RE: Driveway Construction
Dear Mr. Sarenpa,
It has come to the attention of this department that you have recently constructed an extra
driveway on your property to access the county road. As you are aware, permits are required for
creating a driveway. The City requires a Land Alteration Permit. The Hennepin County Public
Works requires a permit to create an access to their road, and the Minnehaha Creek Watershed
District requires an Erosion Control Permit and possibly a Wetland Delineation.
This letter is to require you to submit a Land Alteration Permit application with a survey or site
plan showing the location of the driveway, the approximate amount of fill used and a cross
section of the driveway. Permits from the Minnehaha Creek Watershed District and Hennepin
County will be required prior to issuance of the Land Alteration Permit. A deadline of October
14, 2002 has been established for submittals. If this deadline is not met The City will initiate
legal action and a court appearance will be required. If you have any questions, feel free to

Dear Mr. Sarenpa,
This is response to your voice mail of October 2, 2002. Due to the fact that we discussed the
permit requirements and possible problems of creating a driveway and you decided to build it
without approvals anyway, I find it difficult to grant you an extension of time to deal with it. I
don't need to check the code to know that a permit is required for the work that was done. If it
was just putting red rock on your property a permit would still be required. See the attached
code section 10.03 Sub. 19, 20, and 21. You stated that you haven't asked for it to be a driveway
yet. If you build a driveway, it's a driveway if you ask for it to be or not. If you request in
writing the city will consider an extension of the deadline.

Re: Unauthorized Driveway onto CSAH 151, North Arm Drive, City of Orono
Marty:
As we discussed during our on-site meeting on Tuesday, November 5, 2002, the above-noted access to
County State Aid Highway(CSAH) 151 was constructed without a valid permit, and does not meet
NerLnenin Cour_ty's sight-distance (visibility) minimum of 300 feet to the enter?ng driver's right (south).
Any new or revised access to a county road must have a permit so such things as visibility and drainage
among others, can be evaluated. Therefore, the driveway must be obliterated and restored with seed or
sod (within the road right of way) by December l, 2002.
Apparently, the current access to yours and other's properties is via an unimproved city street right of way
(Westpoint Avenue), not an easement. If any subdivision of the property(s) were proposed, all access
would have to be taken from an improved city street with appropriate ditch/slope grading to enhance
sight-distance.
However, the existing situation can best addressed by constructing a new "temparary" shared driveway
roughly centered along your property frontage where visibility is more than adequate in both directions.
If you wish to pursue this option, please fill out the enclosed permit application and submit it along with
the appropriate easement documentation for other users and the permit would be approved subject to the
elimination of formal access at the current Westpoint Avenue entrance. The City of Orono has been
contacted and concurs with this possibility.
Otherwise the existing entrance may remain "as is" unless further development is anticipated.
