David Erotis 3436 40`h Street NE Buffalo, MN 55313 RE: Tree Removal at 2685 North Shore Drive Dear Mr. Erotis: The City has reviewed the landscaping plan you submitted for the walker residence at 2685 North Shore Drive. The City has ordinances that pertain to the tree and vegetation removal within 75' of the lake. The intent of the ordinances is to protect &preserve existing screening on the lakeshore. Trees with a diameter of 6 inches or more can be removed with a permit from the City provided that at least the equivalent number of replacement trees of a size that are found acceptable to the City staff are planted at the same setback from the shoreline as those removed. Dead trees can be removed without a permit but requires an inspection by City staff prior to removal. The City did not inspect the trees prior to removal and must now require replacement of the same size trees at the same setback from the lake as the existing trees that were removed. Please submit a revised plan for review. I also noted a stone path in the 0-75' zone. This plan and the plan you submitted to address the drainage issue show the path differently. Please submit a final plan on the stone path for approval. Enclosed is the ordinances that addresses Tree Removal and Stairways in the 0-75' zone. Stairways, Lifts and Landings. Stairways and lifts aze the preferred altemative to major topographic alterations for achieving access up and dotirn bluffs and steep slopes _ to shore areas.Stairways,lifts and landings shall be allowed in the shore setback zone and must meet the following design requirements: �= 1. Stairways and lifts must not exceed 4 feet in«-idth. -�- 2. Landings for stairways and lifts shall not exceed 32 squaze feet in azea. 3. Canopies or roofs are not allowed on stairways,lifts, or landinas. _ . 4. Stairways,lifts and landings may be either constructed above the - ground on posts or pilings or placed into the ground, provided they are desi�ned and built in a '� manner that ensures control of soil erosion. - 5. Stairways,lifts and landings must be located in the most visually inconspicuous portions of lots, as viewed from the surface of the public �vater assuming summer, leaf-on conditions,whenever practical. 6. Facilities necessary to provide shore azea access to physically handicapped persons shall be allowed provided that the dimensional and performance standazds of subitems 1 -5 are completed in addition to the requirements of the Minnesota Re;ulations, Chapter 1340. 7. A building pernut shall be obtained for construcdon of stairways, lifts and landings regardless of whether such improvements aze conshucted abo�•e,at or below grade. G. Steep Slopes. Any applicant requesting a permit for construction of sewage treatment systems,roads,driveways,structures,or other improvements on steep slopes,shall provide adequate information to allow the City to evaluate possible soil erosion impacts and development of visibility from public'waters before such permit may be issued. W1ien determined necessary, conditions shall be attached to issued permits to prevent erosion and preserve existing vegetation screening of structures,vehicles,and other facilities as viewed from the surface of public waters, assuming summer, leaf-on vegetation. � H. Height of Structures.No structure within the Shoreland Overlay District shall exceed the height limitations set forth in the standards for the underlying zoning district. ORONO CC 376-13 (2-24-92) .. . § 10.56 I. Vegetation Alterations. 1. No live tree within 75 feet of the shoreline or within the bluff impact zone with a diameter of 6 inches or more(or 19 inches in circuriiference or greater)measured 3 feet above the ground may be removed without first obtaining a permit from the City staff provided that at least the equivalent number of replacement trees of a size and nature found acceptable to the staff are planted at the same setback from the shoreline as those removed.Appeals of staff deternunations as to type,size and quality of the trees to be replaced will be to the Council. Removal of trees that are dead shall not require a permit but such trees must be inspected by City staff prior to their removal. _ 2. Intensive vegetation clearing within 75 feet of the shoreline,on steep slopes or within the bluff impact zone within the Shoreland Overlay District is prohibited. � Limited clearing of shrubs and trees less than 6 inches in diameter and cutting,pruning and trirnming of trees of any size is allowed to provide a view to the water from the principal dwelling site and to accomodate the placement of permitted stairways and landings,picnic areas,access paths,beach and watercraft access azeas,and permitted lock boxes,provided that the screening of structures,vehicles or other facilities as viewed from the water, assuming summer, leaf-on conditions, is not substantially reduced. - Source:Ordinance No. 127,2nd Series Adopted: 7-11-94 J. Topographic Alterations/Grading and Filling. 1. Grading and filling and excavations necessary for the cor�struction of structures, sewage treatment systems, and driveways under validly issued construction permits for these facilities do not require the issuance of a separate grading and filling permit. However, all grading and filling activity approved permits for construction of structures, sewage treatment systems, and driveways shall adhere to the grading and fillinD standazds of this section. 2. Grading, filling or excavating of more than 10 cubic yazds is prohibited within 75' of the Ordinary High Water Level of the public waters enumerated in Subdivision 7 of this section. Grading,filling or excavating of 10 cubic yards or less shall require � City staff review and permit and be subject to other pertinent sections of the Zoning Code.
