As discussed in our phone conversation today, adding onto the existing detached garage to create a"guest house" would not meet the City's minimum lot area requirement. A guest house requires double the minimum lot area required in a zoning district. Since your property is located within the LR-lA zoning district, a minimum lot area of 2 acres is required. Therefore, a guest house would require a lot area of 4 acres ��•hereas your property is approximately 2.488 acres in area. However, instead of adding onto the detached garage, an addition onto your principal structure with a non-rental guest apartment is a permitted conditional use within the zoning district. Any addition onto your principal structure would be required to meet the following requirements: Front Yard Setback (from North Arm Drive) 50' Rear Yard Setback 50' Side Yard Setback (from property to the west) 30' Side Yard Street Setback (from North Arm Lane) 50' From other structures on the property 10' From septic systems 20' From wells 3' From wetlands 2G' Height of structure 30' or 2 '/z stories A non-rental guest apartment is for use of the occupants of the principal residence, including domestic employees or non-paying guests. The guest apartment can not have utilities that are separately metered from the principal residence utilities or a separate street address. A non-rental guest apartment requires a Conditional Use Permit(CUP) from the City. The application must address parking, sewage treatment,entryway to the guest apartment and the method of interior access. CUPs require Planning Commission and City Council review. Attached is a CUP application, including application deadline dates, for your information. If you choose to add onto the principal structure with additional living space instead of a . non-rental guest apartment and the plan is able to meet the required setbacks, sewage treatment requirements, etc. only a building permit will be required. Please note that the addition of a separate'/4 bathroom or full bathroom, kitchen area and bedroom may constitute an apartment.
