Dear Mr. Olson:
The Building & Zoning Department is in receipt of your
application for a building permit, which was received by this
office on February 4, 1991. A review of the application finds
that the proposed improvement will require variances to Section
10.03, Subdivision 9(C)3. The improved structure now at 1,260
s.f. is located in front of the front line of the principal
structure and that structure will be less than the required 30'
from the side setback line. The closest corner of structure is
located at 24' from the side lot line.
Staff has been in contact with your building contractor,
Jeff Cates. It is my understanding that Mr. Cates will pickup
the necessary variance application information, and that you will
be able to file the variance application by the deadline of
February 22, 1991 (Friday, prior to 12:00 noon). The public
hearing before the Planning Commission will be scheduled for
Monday, March 18, 1991. I have enclosed the property owners list
used for your former conditional use permit application and may
be used for the current application. The fee for the variance ,
application will be $175.00 .

concerning the matters discussed above.

3. Any Oversize Accessory Structure shall be
subject to the following conditions :
V a) No such accessory structure shall
be located within a required yard area (principal structure
setbacks must be met). Further, no such structure shall be nearer
the front lot line than the front line of the principal residence
on the property, and no such accessory structure shall be located
less than 30' from the side or rear lot Iine regardless whether
less strict principal structure setbacks apply.
� b ) The maximum height for such
accessory structure shall be 30' or the defined height of the
princiFal residence structure on the property, whichever is less.
c) Such structure sha 11 be a 1 Iowed
only when the property owner agrees and covenants in writing with
the City as follows: '
i. No future subdivision will
be aFproved that Flaces the structure within a Iot that has no
principal structure, except that the City in its subdivision
approval may grant a finite time period in which the oversized
accessory structure may remain without a principal structure, in
order that a principal structure may be constructed. At the end of
this time period the oversized accessory structure must be removed
if no principal structure has been constructed.
