� , , ZONING PERMIT ESCROW AGREEMENT
Permit#
AGREEMENT made this day of , 20_, by and between the CITY OF ORONO,
a Minnesota municipal corporation ("City") and ("Owners").
Recitals
1. A building permit application has been filed for a zoning permit for a property located at
the ("Subject Property"), legally described as ,
Hennepin County Minnesota.
2. Owner requests the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE, THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit $ with the City. All accrued interest, if any, shali be paid to the
City to reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering or legal consultant review) or will
incur in reviewing the plan. Eligible expenses shall be consistent with expenses the Owners would be responsible
for under a zoning permit application. The escrow will also guarantee reimbursement to the City for all out-of-
pocket costs the City has incurred to assure that the work is completed in accordance with the Stormwater
Pollution Prevention Plan and the provisions of Orono City Code Chapter 79. The financial security may also be
used by the City to eliminate any hazardous conditions associated with the work and to repair any damage to
public property or infrastructure that is caused by the work (including planning, engineering, or legal consultant
review) associated with permit # if compliance with the approved zoning permit is not
accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in #3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when the review has been completed and written notification is received from the Owners requesting the
funds.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn. Stat. §§415.01 and 366.012.

Applicant, Kent Hodder, at 2640 North Shore Drive, applied for and received a variance to construct an
accessory structure forward of the principal structure. A building permit was issued on 1/15/2013 for
construction of the shed (building permit application attached). When our inspector visited the property
yesterday for an inspection he noted significant land alterations occurring without a permit. I have attached a
copy of the survey submitted with the building permit application in January 2013 showing the project area and
I've also noted the area that was re-graded without a permit. In an effort to save the applicant money,
topography was not shown over the entire site, just the area of the new project.
Melanie and I met with the contractor yesterday, who was told to install silt fence immediately, obtain a survey
showing pre-existing grades and proposed grades along with calculations of the amount of earth movement.
I hope you understand all this. I'm available until 10:30 today and again from 1 to 3 and then not in until
tomorrow at 7:30. I'm not sure if you want to visit the site also.

Kent,
Good morning, I wanted to touch base with you regarding your projects at 2640 North Shore Drive.
First, a covenant governing the use of your oversized accessory building should have been finalized with you at the time
of the building permit issuance. This covenant requirement was missed by permitting stafF and the permit was issued
without it... This was a requirement which was listed within your approval resolution for the variance last year.
Secondly, our inspector conducted a plumbing rough-in inspection yesterday at your property for the garage. While a
toilet and sink are allowed to be installed in an accessory building without a Conditional Use Permit(CUP); plumbing in an
accessory structure requires a separate restrictive covenant. Please note, we did not want to hold up the rough-in
inspection but we cannot allow further plumbing work until we have the signed covenants on file and recorded.
I will have our attorney draft the covenants and I will send them to you as soon as possible. I believe they should be
able to be combined into one covenant document.
Finally, on May 22�d the City stopped grading work being done on your property without permits between the garage and
the home. This grading work without permits is a violation of 78-1286(d). Inspector Willie Gibbs spoke with your
contractor (Ron) regarding the grading violation and directed him to install silt fencing and to stop work in the area of
concern. Your contractor was told work could continue on the accessory structure and the area around it. It has been
two weeks since we met with your contractor and discussed the after-the-fact zoning permit requirement and after-the-
fact(double) fee. To date we have not received an after-the-fact zoning permit application as required.
Attached is a copy of the zoning permit application, which lists the required submittals for the application. Because there
was no topography shown on the original survey, the submitted survey must show pre-existing topography and
current/changed topography with a calculation of earth movement/disturbance, including any fill that was brought in or
left the site. Ron did call me yesterday to inquire how we calculate��disturbance".
Please assure that we receive the after-the-fact zoning permit application, double fee and required submittals by or
before Thursday, June 13, 2013 or we will have to issue a stop work order for all projects on the property.
Please contact me with any questions. I will forward to you the covenant document upon receipt from our attorney.

Sec. 78-1434. -Area restrictions.
In all R districts, no accessory building shali exceed 1,000 square feet of footprint area; except that
accessory structures in excess of 1,000 square feet will be allowed under the following conditions:
c. Such structure shall be allowed only when the property owner agrees and covenants in writing
with the city as follows:
1. No future subdivision will be approved that places the structure within a lot that has no
principal structure, except that the city in its subdivision approval may grant a finite time
period in which the oversized accessory structure may remain without a principal structure, in
order that a principal structure may be constructed. At the end of this time period, the
oversized accessory structure must be removed if no principal structure has been
constructed.
2. If the property is subdivided, the oversize accessory structure and principal structure will be
located together within a lot that meets the minimum lot area requirement for the given size
of accessory building.
3. In subdivision approval, the setback required for the oversize accessory structure shall
remain.
Such covenant shall be binding on current and future property owners and shall be filed in the
chain of title of the property.
Sec. 78-1437. - Plumbing.
Because the provision of plumbing fixtures and wastewater plumbing in accessory buildings has the
potential to allow such buildings to be used as dwelling units, and because it is the policy of the city to limit
residential development density to the allowed densities within the respective zoning districts, plumbing in
accessory buildings shall be regulated as follows:
(1) The provision of outside sillcocks and indoor water supply shall be allowed in any accessory building
that is conforming in location, size and height.
(2) Installation of any combination of fixtures requiring wastewater plumbing that does not include a
shower or bathtub shall be allowed in any accessory building that is conforming in location, size and
height with, subject to provision of municipal sanitary sewer or a conforming sewage treatment system
designed to handle the anticipated flows from such fixtures, and subject to the property owner's
executing a covenant providing that the accessory building will not be:
a. Used for a home occupation unless specifically approved by the city or if allowed by this Code.
b. Used as a dwelling unless a guest house conditional use permit is obtained.
c. Rented, leased or otherwise provided for use as a dwelling under any circumstances.
(3) Installation of any combination of fixtures requiring wastewater plumbing that includes a shower or
bathtub shall be allowed only in an accessory building that is conforming in location, size and height
and which meets one of the following criteria:
a. The accessory building has been approved for a guest house conditional use permit; or
