2. A maintenance agreement for the retent�on pond and rain �ardens m��st be executed and
recorded.
3. Rule J fees must be paid.
Background:
The proposed project is the consttuction of a new Minnetonka C�nter for the Arts Facility near
North Shore Drive and Briar Street in Orono. No wetlands are lacated on the site. The site is
about 6 acres in size. The project has received Planning Com�l�ission and City Council appro��al.
Rules B and N apply.

The erosion control plan meets Rule B requirements and incluc�c� silt fence w�here neeessary,a
rock construction entraaee,and h�aybale pmtection around catch hasins. A surety of$2,500 is
required.
Rule N
This project requires B1VIps and ratc eontrol. �MPs proposed (ur the project include four rain
gard.ens. Rate control is provided by a stormwater retention pan�l_ The pond iias a a 4 foot 10:1 �
bench. Runoffrates at each poinc exiting the site will decreas�� li�r che 1, 10, a�id 100-year
events. Overall rwioffrates from tUe site will decrease bv 72 ��rr��nt for the 1-year event and by
46 percent for the 100-year event. Excess wa.tet in the rain gard�ns will drain into the retention
pond. Drainage from the retention poad will run to a drainage e�sement on the neighboring
property to the nortla. The City of Oron�has confirmed that th��� have a drainage easement over
the land to the north of the property. Neighbors have r�ised conc�,ns that the project could be
increasing the runoffto the properties to the north and that the uu�let from tlie proposed pond
would cause erosioa in the cirainage easement to the north of tl,e Property_ However,rates will
not increase to any of the nei�hboring properties and a visit to tli�• site indicated that the drainaae
easem�nt receivi.ng water from th�pond is naturally veaetated u,�tl should be able to withstand
flow from the pond.

The Minnehaha Creek Watershed District Board of Managers reviewed the above

Malcolm Reid fee equal to the actual costs of analysis of the project, field inspection, engineering
Robert Schroeder services, legal services, and any subsequent monitoring oi the wurk. These costs are
referred to as Rule J fees.

staff will issue the permit. You are reminded that work on the project cannot begin until
the permit has been issued. This permit expires one year from the date of this letter. If
