Date: February 28, 2007 Re: Wetland Ordinance - Confirmation of Compliance Remarks: Project Background: The proposed project involves the redevelopment of an existing lot that includes the construction of a new home and associated structures and driveways at 360 North Arm Lane. This project triggers the wetland buffer ordinance as a result of removal of the principal use of more than 50% of the existing homes market value and reconstructed on the same property. The wetland on this property is adjacent to an existing channel that provides access to North Arm Lake. In part due to the property draining ultimately to the channel and North Arm Lake which is a recreational resource the wetland was classified by the watershed district as preserve. Under the City's wetland ordinance this classification requires the widest buffer width, 50 ft, of native vegetation which provides valuable filtering and removal of nutrients from the proposed lawn area and impervious surfaces prior to reaching to the wetland as well as the lake. Wetland Ordinance Compliance Review Currently there is an existing home, driveway, and docks approved under previous permits. Due to the existing docks and current turf grass access to the docks the applicant has provided an alternative layout of the buffer to maintain the dock access and the immediate recreational space adjacent to the docks and is requesting this flexibility on the buffer layout (buffer averaging) based on Section 78-1608 (Buffer Flexibility) of the Wetland Ordinance. In these locations the buffer width is reduced from 50 feet to 15 to 5 feet. The applicant has proposed to shift 5,500 square of the buffer away from the docks for access and expand the buffer directly to the east of the proposed home by 2,500 square feet (additional 20 feet approx.) and directly to the south of the proposed home by 3000 square feet (additional 30 feet approx.) for a total of 5,500 square feet. The relocation of the buffer east of the proposed structure will create a total buffer width of 70 —85 feet and is located in an area that provides additional buffering from the lawn and will serve to expand the habitat of the buffer. The buffer expansion along the south of the property will provide buffer and habitat to an existing wetland located south of this property. The applicant has developed a buffer layout that replaces the lost buffer Bonestroo, Rosene,Anderlik and Associates,Inc. www.bonestroo.com ❑St.Paul Office: ❑Mllwaukee Office: ❑Rochester Oce: ❑Willmar Office: ❑St Cloud Office: 0 Grayslake Office: 2335 West Highway 36 1516 West Mequon Road 112 7`h Street NE 205 5th Street SW 3721 23rtl Street S 888 East Belvidere Road St.Paul,MN 55113 Mequon,WI 53092 Rochester,MN 55906 Willmar,MN 56201 St.Cloud,MN 56301 Grayslake,IL 60030 Phone:651-636-4600 Phone:262-241-4466 Phone:507-282-2100 Phone:320-214-9557 Phone:320-251-4553 Phone:847-548-6774 Fax:651-636-1317 Fax:262-241-4901 Fax:507-282-3100 Fax:320-214-9458 Fax:320-251-8252 Fax:847-548-6979 ... , Bonestroc Mem o o Rosene Anderlik 6 Associate: Enginees 6 ArcMtect square footage and has located the buffer expansion in areas that provide similar benefits and thus meets the requirements of Section 78-1608 (Buffer Flexibility) of the Wetland Ordinance. The Prairie Restoration Buffer landscaping plan provided by the applicant as part of the submittal meets the requirements of the ordinance and should be followed. Wetland Ordinance Compliance Decision with Conditions The proposed plan is in compliance with the ordinance. As allowed under the ordinance it is recommended that the following be required of the applicant. 1. The contractor completing the seeding provide documentation of what was seeded and planted by providing a seed tag or invoice to insure installation is completed per the plan. 2. If the wetland delineation review completed by the watershed districts increases the wetland boundary by more then 5 feet in any area then the buffer will need to be adjusted on the plan accordingly. 3. Silt fence be installed above the buffer. There is one location where the silt fence is currently shown below the buffer. 4. Permanent signage installed along the upslope edge of the buffer prior to construction. The signs should be located no further then 50 feet apart and located to capture the extent of the buffer. Signs will be provided by the City. 5. Provide the City a letter of credit or escrow amount of$3,500. The escrow or letter of credit must be valid for up to two years and will be used by the City to cover the cost to have an ecologist complete follow-up compliance visits to the site and to provide the signage required under item 4.
