A RESOLUTION APPROVING TIiE
PLAT OF NORTH ARM OVERLOOK
FILE NO. 2372
WHEREAS,the City of Orono is a municipal corporation organized and existing
under the laws of the State of Minnesota; and
WHEREAS, the City Council of the City of Orono has adopted subdivision
regulations for the orderly,economic and safe development of land within the City; and
WHEREAS,the City Council has considered the application for a subdivision of a
two-lot plat by Barry and Janiece Haglund(hereinafter"the subdividers"); and
WHEREAS, the subdivision has been found to meet all standazds of the LR-lA,
Single Family Lakeshore Residential Zoning District finding that each lot is of a size and
configuration that would allow its use for a single family residence to be fully developed without
the need of any variances; and
WHEREAS,the subdivider has completed or has agreed to complete all requirements
of the platting regulations of the City, including:
1. Completion of all the requirements of Resolutian No. 4096,the resolution granting '
preliminary approval of the Class III subdivision.
2. Dedication on the plat of standard perimeter drainage and utility easements.
3. Provision of drainage calculations for pre-and post-development stormwater quantity
and quality conditions, and design of stormwater and drainage improvements and
facilities.
4. Designation and dedication of drainage easements over the stormwater pond within
the plat.

5. Provision of evidence of stormwater management plan approval from the Minnehaha
Creek Watershed District.
6. Dedication to the City of public roadway for North Arm Lane and North Arm Drive
West.
7. Granting of a partial temporary cul-de-sac easement over the northeasterly portion
of Lot 1.
8. Creation of covenants for Lot 1 for protection of drainfield sites, including protective
langua.ge for alternate septic sites along with site plans locating both primary and
altemative sites, and alerting future property owners of the need to protect sites on
adjacent properties.
9. Execution of a Subdivider's Agreement providing for the installation of drainage and
stormwater facilities required as a condition of subdivision approval, and posting of
security to ensure that these required improvements aze completed to the City's
satisfaction, the design of said improvements subject to approval of the City
Engineer.
10. Payment to the City for the final plat review fee and fee for legal review and filing
of the plat, easements and covenants in the amount of$400.00.
NOW, THEREFORE,BE IT RESOLVED, that the City Council of the City of Orono
hereby approves the plat of North Arm Overlook, Hennepin County, Minnesota, subject to the
following conditions:
1. Prior to release of the plat for filing, applicant shall provide to the City evidence of
an access easement in favor of applicant's properry over the 33' privately owned
comdor adjacent to the east side of the properiy;except that at such time that a road
and utility easement over(or fee title to)the 33'corridor is obtained by the City,this
condition shall become null and void.

2. Lot 2 shall continue to access to North Arm Drive West via the existing private
driveway. Lot 1 shall directly access North Arm Lane via a private driveway as
shown on the preliminary plat drawings.
3. All identified primary and altemate sewage system drainfield sites within Lot 1 shall
be fenced off prior to any land alterations, and such fencing shall remain in place
until such time that Lot 1 is developed.
4. Payment of Park Dedication Fee for Lot 1 in the amount of$4,900.
5. Subdivider shall construct stormwater management improvements generally as
shown on the Preliminary Plat Drawing dated Apri122, 1998,revised June 17, 1998
subject to any revisions of said plan as may be required by the City Engineer.
Erosion control shall be maintained over all disturbed areas until natural groundcover
is restored, adhering to guidelines found in 'Best Management Practices for
Protecting Water Quality in Urban Areas'.
6. The stormwater improvements shall be constructed to City requirements, subject to
a Developers Agreement executed between the City and the developer. Drainage and
stormwater improvement construction can begin as soon as the fmal plans have been
formally approved by the City Engineer and the Developers Agreement has been
executed.
7. No building permit will be issued for Lot 1 until the stormwater management
improvements have been completed by the developer and approved by the City.
8. Prior to City release of the plat for filing, applicant shall provide evidence of fee
ownership of the property in a form acceptable to the City Attomey, and applicant
shall meet any other title requirements as may be required by the City Attomey.
9. Applicant shall provide all documents noted in this resolution in a format
acceptable to the City Attorney prior to release of the plat for filing, and shall
complete all conditions to the satisfaction of City staff,prior to release of the plat for
filing. .

10. The aforesaid plat shall be filed by the City of Orono with either the Hennepin
County Recorder's Office or Registrar of Titles Office on or before December 28,
, 1999 together with a certified original copy of this resolution and executed copies of
the easements, deeds and covenants noted above. .
The approval granted by this resolution shall expire if the plat has not been filed by the date
specified abave. In that event,it will be necessary to file a new application with the City of Orono
for subdivision review. Dated this 28th day of June, 1999.
