This application�vas revie�.��ed as Zoning File �03-2929. 2. The property is located in t�e LR-1�ZoninQ District,where 2 u--res is the min�um lot area. The properiy is approxirrately 1.47 acres in�oss area includinQ wetiands. 3. The proposed use of the accessory structure with p:�.�=nb:�� will not be detrimzntal to the residential character of the neighbor'=ooc_ b. The plumbing fixtures proposed are in keepin�with t�: inr_uded use of the accessory structure. c. The property size and building location are sufficient to::Io�.=.�the conditional use permit to be granted. d. The CUP should be subj ect to the standard"Plumbinj in�cccssc�ry Structure" conditions. e. The installation of a kitchenette in the structure would��t b= appropriate as that�vould make the building easily functional as a gue_.noL�e for which the the property does not qualify. f. The property can remain in compliance with the hardco�,-:;re�-.?irements ifthe concurrent removals of driveway are completed as prc�:�sz�. 4. The City Council has considered this application includiLa tr� findings and recommendations of the Planning Conunission,repons by Cir. �ta�. comments by the applicants and the effect of the proposed conditional use ��rr�: on the health, safety and welfare of the community. 5. The City Council finds that granting a conditional use permit :� al:��.;-plumbing in the accessory structure will not be detrimental to the health,saf�.�or_eneral welfare of the public, would not adversely affect light, air nor pose � �re :azard or other danger to neighboring properties, nor w•ill its use depreciate :_rro�-�ding property values and that the proposed level of use of the property will b= in���ping with the intent and objectives of the Zoning Code and Comprehensive?:an �f the City. Page 2 of 6 - �°� 0 0 ���- CITY of ORONO � : `� •y�'`• l� �� ' �� �'�' RESOLUTION OF THE CITY COUNCIL L�kESII�4'� NO. � � !� � CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the findings noted above,the Orono City Council hereby �ants a conditional use permit per Municipal Zoning Code Section 78-303, Subdivision (17) to allow plumbin�including a toilet,sink and shower to be installed in a proposed accessory structure, per the site and building plans attached to this Resolution as Exhibit B and as annotated by City staff, subject to the follotiving conditions: l. The applicants by executing this resolution agree and covenant that the property will be bound by the following conditions: A) the accessory building will not be used for a home occupation unless specifically approved by City or if allo�ved by City code; B) the accessory building will not be used as a d�velling unless a guest house CUP is obtained(site is not large enough to qualify); C) the accessory building will not be rented, leased or otherwise provided for use as a dwelling under any circumstances; and D) the accessory building shall not be fitted with a kitchenette (kitchen sink, range or refrigerator); and installation of such fiYtures in the future shall be considered a violation of this approval. 2. The applicants shall remove excess driveway hardcover per the site plan attached as Exhibit B so that the property remains in hardcover compliance. 3. Authorities granted by this resolution run with the property not with the applicants, but are permissive only and must be esercised by obtaining a building permit for the new construction within one year of the date of Council approval, or the variance�vill expire on that date (October 27, 2004). 4. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the Zoning Code,shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 5. The undersigned applicants have read, understood and hereby a�ee to the terms of this resolution and on behalf of themselves, their heirs, successors and assi�s, hereby a�ee to the recordin� of this resolution in the chain of title of the property.
