Based upon one or more of the fiadings noud above, the Orono City Couaci3
hcreby grants a variance to Mun3cipal Zonin� Code Section 10.23, Subdivision S (A) to permit
the installation of a directional sign on a residential property located at Z040 North Shore Drlve ,
for the bcnefit of the Minnetonka. Center for the Arts, subject to the follow� condidoas:
1. Applicant shall obtain an access easement from the owner of the subject properry
to allow for the re�ular maintenance af the sign.
2. Applieant shall obtain a building permit from the City of Orono. 'The application
for a building permit shall inciude a site plan.locating directional sign 5 feet from
all lot lines. .
3, Authorities graated, by tlus variaa.ce run with the prapezry not with the app�ic�nt,
but are peimissive oaly and must be exercised by application for a buildiag
permit withia one year of the date of Council.approval, or this variance will
expire on that date (Febivary 8, 1994). �

Brief Review of Application
The Art Center needs a directional siga at the intersection of Hi�hways 15 an.d 51 for
both students and visitors traveling west on County Road 15 from mi�ssit�g the right turn to the
Art Centex. The Code classifies s�gns as accessory s�uct►ues or uses subordinate to or servin,g
the principal use of structure on the same lot. In ord� to install the sign on ons of the
residential lots at the intersecdon, it is necessary for applicaat to apply for the variaace. Keith
Fsickson, the owner of 2040 North Shore Drive, has given the applicant the approval to instalt
the 8 foot high directional sign at 3 s.f. Appli�cant has also worked. cZosely with Hennepin
Counry so that the location of the sign will not x'eStrlct situ� at the iatersect�ing road.ways.

The Art Center ha� filed a variance application that would
allow a directional sign to Yie located at 2040 North Shore Drive,
a residential lot located at the int�rsection of 15 and 51.
Earlier in ' 92, the Art Center was advised that placement of such
aigns were not p�rmitted by� code as a11. aigne are� considered
acceeaory in support or connected with the principal uee on the
aubject property. The Art Center advised that etudents and
visitors were mi�sing turns and finding themeelvea all the way into
Navarre before realizing they had misaed the turn at S1
intersection. In discussing the di.lemma with City staff, the

The �ign is a etandard directional type sign wi.th� a greea
background and white le'ttering. Th� sign shall be located 5' from �
side and road lot lines as r�quired by� code and wi11 cr�ate no
siting problems for the user� of the intersection. Per the pl.ane '
�ubmitted with the application, the sign wi11 be 1 1/2x2• measuring
3 9 .f. in area.
The City'� ordinanc�s do not allow directional signe of th:ie
typ�.' Signs that advertiae the varioua churches in the C�ty
located along the roadways have been grandfathered in as they have
been installed prior to the City'� regulatione for aignage. The
many �igns that appear around the City advertising garage ealea
when placed within the road right-of-waye are removed. Reoidents
are encouraged to place� the�e informational eigns on adjacent
private properties. Th�se are temporary informational signe and
ar� removed as soon as the garage eale� are compl�ted.

application are not addressed in the code and can only be alYowed
via appropriate variance approvals.
