The purpose of subsection (4) of this section is to establish predictable, balanced regulations for the siting and screening of wireless communication equipment in order to accommodate the growth of wireless communication systems within the city while protecting the public against any adverse impacts on the city's aesthetic resources and the public welfare. b. Personal wireless service antennas. Personal wireless service antennas erected on a municipal water tower may be allowed as a secondary use by administrative permit, provided they comply with the city policy regarding the use of city-owned property for wireless telecommunication antennas and provided they meet the following conditions: 1. The antenna shall be in compliance with the state building code and all other applicable federal and state regulations and permits. 2. Structural design, mounting and installation of the antenna shall be in compliance with manufacturer's specifications and shall be verified and approved by a registered professional engineer. 3. No advertising message shall be affixed to the antenna. 4. Antennas shall not be artificially illuminated unless required by law or by the Federal Aviation Administration (FAA) to protect the public's health and safety. 5. When applicable, proposals to erect new antennas shall be accompanied by any required federal, state or local agency licenses. 6. Transmitting, receiving, and switching equipment shall be housed within the existing structure. If a new equipment building is necessary for transmitting, receiving and switching equipment, it shall be situated in the rear yard of the principal use and shall be screened from view by landscaping. 7. All obsolete and unused antennas shall be removed within 12 months of cessation of operation at the site unless an exemption is granted by the city administrator or his designee. The applicant shall demonstrate by providing a coverage/interference analysis and capacity analysis prepared by a registered professional engineer that the location of the antennas as proposed is necessary to meet the frequency spacing needs of the personal wireless service system and to provide adequate portable personal wireless service coverage and capacity to the area. (5) Study and research centers owned or operated by one or more nonprofit charitable, scientific or educational organizations, provided no building other than a residence shall be located within 100 feet of any lot line of an abutting lot in an R district. a. Open space. Not more than 15 percent of land devoted to use as a study and research center shall be occupied by structures or buildings without a conditional use permit allowing a greater percentage of such land use. Any application for zoning of land as an RR-1B-1 one-family rural residential district shall be accompanied by a map or plan showing the portion of land within the district that may be occupied by structures or buildings, which shall become a part of the conditions upon which such zoning is approved; and no structure or building may be located outside of such portion without a conditional use permit allowing the structure or building. b. Height. No structure or building in a study and research center in any RR-1 B-1 district shall exceed 30 feet in height except as provided in section 78-1366. c. Temporary or permanent residents. No study and research center in any RR-1 B-1 district shall at any time serve as a temporary or permanent residence for a number of persons in excess of that determined by multiplying by 2'/2 the number of acres of land devoted to use as such study and research center without a special permit allowing a greater number of persons in such number and for such periods of time as the council may deem appropriate, due consideration being given to the interests of health, safety and public welfare. d. Use. No study and research center in an RR-1B-1 district shall at any time permit more than 300 persons to be present by invitation upon its property without a special permit allowing a greater number of persons in such number and for such periods of time as the council may deem appropriate, due consideration being given to the interests of health, safety and public welfare. A RESOLUTION GRANTING A CONDITIONAL USE PERMTT PER MUNICIPAL ZONING CODE SECTION 10.03, SUBDIVISION 5 AND A VARIANCE TO SECTION 10.61, SUBDIVISION 5 (A) FILE NO. 1923 WHEREAS, Atelier LeSueur, Inc. (hereinafter the "applicant") has an interest in the property located at 2180 North Shore Drive within the City of Orono (hereinafter "City") and legally described as: refer to Exhibit A, attached (hereinafter "property"); and WHEREAS, per Section 10.03, Subdivision 5, the applicant has made application to the City to allow the continuation of a non-conforming use of the facility as a school of fine arts providing full-time class instruction and a variance to Section 10.61, Subdivision 5 (A) that would allow the continued use of an open parkin� area located within a required side street yard where no such parl:ing would be allowed. NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File #1923. 2. The property is located in the RR-1B Single Family Residential Zoning District requiring two acres in area. The property consists of 25,4-40 s.f. or .63 acres. 3. The building referred to as the Hill School was built in the late 1800's and served as an elementary school for the Crystal Bay community. 4. From August 15, 1989 through September 11, 1990, the Art Center of Mi.nnesota (formerly Minnetonka Art Center) leased the facility from the new owner for the purpose of continuing use of the facility for art instruction purposes. 7. From the later part of 1990 through the present, the facility has served as a licensed day care and a dance school. g. From the late 1800's to the present, the facility has never been used as a residential dwelling. �. As required by Municipal �oning Code Section 10.03, Subdivision 5, the applicant has filed for a conditional use permit to allow the continued use of the facility or a fine arts school offering full-time instruction. 