AkESH�4� A RESOLUTION APPROVING A SUBDIVISION OF A LOT LINE REARRANGEMENT AT 2465-2485 NORTH 5HORE DRIVE FILE NO. l.b-3829 WHEREAS, the City of Orano is a municipal corporation organized and exisking under the laws of the State of Min.n.esota; and VYHEREAS, the City Council of Orono (hereinafter"City Coun�cil'� has adopt�ed subdivisian regul�tians for the orderly, economic and safe development of land within the City; and WHEREAS, B. John Lindahl, Jr. and Sarah B. Lindahl, a married couple, {hereinaft,er the "Applicants"} are the owners of'the properties located at 2465 and 24851\Torth Shore Drive within the City of Orono (hereinafter"City") and legally described as fouows: Attached as Ezhibit A(hereinafter the"properties"�; and WHEREAS, the applicants have made application to the City for appmval of a lot line reanangement which would relacaxe the lot boundary line be�tween the properties;and �VHEREAS,after due published aad mailed.notice in accordance with Minnesata Statutcs 462.358 et. seq. and the City of Orono Zoning and Planning Codes,the Orono Planning Commission held a public hesring on the proposed Iot liue rearraagement on May 16, 2016 at which time all persflns desiring to be heard canc�ming this applicatioa were given the opportunity to speak thereon; and WHEREAS, the Orono City Council reviewed the pr�posed lot line rearrangeme�t at a regular meeting held on M$y 23, 2016 and makes the following findings with regards to the propased lot line rearrangement: FINDINGS l. This application was r�viewed as Zoning File#1b-3829. 2. The parcel at 24651vTorth Shore I?rive(the"2465 parcel'�confiaiaas 1.33 acres in t�ta1 azea and currently contains a single family residence and autbtuldings. 3. Th�e parcel at 2485 Ivorth Shore Drive(the"2485 parcel'� contains 2.47 a�res in total area and curxently contains a single family residence and outbuildings. 4. This application contemplates a lot line reasxangement to trans.fer a 0.29 acre portion of the 2485 pazcel to the 2465 parcel, The 0.29 acre portion consists of dry buildable land. 6. Following the lot line rearrangement the 2465 parcel will contain 1.62 acres in total and the 2485 parcel�witll contain 2.18 acres in tot�l. 7. The lot line rearraagement will resul# in the resid,euce and barn on the 24b5 parcel becoming conforming with regard to west side setback. 8. Because this is $lot line rearrangement which results in no additional lats,no park fee or stormwater trunk fee will be required. CONCLUSIONS,ORDER Al�� CONDITION5 NOW,Tl�REFORE,BE IT RESOLVED,that based upon one or more of the findings noted above, the City Council of the City of Orono hereby grants the lot ].ine rearrangement of the above referenced properties based on the lot Iine rearrangeinent stnvey with most recently revised date of April 20, 2016 by Wayne W, Preuhs of Advanced Surveying and Engineering Co.,attached as Ezhibit B; subject to the follvwing conditions: 1. The 0.29 acre portion of the 2485 parcel to be transfe�red s�hall not be considered a standatone buildable lot, and shall be legatly combined with the 2465 parcel. 2. Followin.g the lot line reazraagement the properties shall be legally described as follows: a. 2465 pamel: Description a�.tached as Eahibit C; b. 2485 parcel: Deseription attached as Ezhibit D. 3. The Applicants shell file the appropriate deeds reflecting the new legal descriptions with the Hennepin County Recorde�r's Office aad/or Registrar of Tities Office on or before May 23,2017, or the approval granted by this resolu�ion shall expire, Adop�ed by the City Cauneil of Orono,Minnesota this 23rd day of May,2Q16.
