ENCROAC�IlVIENT AGREEMENT
AGREEMENT made this �J'� day of a�..n.��� ,2014,by and between the
CITY OF ORONO,a Minnesota municipal corporation("City"), and DANIEL J. ASHFELD and
ERICA L. ASHFELD,husband and wife(collectively"Ashfeld"or"Owner").
1. BACKGROUND. Ashfeld is the fee owner of certain real property located in the
City of Orono, County of Hennepin, State of Minnesota,legally described as follows:
Parcel ID No. 07-117-23-41-0052
Lots 15 and 16, Block 8, SAGA HILL REVISED, according to the recorded plat
thereof on file and of record in the office of the Registrar of Deeds,in and for
Hennepin County,Minnesota
(Abstract Properry)
having a street address of 1376 North Arm Drive, Orono,Minnesota("Subject Property"). The City
owns easements for drainage and utility purposes over portions of the Subject Property. The Owner
has constructed a private driveway on the Subject Property which encroaches on the City's
easement areas as depicted on the attached survey sketch.

2. ENCROAC�IlVIENT AUTHORIZATION. The City hereby approves the
encroachment of the existing driveway upon its easement areas on the Subject Property,subject to
the conditions set forth in this Agreement. .
3. MAINTENANCE AND REPAIR OF DRIVEWAY. The Owner shall be solely
responsible for a11 costs relating to the maintenance and repair of the driveway,including any
damage to the driveway caused in whole or in part by the Owner's use,maintenance,and repair of
the driveway. This maintenance agreement is an obligation of the Owner and shall be binding upon
the executors,administrators, successors and assigns of Owner.
4. HOLD HARMLESS AND INDEM1vITY. In consideration of being allowed to
encroach in the City's easement areas,Owner,for himself,his heirs and assigns,hereby agrees to
indemnify and hold the City harmless from a11 costs and expenses,claims and liability,including
attorney's fees,relating to or arising out of this grant to the Owner of pernussion for the existing
driveway on the Subject Property. The Owner further agrees to indemnify and hold the City
harmless from any damage caused to the Subject Property,including the driveway in the City's
easement area,caused in whole or in part by the encroachment and use of the Subject Properiy
5. TERMINATION OF AGREEMENT. The City may,at its sole discretion,
terminate this Agreement at any time by giving the then owner of the Subject Property thirty(30)
days advance written notice, except that no notice period will be required in the case of an
emergency condition as determined solely by the City and the Agreement may then be
terminated immediately. Following notice,the Owner shall remove the portion of the driveway
from the easement area,at Owner's sole expense. If the owner fails to remove the driveway as
provided in this paragraph,then the City may remove the driveway and charge the cost of removal
to the owner for reimbursement or have it assessed against the Subject Property.

6. RECORDING. This Agreement shall run with the land and shall be recorded
against the title to the Subject Property.
