THIS INDENTIIR$, made this �rd day of Mav , 1989, by and
between Einar G. Hagberg and Florence A. Hagberq , hereinafter referred
to as "Grantor(s )", and the City of Orono, a municipal cor�oration, under
the laws of the State of Minnesota, hereinafter referred to as "Grantee".
WITNSSSETH, that Grantor(s ) , in consideration of the sum of One
Dollar ( $1.00 ) and for other good and valuable consideration given by
Grantee, the receipt of which is acknowledged by Grantor(s), do(es) hereby
grant, bargain, sell and convey to grantee, its successors and assigns, a
perpetual easement for construction and maintenance of sanitary sewers,
together with ingress, egress and access thereto, on, across and under the
land in the County of Hennepin and State of Minnesota, as follows:
The following described property within the boundaries of Lot 4,
Auditor' s Subdivision No. 362 :
A permanent easement for sanitary sewer purposes 10 feet on each
side of the following described line. �
:
Beginning at the northwest corner of Lot 4 ; thence 249 feet
northeasterly to a point 7 feet southeast of the northwest line;
thence southeasterly to a point on the southeast line 310.3 feet
easterly of the southwest corner and there terminating;
including, but not by way of limitatien, a full and free right and
authority to enter upon said land to construct, install, maintain, oFerate,
and reFair a sanitary sewer interceptor, lift station, main or line, a
_ water main or line, and the Grantee shall have the right to make use of
' said land as is reasonably necessary and advisable to the construction
� installation, maintenance, operation and repair of the Improvement.
� In addition to any other remedy the Grantee may have, the
covenants and restrictions contained herein may be enforced by injunction.
TO HAVE AND TO HOLD said easement unto said Grantee, its
successors and assigns, �ermanently.
The Grantor(s) herein certify that the lands herein described are
free and clear of all encumbrances except:
