The Minnesota Pollution Control Agency (MPCA) staff has reviewed the Excavation Report dated September 5, 1990, and has determined that the cleanup performed in response to the petroleum tank release at the site referenced above has adequately addressed the petroleum contamination, and therefore, the file regarding this release will be closed. On October 17, 1990, a petroleum tank release was reported to the MPCA. Mr. Leech has taken the following corrective action in response to the release: l. Mr. Leech retained Maloney Construction, Inc. to remove a 1000 gallon fuel oil underground storage tank. 2. Ground water was not encountered during the excavation. 3. Dtiring tank excavation, soils were scanned for the presence of organic vapors. Eleven cubic yards of soils showing elevated levels of organic vapors were excavated and stockpiled on site. 4. A chemical analysis done on a soil sample of the excavated soils found 21 parts per million total hydocarbons. The 11 cubic yards of soil was , incorporated into cement and used on a driveway in Wright County after receiving approval from the MPCA on November 16, 1990. 5. No organic vapors or staining were detected on the sidewalls or base of the excavation after the soil was removed. Two soil samples were collected from the tank basin for applicable chemical analyses. No contaminants were detected. Therefore, MPCA staff does not intend to require any more investigation or cleanup work in response to this release. However, the MPCA reserves the right to reopen this file and require additional work if in the future more work is determined to be necessary, and this letter does not release any party from liability for this contamination. Because you performed the requested work, the state may reimburse you for a major portion of your costs. The Petroleum Tank Release Cleanup Act establishes a fund which in certain circumstances provides partial reimbursement for petroleum tank release cleanup costs. This fund is administered by the Petroleum Tank Release Compensation Board (Petro Board). More specific eligibility rules are available from the Petro Board (612/297-4017). We have the following comments in regards to engineering matters. • The proposed swales along the east and west sides of the home approach grades of 25%. This will be an erosion problem. Typical grass swales should be constructed at grades between 2% and �% to convey water without ecosion concerns. The proposed swales should be constructed utilizing methods to control erosi�n (check dams, erosion mat, etc.). • The swales adjacent to the existing portio�l of the home will be 3' to 5' feet wide without encroachind onto � the neighbor's property. It may be necessary to acquire tempocary easements to construct the swales as sho�vn. • Tl�e plans should identify the �lraintile discharge location shown nt the noi-theast corner of the existing home. • The erosion and sediment control measures should be in place, inspected ancl approved by the city prior to any grading or construction activities. Applicant shall work with the Orono building staff to make any necessary grade changes to provide positive drainage in conjunction with installation of new foundation of garage and paving improvements in street yard. 2. Authorities granted by this variance run with the property not with the applicant, but are permissive only and must be exercised by application for a building permit within one year of the date of Council approval, or this variance will expire on that date (October 11, 1994). . 2. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically ' terminate any authority granted herein, and shall be punishable as a misdemeanor. 3.
