A RESOLDTION GRANTING APPROVAL OF
A LOT LINE RFARRANGEMENT OF A PLAT
INVOLVING PROPERTIES LOCATED AT
340 AND 350 NORTH ARM LANE
FILE NO. 1771
WHEREAS, James and Sarah Markoe on September 22, 1992
filed a formal subdivision application with the City for approval
of a residential subdivision of a plat of a lot line
rearrangement of property legally described as Lots 1 and 2,
Block l, North Arm Estates, 2nd Addition (hereinafter "the
property"); and
WH$REAS, after due published and mailed notice in
accordance with Minnesota Statues 462.358 et. seq. and the City
of Orono Zoning and Platting Codes, the Orono Planning Commission
held a public hearing on October 19, 1992 at which time all
persons desiring to be heard concerning this application were
given the opportunity to speak thereon; and
WHSREAS, at their regular meeting held on November 9,
1992 the Orono City Council considered the subdivision
application of Sarah and James Markoe, noting the following
findings of fact:
1. The property is located within the unsewered areas of
the LR-lA Single Family Lakeshore Residential Zoning
District requiring a minimum of 2 acres of contiguous
dry buildable land within each newly created lot.
• 2. The property contains a total of approximately 9+
acres.
3. The proposed plat of a lot line rearrangement will
still provide each lot with 3+ acres of contiguous
lands.
4 . The lot line rearrangment as proposed will bring the
, lakeshore properties into conformance with the required
width at 200' measured in a straight line adjacent to
the navigable channel and at the 75 ' • setback line.

NOW, THEREFORE BE IT RESOLVED, that based upon one or
more of the findings noted above, the City Council of the City of
Orono hereby approves the preliminary plat application of James
and Sarah Markoe per the survey by Mark S. Gronberg dated
December 18, 1989, revised September 24, 1992, subject to the
following conditions:
1. Applicant shall dedicate 8-1/2' of right-of-way for
public road purposes. ,
2. Applicant shall grant conservation and flowage
easements over the drainage swale that intersects both
Lots 1 and 2 , over the designated channel that
intersects the property below the 930 elevation and the
designated wetlands that slightly encroach the northern
boundaries of Lot 1.
3. Septic areas must be staked prior to the issuance of
building permits for new residential construction on
either lot.
FINAL PLAT SUBMITTALS
The fol lowing Iist of final submittals must be submitted to
the Zoning Administrator two weeks prior to the regularly
scheduled Council meeting on the second and fourth Mondays of the
month:
l. RECORD PLAT drawings in the form of two (2 ) mylar
copies and one (1) copy reduced to 1"=200'. Drawing to
include:
A. Lot lines platted per preliminary survey by Mark
S. Gronberg dated December 18, 1989, revised �
September 24, 1992.
B. Dedication of "drainage and utility easements" 10'
, wide along all perimeter property lines and 5'
each side of internal property lines - this may be
omitted along the east boundary where the City
will obtain drainage easements for channel.
Designate and dedicate drainage easements over the
following:

1 ) Drainage swale to be designated at a 30'
minimum width .
2 ) Drainage easements to be taken over channe 1
to commence at the 930 elevation or top of
the bank of the channel along the northeast
and east side of plat and to continue to the
top of the east bank if located within
property.
3 ) Drainage easements over designated wetland
areas that intersect northern boundaries of
Lot 1.
4 ) Dedicate 8-1/2' of right-of-way for North Arm
Lane.
2. LEGAL DOCUMENTS required:
A. Title opinion addressed to the City. All owners.
mortgage holders or others with property interest
indicated therein shall sign the plat and all
other documents affected by such interest.
B. The applicant must provide certified copies of al 1
recorded easements currently affecting the
property.
C. Signed and executed Flowage & Conservation
Easement over all drainage easement areas as
specified above. (See boiler plate attached)
D. Covenants in a form suitable for filing defining
location of septic areas to ensure protection
prior to development and after development as this
wil 1 be only suitable area for septic development
for residential use. Septic areas must be staked
prior to issuance of building permits.
