As you are aware, your permit #2013-01036 for 1376 North Arm Drive was issued yesterday. Our permitting software
was recently updated and we have discovered an apparent glitch in the permit card format. The standard informational
disclaimer wording printed on each permit regarding Temporary Certificates of Occupancy (TCO) is cut off... I want to
make sure you are aware of the TCO escrow requirement of $10,000. This is what was apparently cut off of the
disclaimer.
Please be aware, the informational disclaimer on the permit card should read:
Separate Permits Required: Plumbing, Mechanical, Septic, Fireplace, Electrical (State)
NOTE: Prior to the start of framing an As-Built Foundation Survey must be submitted and approved by city
or a stop work order will be issued. Initial:
NOTE: For any retaining walls 4 feet or higher or not meeting the required separation submittal of wall
plans signed by a registered professional engineer will be required prior to the release of the escrow.

Nennepin County Minr�esota, is the subject of buifding permit appficatian number 2Q13-
01306 has been completed,
2. Winter conditions currentEy prpnibit Campletion of exteriQr imprvvements, finaE gfading,
and vegetation establishment. An as-built survey cannot be accurately conducted at this
time.
3. Owners requsst the City issue a Eemporary certifica;e of accupancy ("TCO") to the
Owners so that the Owners may occupy the new res+dance.
4. The City wi11 issue a TCO only if the Qwners establish an escraw to ensure completion of
exterior improvemenfs, confinu�tian of erosion contral and submittal of an as-built sur✓ey
to the City.
NOW THEREFORE,TH� PAR7IES AGREE AS F�LLOWS;
1. DEPOSIT O� ESCROW �UNDS. Contemporanea�sly with the executi�n of fhis Escrow
Agreement, the Owners shall depasif $10,aQ0 with the City. A!I accrued interest, if any, shall be paid to
tne City to reimburse tfie Gity for its cost in administering the escrow account.
2. PURPOSE UF E3CR�W. The purpose of the sscrow is to assure ;ompletion of any
ex#erior improvemenfs, Pinal grading, establishmeni of vegetation as weli as guarantee reimbursement to
the City far al1 out-of-pocket costs the City has incurred (including planning, engineering, in axcess of
$500, or legal consulfartt revietiv) or wiil incur in reviewing the plan. Eligible expenses shall be consistent
with expenses the Owners wou!d be responsiele for under a buildirg permit appiication. The escrow wifl
aisa guarantee reimbursement to the City for all out-af-packet cos:s the City has incurred to assure that
the work is compiated in accordance with the Stormwater Pollution Prev�ntian Plan and the pro�isions of
Or�no City Code Chapter 79. The financiaE security ma� also be used by t�e Ci:y ta etiminate any
hazardous conditions associated with the wa;lc and io repair any dar-�age to pu�lic pro�erty ar
infrastructure that is caused by Ehe work (including planning, engineering, or legai consultant review)

3. MONTHLY BILLING. As the City receives consuftan#bills for incurred costs, the City wil[
in turn send a biil to Fhe Gwners. Owners shail be respo�sible fo�payment to ihe City wifhin 30 days ofi
the C3wners'recefpt of bill.

payment to the City within the timeframe outlined ir #3 above, shall issue a 51�p Work Order until the O�vners

5. ClOSING E5CROW. 7he Balance on daposit in the escrow, i€any, shall be retumed ta
the Owners when the review has been completed and written nofification is received f�om the Owners

6. GERTIFY UNPAID CFIARGES. lf the project is abandoned by Owner�, or if the eligib�e
expenses iRcurred by the City exceed the amount in escrow, the City shall have the right to certify ihe
unpaid balance to#he subject property pursuant to Minn. Sfat. §§Q15.01 and 366.092.
7. ACCESS TO SE1B.7£CT PROPERTY. The Owners hereby grant to the City, its agents,
employees, officers and contracfars, the right to enter upon the subject praperty for the specific �urpose
of inspecfin� and compfeting any sxterior improvements, final grading, establishrnent of vegetation and
the restoration of the subject property should the Owners Rat complete the work by tha specified dates.

AGREEMENT AND SWORN STATEMENT
The work for which this permit is issued shall be performed according to
the approved plans and specifications,applicable City approvals,and the
State Building Code. This permit is for only the work described and does
not grant permission for additional or related work which requires separate
permits. All provisions of laws and ordinances goveming this type of work
shall be compied with whether or not specified herein.This permit will
expire and become null and void if construction authorized is not
commenced within 180 days of the date of issuance,or if construction is
suspended for a period of]80 days at any time after work has commenced.
The applicant is responsible for assuring all required inspections are
requested in conformance with the State Building Code.This permit may be
revoked at any time for due cause.

BUILDING PERMIT ESCROW AGREEMENT

AGREEMENT made this �� day of '�i�1 20� , by and between the CITY OF ORONO,
a Minnesota municipal corporation ("City") 11.o, 'd.L.�,r,3.Er�c sti�' ("Owners").
Recitals
1. A building permit application has been filed for a new single family home located at 1376 North
Arm Drive, the ("Subject Property"), legally described as Lots 15 & 16, Block 8, Saga Hill Revised, Hennepin
County Minnesota.
2. Owners request the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit$2,500 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal
consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the
Owners would be responsible for under a building permit application. The escrow will also guarantee
reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in
accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may also be used by the City to eliminate any hazardous conditions associated with the
work and to repair any damage to public property or infrastructure that is caused by the work (including planning,
engineering, or legal consultant review) associated with building permit #2013-01306 if compliance with the
approved building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in#3 above, shall issue a Stop Woric Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when the review has been completed and written notification is received from the Owners requesting the
funds.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amou in escrow, the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn. St t.§§415.01 and 366.012.
