GRANTING A VARIANCE TO
MUNICIPAL ZONING CODE
SECTION 78-330

WHEREAS, Margaret Peltola, a single person (hereinafter "the Applicant") is the
owner of the property located at 1550 North Arm Drive within the City of Orono (hereinafter
the "City") and legally described as follows:
Lots 15 and 16, Hickory Hill, Hennepin County, Minnesota (hereinafter the
"Property"); and
WHEREAS, the Applicant has made application to the City of Orono for an after-
the-fact variance to Orono Municipal Zoning Code Section 78-330 to allow construction of
additions to the existing home, consisting of an enclosed entryway and covered porch, both
located within the required front yard where no structure is normally allowed; and
WHEREAS, after due published notice and mailed notice in accordance with
Minnesota Statutes and the Orono, Minnesota, City Code,the Orono Planning Commission held
a public hearing on April 16, 2012 at which times all persons desiring to be heard concerning
this application were given the opportunity to speak thereon.
NOW,THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota:
FINDINGS
1. This application was reviewed as Zoning File 12-3549.
2. The property is Iocated in the LR-1B One Family Lakeshore Residential Zoning
District which requires a minimum lot area of 1.0 acre and a minimum lot width
of 140'.
3. The Planning Commission reviewed this application at a public hearing held on
April 16, 2012 and on a vote of 5-0 recommended approval of the requested

variances, and additionally recommended that the appiicant be granted a
variance to allow construction of a ramp leading from the covered porch to
ground level to accommodate applicant's anticipated pending need for handicap
access to the residence.
4. The City Council reviewed the application at their May 14, 2012 meeting and
reviewed the request in light of the following findings:
a. The property contains 15,035 square feet in area and has a lot width of 100.5
feet. The existing property is conforming with respect to lot coverage and
hardcover.
b. The proposed enclosed entryway as partially constructed will be located 34.4
feet from the front property line and the proposed covered porch as partially
' constructed is 28.4 feet from the front property line, where a setback of 35
feet from the front property (ine is normally required.
c. The P{anning Commission recommended that to accommodate the
appiicant's future needs without the need for an additional variance request
in the future, a variance should be granted at this time to allow a handicap
ramp to be constructed, extending southward from the covered porch, and
that the applicant be strongly advised to construct that ramp at this time.
d. The Property is within the 250-500' hardcover zone where 30% hardcover is
allowed. Existing hardcover on the property incfuding the partially
constructed entryway and porch is 23.8%, well below the 30% limit, and will
remain at a conforming level of approximately 24.5% after construction of
the ramp.
e. The addition of an enclosed entryway and covered porch are reasonable uses
of this residential property when accomplished in a conforming manner. The
home already existed when the current zoning district setback standards
were adopted. The location of the existing home is unique to the property
and not caused by the tandowner.

f. With the enclosed entryway door facing the street, an entry porch or stoop
encroaching into the setback is necessary for reasonable access due to the
height of the main floor. If the entry door was relocated to the side of the
enclosed entryway, a stoop could likely be constructed that would not
require a variance. Covering that side-entry stoop would impact views from
the front windows and would reduce light into those windows. Applicant
noted that the interior of the enclosed entryway is too small to allow for
large furniture, etc. to make the turn so that a straight-through configuration
was constructed; that a south-facing door and porch would conflict with
existing utilities; and that the covered porch is intended to protect vis�itors
from the rain, etc. as the house has minimal overhangs.
g. The conditions applying to this property are somewhat unique in that
existing structures on adjacent properties are not uniformly set back from
the road. The adjacent home to the north has a detached garage located in
the front yard approximately 25' from its front lot line; the applicant's
entryway and covered porch will extend no closer to the road than that
neighboring garage. The residence to the immediate south is located
approximately 34 feet from the street lot line. Applicant's house sits 4-6'
above the street and the entryway and porch will be somewhat screened
from public view by existing vegetation. Given these unique characteristics,
the proposed additions will be in keeping with the character of the
neighborhood.
h. The App(icant's request is in harmony with the purpose and intent of the
ordinance.

i. The Applicant has demonstrated that enforcing the front setback provision of
the Zoning Ordinance would deprive the Applicant of the reasonable use of
their property.
5. The City Council has considered this-application induding the findings and
recommendation of the Planning Commission, reports by City staff, comments
by the appiicant and the public, and the efFect of the proposed variance on the
health, safety and welfare of the community.

6. The City Council finds that the conditions existing on this property are peculiar to
it and do not apply generally to other property in this zoning district; that
granting the variance would not adversely affect traffic conditions, light, air nor
pose a fire hazard or other danger to neighboring property; would not merely
� serve as a convenience to the Applicant, but is necessary to alleviate a practical
difficulty; is necessary to preserve a substantial property right of the Applicant;
and would be in keeping with the spirit and intent of the Zoning Code and
Comprehensive Plan of the City.
CONCLUSlONS, ORDER AND CONDITIONS
Based upon one or more of the above findings, the Orono City Council hereby grants a
variance to Orono Municipal Zoning Code Section 78-330 to allow construction of additions to
the existing home, consisting of an enclosed entryway and covered porch, both located within
the required front yard where no structure is normally allowed, as well as a handicap ramp
extending southward from the covered porch, subject to the following conditions:
1. Council approval is based on the survey/site plan dated March 1, 2012 and building
plans submitted by the Applicant and annotated by City staff, attached to this
Resolution as Exhibits A & B. Any amendments to the site plan which are not in
conformity with City codes will require further Planning Commission and City Council
review.
2. App(icant shall obtain an after-the-fact building permit for the construction prior to re-
commencing work on the structure.
3. The existing construction shall be reviewed by the Orono Inspections Department and
any elements not meeting code requirements shall be brought to code. The handicap
ramp approved by this variance shall meet all pertinent standards subject to plan review
and approval by the inspections Department.
4. Authorities granted by this resolution run with the propertjr not with the Appficant, but
are permissive only and must be exercised by obtaining a building permit for the new
construction and commencing construction of said project. A framing inspection must
be completed within one year of the date of Council approval, or the variance will expire
on that date (May 14, 2013).

5. Violation of or non-compliance with any of the terms and conditions of this resolution
shall constitute a violation of the zoning code, shall automatically terminate any
authority granted herein, and shall be punishable as a misdemeanor.
6. The undersigned Applicant has read, understands and hereby agrees to the terms of this
resolution and on behalf of the Applicant and the Applicant's heirs, successors and
