RE: 1560 NORTH ARM DRIVE-ZONING COMPLIANCE REVIEW
Dear Mr. Mckenzine:
The property located at 1560 North Arm Drive in the City of Orono is located in the LR-1B zoning
district. The LR-1B zoning district is a single family lakeshore residential district requiring a
minimum lot size of 1 acre and a minimum lot width of 140'. Records available to the City of Orono
indicate the property was developed in 1920,long before the current zoning standards were adopted.
The property has a total lot area of approximately 7,440 s.f. and a lot width of 50'.
Because the property was developed prior to the adoption of the current standards, and the use is
residential,the existing structure(s)on the property are considered legal non-conforming. The City
would permit general cosmetic changes(ie.reroof,new siding,window replacement)to the house.
However, no change or expansion to the building envelope of the house, or replaceinent of the
structure is permitted without the City of Orono approval. The process currently available to the
property owner would be to apply for variances to the lot area and lot width standards. Variances
to permit replacement or expansion of the structure can only be approved by the City Council after
� a public hearing with the Planning Commission.
The City of Orono would include consideration of the following issues while reviewing a variance
request:
. The property has been developed as a residential site and used for residential purposes since
about 1920.
. The property is consistent with other lots in the locality.
. Can the lot sustain the type of development proposed?
. The property has been provided sanitary sewer service.

This letter is not an indication of future variance approval or denial,but rather an indication of the
process available to individual properties that are non-conforming. The City of Orono has reviewed
many cases where houses have been removed by the property owner or removed by an"act of god"
and have used the variance process to permit redevelopment.
