I drove by the Baileys' property today on my way to a different inspection. I did not realize work had begun on site. We
have not issued the administrative permit for the earthwork. I spoke with John a couple weeks ago regarding tree
removals that would be part of the project and gave him the go-ahead on the tree removals, as I understood they
needed to be removed prior to your work.
The City Council only approved a conditional use permit for the proposed plans however the City also requires an
administrative Zoning Permit to authorize the work. I do not know if you have a permit from the Minnehaha Creek
Watershed District for any work other than the rip rap permit issued on June 7tn
Please submit the application with a full set of plans at your earliest convenience; call me with any questions.

Dear Mr. Bailey:
We have been informed by the Minnehaha Creek Watershed District that you intend to install riprap on the
property at 2807 Casco Point Road in Orono, MN. Because riprap is often part of a larger project, we want to
alert you to some related City code provisions so you can avoid the hassle and expense of obtaining an after-the-
fact permit or even having to undo some of the work.
With few exceptions, including riprap and lakeshore steps, City code prohibits the installation of impervious
surtaces within 75 feet of the lake. Any sort of fabric is considered impenrious. This means that riprap rock may
be extended farther than allowed by the riprap permit but no fabric may be installed under it.
The following activities require a permit from the City:
• Any earth movement outside the area where the rip rap will be placed
• Replacement of retaining walls and/or installation of new retaining walls within 75 feet of the lake (regardless of the
height of the walls)
• Construction or replacement of lakeshore steps
• Removal of trees(dead or alive)six inches in diameter or larger within 75 feet of the lake
• Removat of vegetation on any slope within 75 feet of the lake that is too steep to easily walk
• Removal of vegetation or trimming of trees larger than six feet to provide a view of the lake from the house
• Total or near total removal of vegetation within 75 feet of the lake not part of another permit
A tree removal permit can be arranged by calling 952-249-4600. For the other permits your contractor must
submit a permit application and plans for review. Additional information can be found at the City website,

This permit is not transferable without District approval, and is valid to the date of
expiration. No activity is authorized beyond the expiration date. If the permittee
requires more time to cornplete the project, an application for renewal of the
permit must be received by the District at least 30 days before expiration.
The applicant is responsible for compliance with all District Rules and for the
action of their representatives, contractors, and employees.
Stipulations: Project to be completed as described in plans submitted to the
MCWD office on May 30t'', 2017 according to the provisions of this
permit.

Inspection/Analvsis/Monitorinq Fees
A site inspection and monitoring by District staff will be performed where the
activity involves:
• a commercial/industrial/multi-family residential development
• a single family residential development greater than 5 acres or of any size if
within the Minnehaha Creek subwatershed
• any alteration of a floodplain or wetland
• dredging wi#hin the beds, banks or shores of any protected water or wetland
• a violation
� any project which in the judgment of the District staff should be inspected due
to project location, scope, or construction techniques
In these cases, the applicant shall pay to the District a fee equal to the actual
costs of field inspection of the work, including investigation of the area affected
by the work, analysis of the work, and any subsequent monitoring of the work,
which in the case of a violation shall be at least$35.