10. On April 18, 1994, the Orono Planning Commission voted unanimously to recommend approval of the conditional use permit and variance based on the following unique findings: a. The use has existed prior to the creation of the single family zoning district through to present times without interruption. b. The use has had no detrimental effects on the surroundin� residential neighborhood. c. The art school to be operated from the Hill School building will continue to share parking facilities of the Art Center of Minnesota consistent with the former comprehensive operation. d. The City has no record of vehicular accidents resulting from the use of the gravel parking areas along the east side of the properry adjacent to Briar Street. The Council finds that the conditions existi.ng on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance would not adversely affect traffic conditions, li�ht, air nor pose a fire hazard or other danger to neighboring properties, would not merely serve as a convenience to the applicant, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicant; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. 12. The City Council finds that granting a conditional use permit to allow the continued use of the facility as a fine arts school offering full-time instruction will not be detrimental to the health, safety or general welfare of the public, would not adversely affect light, air nor pose a fire hazard or other danger to neighboring properties, nor will it depreciate surrounding property values and that the proposed level of use of the property will be in keeping with the intent and objectives of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council concludes that applicant's proposed use of the property as a school of fine art instruction is a legal non- conforming use of the property and hereby grants a conditional use permit per Municipal Zoning Code Section 10.03, Subdivision 5. The Council further concludes that the configuration of the Hill School property and the historic background and school use of the property are unique and consequently grants a variance that would allow open parking stalls within the required side street yard. This approval is subject to the following conditions: l. Applicant has received approval of a variance to allow open parkin� within a required side street yard area as shown on approved site plan attached to this resolution as Page 7. Applicant shall be responsible for installing a median within Briar Street right-of-way as shown on said site plan to be completed by November 9, 1994. Applicant shall provide an updated survey locating travelled right-of-way of Briar Street. NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File OS-3139. 2. The property is located in the RR — 1B, Zoning District which requires a minimum lot area of 2.0 acres and a minimum lot width of 200'. The property contains 0.58 acres of area and 106' of defined lot width. 3. The Planning Commission reviewed this application at a public hearing held on November 21, 2005 and on March 20, 2006 and recommended approval of the variances and conditional use permit based on the following findings: Page 1 of 5 . � �� . The proposed addition will not encroach any further into �the western side yard or the side street yard than what cunently exists. b. The use to the west contains the Minnetonka Arts Center,which is also a conditionally permitted use rather than a residential use, alleviating any negativ� impacts that may-resuit vvith an adjacent residential use. c. Briar Street to the direct east provides for a buffer from the residentially used properties, which is the intent of requiring a 50' setback from all residentially zoned property. d. The addition will meet all other setback, structural coverage and parking standards required within the Zoning Ordinance. The property is not located within the Shoreland Overlay District and is therefore not subject to hardcover restrictions. e. The proposed addition meets all criteria esta.blished under Section 78- 916 and will not be detrimental to the public health, safety or welfare of the community. f. The parking lot will be paved and 16 parking spaces (in addition to required handicap parking) will be striped 8.5' in width. g. The enrollment will be limited to 100 students. Council approval will be required to increase the number of enrolled students over 100. h. A grading and drainage plan will be subrnitted and approved by the City Engineer prior to the issuance of a building permit. 4. The City Council has considered this application including the findings and recommendation of the Planning Commission, reports by City staff, comments by the applicant and the public, and the effect of the proposed variances and conditional use permit on the health, safety and welfare of the community. 5. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants side yard and side street yard setback variances and a conditional use permit per Orono Municipal Zoning Code Section 78-418 (1) to permit construction of an addition with second story extending 45' to the north of the existing building to be located less than 50' from the western side yard and street yard of Briar Street when 50' is normally required, subject to the following conditions: 1. Council approval is based on the site plan submitted by the applicant and annotated by City staff, attached to this Resolution as Exhibit A. Any amendments to the site plan which are not in conformity with City codes will require further Planning Commission and City Council review. 2. A staff issued permit must be obtained for utilization of a temporary trailer during construction. 3. The parking lot shall be paved and 16 spaces (not including the required handicap parking) shall be striped to an 8.5' width. 4. Enrollment level shall not increase above 100 students without City Council review. At such time that an enrollment level exceeding 100 students is requested, the number of required parking spaces will also be reviewed. 5. A grading and drainage plan meeting the City Engineer's approval shall be required prior to building permit issuance. 6. Authorities granted by this resolution run with the property not with the applicant, but are permissive only and must be exercised by obtaining a building permit for new construction within one year of the date of Council approval, or the variances and conditional use permit will expire on that date (April 10, 2007).
