This was because your property has a 10 ' VJayzata easement for access to the lake and the deed includes the George C.Owen v��io��a right to build a dack. However � placing a dock on the TomPenn easement , which abuts the property line , would not comply TonkaBay with LMCD setback ordinances which require a 10 ' setback Robert Rascop Shorewood from the extended property line , regardless of any RoberiE.Slocum easements . Therefore , the court order allowed the Harrens Woodland to construct a dock which would abut the extension of the north boundary line of the 10—foot easement , bnt was not in any way to protrude into the 10 ' setback. Because this was allowed as a "grandfathered" situation , the dock must be maintained in the configuration and size that existed when the order was issued . The dock that existed at the time of the court order wae approximately 40 ' long with no canopy or side extensions . Note further that a canopy requires a 20 ' setback. T� }�rin�o vqLr' current dock into compliance , it will be necessary to remove the dock sections which are for the canopy, as well as the dock extension to the south which encroaches into the setback . Next year_ and in subsequent qears , only a straight , 40 ' dock is allowed unless you have permission from the owners of the property on which your dock is located .
