISION 2 AND GRANTS CONDITIONAL APPROVAL FOR PARR D$VELOPZIENT PDRSIIANT TO CONDITIONS OF RESOI,IITION NO. 1652 OF THE CITY COIINCIL FILE NO. 1020 WH$REAS , the Suburban Hennepin Regional Park District (hereinafter "the applicant" ) is owner of the property located at �965 North Shore Drive within the City of Orono (hereinafter "the City") and legally described as follows: Exhibit "A" attached; (hereinafter "the property) ; and WHEREAS, the applicant has applied to the City for variances to Municipal Zoning Code Section 10. 22 , Subdivision 2 to permit the installation of trail improvements that will increase the hardcover in the 0-75' lakeshore setback zone to 3.8$ where no hardcover is normally allowed; and has applied for City Council review of the Noerenberg Park Master Plan pursuant to conditions of City Council Resolution No. 1652 adopted July 9, 1984; and WHER$AS, the use of a public-owned park is a permitted use in the LR-lA Single Family Lakeshore Residential Zoning District in which the property is located; and WHEREAS, because the intensity and type of usage of Noerenberg Park is a concern of the residents of the City of Orono, and because the property is an environmentally significant wildlife and natural area on the shore of Lake Minnetonka, and because the use of the property as a regional � park has a potentially greater impact on traffic through the surrounding neighborhood than would a purely local public park or playground, the City has requested that the applicant allow the City to review and conditionally approve development of the property as a regional park, and the applicant has agreed to such a review process. NOW, TH$REFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File No. 1020. 2. The Council finds that the increase in hardcover to 3.8� in the 0- 75' setback zone to provide f or nature trai 1 s as we 11 as to provide for the hardcover contained within the existing well house and gazebo near the lakeshore is not inconsistent with the intent of the Municipal Code and Community Management Plan. The hardship in this instance is that without such a trail system, the natural aspects of the property cannot be enjoyed to the ful lest advantage by the members of the public using the park. 4. The Noerenberg Park Master Plan has been submitted to the City Council for review. Major points in that plan include: a) Relocation of driveway on the north side of County Road 51. b) Relocation of the main entrance driveway on the south side of County Road 51. c) Construction of a new parking lot on the south side of County Road 51. d) Removal of the existing garage/storage building. e) Construction of a new visitor center, including: i ) Reception area; ii ) Park office; iii ) "Classroom" or small group discussion area; iv) Park plantings maintenance area/lath house; v) Rest rooms; f ) Construction of a Memorial Arbor. g) Construction of approximately � mile of pathways through the grounds. 5. The proposed access locations have been reviewed and approved by the Hennepin County Department of Transportation. 6. The City Council has reviewed and approved the Alternative 2 Parking Plan on August 25, 1986 with a vote of 4 ayes and 0 nays. That Parking Plan provides for an initial paved parking area for 24 cars, with potential overf low/expansion for an additional 26 cars. The Council suggested that the future expansion area would be an � appropriate test location for the use of "grass pavers". � Page 2 of 6 Cit� o� ORONO RESOLUTION OF THE CITY COUNCIL NO. 2203 • • • - s s , Parking on the north side of County Road 51 was approved by thE Council on June 9 , 1986 subject to the limitation that only 10-1� graveled parking spaces would be developed and that no grading tc create parking expansion area would be allowed on the north side of the County Road. 7. The proposed visitor center was approved by the Council on June 9, 1986 with the stipulation that any changes in size or exterior view would be subject to additional Council review, and that retail sale� of goods or services would be limited within the structure. 8. The Memorial Arbor, pathways, and general site plan were approvec by the Counci 1 on June 9, 1986. The City Engineer has reviewed the revised grading and drainage plans and they meet with his approval a� we1 1 as that of the Minnehaha Creek Watershed District. 9. The landscape plan provides for appropriate screening of thE parking area from the County Road and f rom neighboring properties. 10. The City Council has considered this application including the findings and recommendations of the Planning Commission, reports b� staff and comments of the a�plicant and the effect of the proposed use on the health, safety and welfare of the community. 11. The City Council finds that the conditions existing on thi� property are peculiar to it and do not apply generally to othez property in this zoning district; that granting the variance requeste6 would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring properties; would not merely serve as a convenience to the applicant, but is necessary tc alleviate a demonstrable hardship or difficulty; is necessary tc preserve a substantial property right of the applicant; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. - CONCLDSIONS, ORD$R, AND CONDITIONS Based upon the above findings, the Orono City Council hereby grants a variance to Zoning Code Section 10.22, Subdivision 2 to permit the installation of trail improvements that wil 1 increase the hardcover in the 0-75' lakeshore setback zone to 3.8$ where no hardcover is normally allowed; and hereby grants conditional approval of the Noerenberg Park Master Plan attached hereto as Exhibits B thru E, subject to the following � conditions : Page 3 of 6 City of ORONO RESOLUTION OF THE CITY COUNCIL • NO. 2203 • - • � � 1. Hardcover in the 0-75 ' setback zone is Iimited to the following: Gazebo 575 s.f. Pumphouse 430 s.f. Pathways 3, 555 s.f. 4 , 560 s.f. or 3. 8� Hardcover in the 75-250' lakeshore setback zone per the proposed plan is approximately 4.1$ where 25$ hardcover is allowed. Hardcover in the 250-500' lakeshore setback zone per the proposed plan is about 15$ where 30� hardcover is allowed. 2. The proposed improvements are approved in accordance with the 3 phase plan as follows: Phase I - Memorial Arbor - Landscape Plantings to the East - Parking and Grading - Site Utilities, Modify Irrigation System Phase II - Visitor Center - Pathways - Garden Trellis/Plantings Phase III - Water Feature - Wall Garden at Entrance - Fountain Sculpture - Other Architectural Features 3. The approved grading plan is attached as Exhibit B. Any changes in that plan shall be subject to City review. 4. Retail sale of items in the visitor center shall be Iimited to garden related art, books, and the like. No food or beverages shal 1 be sold. 5. Parking on the north side of County Road 51 shall be limited to the 10-12 spaces shown on the approved grading plan. Parking on the south side of County Road 51 shall be limited to 24 spaces as shown on the attached grading plan, Exhibit B, with future expansion area adjacent limited to an additional 26 spaces which are intended by Council to be developed using an innovative "grass paver" system. Development of those 26 additional spaces will be subject to Council review. 6. Variance authority granted by this resolution runs with the property not with the owner, but is permissive only and must be exercised by commencement of the improvements which require the variance (pathway system) within one year of the date of Council approval of this resolution, or the special conditions of this resolution related to the variance will expire on that date (June 22, 1988) and will at that time be subject to application for a variance renewal. ' 8. Violation of or non-compliance with any of the terms ana conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shal 1 be punishable as a misdemeanor. 9.
