This type of storage is in violation of Orono Municipal code Section 10.60 Subdivision 13. Therefore the City must require you to store the equipment inside a building or to remove it from the site.A deadline of 11-13-00 has been established.If this deadline is not met the City will initiate legal action. Z.Vibration.Any use creating periodic earth-shaking vibrations, such as may be created from a drop forge shall be prohibited if such vibrations aze perceptible beyond the lot line of the site on which the use is located.The standazd shall not apply to vibrations created during the process of construction. Subd. 8. Glare or Heat.Any use requiring an operation producing an intense heat or light transmission shall be performed with the necessary shielding to prevent such heat or light from being detectable at the lot line of the site on which the use is located. Lighting in all instances shall be diffused or directed away from "R" Districfs and public streets. Subd. 9. Explosives. Any use requiring the storage,utilization or manufacturing of products which could decompose by detonation shall be located not less than 400 feet from any "R" Drstrict line. � Subd. 10. Screening Required. Screening shall be required in residential zones where: A. Any off-street parking area which contains more than four pazking spaces and is within 30 feet of an adjoining residential lot line, and, B. �Vhere the driveway to a parking azea of more than six pazking spaces is ��-ithin 15 feet of an adjoining residential lot line. Subd.,l l. Screening,Type of. The screening required herein shall consist of a solid fence or�vall at least 50%open,not less than four feet nor more than five feet in height but shall not extend within 15 feet of any street or driveway opening onto a street. The screening shall be placed along the property lines or in case of screening along a street, 15 fe�t from the street right-of-way «ith landscaping(trees, shrubs, grass and other planting)between the screening and the pavement. A louvered fence shall be considered solid if it blocks direct vision. Planting of a type approved by the Planning Commission may also be required in addition to,or in lieu of, fencing. Subd. 12. Maintenance. In all districts, all structures, required landscaping and fences shall be maintained so as not to be unsightly or present harmful health or safety conditions. Subd. 13. Exterior Storage in"R" Districts. In all "R" Districts, all mobile materials and equipment shall be stored within a building or fully screened so as not to be visible from adjoinin� properties,except boats and unoccupied trailers less than 20 feet in length, which aze not stored for commercial purposes, if stored to the rear of the house and a distance of 10 feet or more from any property line. I am aware of your long standing dispute with your neighbor however this is a legitimate complaint. I don't think you will find too many yards in Orono with construction equipment stored in them.Over the years I have been with Orono the city has enforced its ordinances on many properties and required removal of construction equipment. Your retaliation has now caused complaints from other property owners.The orange snow fence and the painted rocks are not in violation of city code but serve no purpose but to demonstrate your spite. There is still some machinery that is in violation of Orono City Code section 78-1577 (attached).The trailer is allowed to be stored in the rear yard 5"from property lines.The skid steer attachments must be removed or stored in a legally constructed building. A dead line of September 22, 2014 has been established to bring your property into compliance. If this dead line is not met the city will refer the matter to the city attorney for legal action. I have received additional complaints regarding exterior storage on your property. I had hoped this matter had been resolved the last time we spoke. As previously discussed the trailer located on the property is allowed provided it meets the requirements of the ordinance. The bobcat and other equipment currently screened is not allowed by ordinance nor are the pallets on the property. I have enclosed the section of the City of Orono Zoning Ordinance that pertains to this letter. Please see that the property meets the intent of the ordinance by November 1, 2005.
