Box 66 Orono, MN 55356 Crystal Bay, MN 55323-0066 July 29, 1997 � Marty Schneider 1235 Hunter Drive Wayzata,Minnesota 55391 Deaz Mr. Schneider: The city of Orono's Building Code Board of Appeals has determined the type of use proposed by the Environmental School for your building to be an E classification. To meet the requirements for this use classification, your building needs significant improvements. Because there is a very short time remaining before the fall opening of the Environmental School, it is very important that these improvements are initiated as soon as possible. All improvements necessary for the building to comply with the E classification will need to be completed before the Environmental School use will be allowed to begin. The existence of an in-process appeal of the Building Code Boazd of Appeals ruling will not be a reason to allow the Environmental School use to begin without the building being in full compliance. The Building Code Board of Appeals'decision,and the minutes of the Board's meeting,have been forwarded to the State Building Code Department for their review. It is my understanding that the scope of their review relates more to determining whether the Building Code Board of Appeals was within its scope of authority in the decision that it made,than to reviewing the specifics of the code interpretation made at the local level. You also have the ability to appeal the decision to the State Building Code Commissioner of Administration. Again,it is my understanding the review by the Commissioner is generally to ensure the Building Code Board of Appeals was within its authority in the decision it made,rather than reviewing the specifics of the code interpretation made at the locallevel. It is unclear how long the process of review by the State Building Code Department, and a potential appeal to the Commissioner, will take. What is clear is that the conditional use permit approved by the City Council, for the use of your building by the Environmental School,requires that you retain an architect to address code requirements for change of occupancy. Because the Environmental School wants to begin its use on September 1,there are only five (5)weeks remaining to accomplish the necessary improvements to the buildi.ng. This plan will be reviewed by the city and,when the plan is approved, a building permit can be issued. The improvements will then need to be completed before the Environmental School use will be allowed to begin. Work has been completed on the building to allow the building to be used under the F-2 occupancy classification. It is my understanding that the children's art school will be operating in the building for less than 12 hours per week or 4 hours in any one day. It is also my understanding that the Minnetonka Environmental School may be using the building for staff inembers but the children will not be using the building until a certificate of occupancy has been issued for the E occupancy classification. Box 66 Orono, MN 55356 Crystal Bay, MN 55323-0066, September 29, 1997 James Logan Graham Construct Architects 3750 Minnehaha Avenue Minneapolis, Minnesota 55406 Re: The Old "Hill" School Dear Mr. Graham: In response to your letter of September 26, 1997, my research of the City's files found the last inspection report to have the following corrections listed: 1) Exit signage required at all exits. 2) Post occupant load sign in 2nd floor assembly room. 3) Post balcony door "No Exit". 4) Provide railing on main stairs at window. If these corrections were completed and inspected, a certificate of occupancy could be issued and the building used as a F-2 occupancy (educational use beyond the 12th grade with less than 50 occupants in any room and educational use through the 12th grade for less than 12 hours per week or 4 hours in any one day). As stated in my July 16, 19971etter to you, the F-2 classification would allow an education use beyond the 12th grade with less than 50 occupants in any room and educational use through the 12th grade for less than 12 hours per week or four hours in any one day. The motion made by Loren Kohnen was to reaffirm my change in occupancy classification from B-2 or F-2 to an E occupancy classification. Schreiner Atelier LeSueur 2180 North Shore Drive Way�ata, Minnesota 55391 Re: Building Code Compliance - 2180 North Shore Drive Dear Ms. Schreiner: On Apri127, 1994 this office first became aware of your change in use of the building at 2180 North Shore Drive in Orono. As you know, this change requires the building to meet all building code requirements for the new use. Some progress has been made; however, I feel the City has provided ample time for you to complete these requirements. Some of the outstanding items include handicap access and code compliance of the exterior stairs. This letter is to notify you that we are aware that the building is not being used at this time and that the building must be in full compliance before it is occupied again.
