A RESOLUTION APPROVING
A CONDITIONAL USE PERMIT
PER SECTION 78-1116(a)(8)
FILE NO. #05-3095
WHEREAS, Gregg W. Steinhafel and Denise E. Steinhafel, husband and wife
(17ereinafter "the applicants") are owners of the property located at 2265 North Shore Drive within
the City of Orono (hereinafter "the City") legally described as follows:
EXHiBIT A attached (hereinafter "the property"); and
W�-I�REAS, the applicants have applied for a conditional use perniit per Municipal
Zoning Code Section 78-1116(a)(8)to permit construction of a pernlanent dock to be located within
a wetland at the perimeter and within the basin of Lalce Minnetonka adjacent to the property; and
WHEREAS, after due published notice and inailed notice in accordance with
Min.nesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning
Commission held a public hearing on September 19, 2005, at which times all persons desiring to be
heard concernin�this application were �iven the opportunity to speak thereon.

1. This application was reviewed as Zoning File #OS-3095.
2. The property is located in the LR-lA Single Family Lalceshore Resideniial zoning
district.
3. The Orono Planning Commission revie��ed this application on September 19, 2005
and recominended approval for a conditional use permit for constnlction of a
pernzanent doclt by a vote of 7-0, based on the follo�vin� findin�s:

a) Penizanent docks are allowed by Conditiona]Use Permit in the floodway and
flood fringe of Lake Minnetonka per the provisions of Orono Muiucipal Code
Section 78-1116(a)(8).
b) Docks which provide reasonable access to the lakeshore a�id do not exceed 8'
in width are a permitted use within wetlands per the provisions of Municipal
Code Sectioxi 78-1606(a)(4).
c) The properiy abuts the shore of Lal:e Minnetonka,and the proposed dock will
be constructed within a lake perimeter wetland and will provide reasonable
access to the lake for the applicants' stated intent of nature enjoyment,
fishing, etc. The dock is not specifically intended for boat storage. The
proposed permaiient dock will be 100' in length eatending lal:eward from the
shoreline, being 8' in width and having a"T"section at the lal:eward end of
dimension 8' x 24'.
d) The proposed dock location is within a small inlet connecting to Crystal Bay
of Lake Minnetonka where wave and ice action will be niinimal, hence tlie
stability of the dock will be at minunal risk, and will not require winter de-
icing to maintain its integrity.
e) The proposed permanent dock by virtue of its location in Lake Minnetonka
is under the jurisdiction of the Lake Minnetonl:a Conservation District
(LMCD) and is subject to the LMCD permitting process.
fl The proposed pennanent dock will be located to meet LMCD setback,
location and length standards and is not anticipated to result in conflicts with
adjoining docks nor pose any navigation hazards.
4. The City Council finds that the conditions eaisting on this property are peculiar to it
and do not apply generally to otller property in this zoiiiiig district, and that grantin�
of the conditional use perinit would be in keeping with the spirit and intent of the
Zoiiing Code and Comprehensive Plan of the City.

5. The City Council has considered this application including the findings and
recommendations by the Planning Commission,reports by City staff, comments by -
the applicants and the effect of the proposed conditional use permit on the health,
safety and welfare of the community.
CONCLUSIONS, OgtDER AND CONDIT'IONS
Based upon one or more of the above findings,the Orono City Council hereby grants
a conditional use permit per Municipal Zoning Code Section 78-1116(a)(8)to permit construction of
a permanent dock to be located within Lake Minnetonka adjacent to the property, subject to the
following conditions:
1. The dock shall be constructed per the location and design as indicated on the
approved site plan attached hereto as Exhibit B.
2. The dock shall be allowed as long as it continues to be permitted by the LMCD and
DNR and is in conformity with the rules and regulations of those agencies.
3. Future replacement or alteration of the dock will require a new conditional use pernut
from the City of Orono.
4. The dock shall be constructed in accordance with any pertinent requirements of the
City of Orono ordinances regarding wetlands.
5. The property owner is advised to obtain the appropriate permits from the LMCD in
the event that winter de-icing of the dock area is proposed.
6. Authorities granted by this conditional use permit run with the property not with the
applicants, but are permissive only and must be exercised by obtaining a City of
Orono one-time dock permit within one year of the date of Council approval, or this
conditional use permit will expire on that date (September 26, 2006).
7. Violation of or non-compliance with any of the terms and conditions of this
conditional use permit shall constitute a violation of the zoning code, shall
automatically terminate any authority granted herein, and shall be punishable as a
misdemeanor.

8. The undersigned applicants have read, understand and hereby agree to the ternZs of
this resolution and on belialf of themselves, their heirs, successors and assigns,
hereby agree to the recording of this resolution in the Chain of Title of the property.
Adopted by the City Council of the City of Orono, Minnesota at a regular meeting
held on the 26t�' day of Septeinber, 2005.
